1414 This bill makes appropriations for the support,

2525 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2626 Section 1. There is hereby appropriated for the support
2727 of public education in Alabama for the fiscal year ending
2828 September 30, 2024, for debt service, and for capital outlay
2929 to be paid out of funds specified in subsection (a) of Section
3030 2 of this act, the amounts specified in subsections (a), (b),
3131 (c), (d), and (e) of Section 3 of this act. For the purpose
3232 specified in subsection (b) of Section 2 of this act, amounts
3333 are shown by programmatic area and the total for all programs
3434 is shown so as to include estimated sources of funds other

6464 For the purpose of this act, "ETF" shall mean the Education
6565 Trust Fund and "Federal and Local Funds" shall mean all gifts,
6666 grants, contributions, or entitlements, including grants by

6868 Section 2. (a) The appropriations provided for in this
6969 act shall be paid from funds in the State Treasury to the
7070 credit of the Education Trust Fund, Alabama Peace Officers'
7171 Standards and Training Fund, Impaired Drivers Trust Fund,
7272 Driver Education and Training Fund, Special Education
7373 Catastrophic Fund, Public School Fund and other listed funds
7474 and are hereby made for the support of public education in
7575 Alabama for the fiscal year ending September 30, 2024, and the
7676 appropriations herein made shall be subject to the provisions,
7777 terms, conditions and limitations of the Budget and Financial
7878 Control Act (Code of Alabama 1975, Sections 41-4-80 et seq.),
7979 the provisions of the Budget Management Act of 1976 (Code of
8080 Alabama 1975, Sections 41-19-1 et seq.), and shall be in the
8181 amounts hereinafter specified.
8282 (b) Amounts shown hereinunder the columns "Other Funds"
8383 and "Total" are as set forth for the purpose of establishing
8484 amounts estimated to be available by programmatic area from
8585 sources other than those listed in subsection (a) of this
8686 Section 2, in order, upon consideration of such other funds so
8787 estimated to be available, to promote the accountability for

339339 To manage the Alabama Credential Registry, to develop the annual Compendium of Valuable
340340 Credentials by using the two-tiered non-degree credential quality assurance review process
341341 established in the bylaws of the Alabama Committee on Credentialing and Career Pathways, and to
342342 provide technical assistance to credential providers in registering credentials to the Alabama

345345 Of this appropriation, $2,400,000 shall be expended for the Teacher Registered Apprenticeship
346346 Pilot Program. Pilot program funds shall be allocated to local education agencies based on
347347 contracts established with the Alabama Office of Apprenticeship for each apprentice and shall
348348 be used for the reimburesment of wages, the costs of related technical instruction for
349349 registered apprentices, and the costs of stipends for journeyworker teachers supervising
350350 registered apprentices. The maximum allowable reimbursement to a local agency will be $60,000
351351 per apprentice. The Secretary of the Department of Commerce shall report semi-annually to the
352352 Chairs of the Senate Committee on Finance and Taxation-Education, the House Ways and
353353 Means-Education Committee and the Legislative Fiscal Officer any funds allocated for the
354354 Teacher Registered Apprenticeship Pilot Program.

362362 The funds appropriated for Workforce Development are to be expended for those costs
363363 incurred by the State in honoring commitments to pay workforce development costs,
364364 including services and other assistance and expenses of recruitment and training of
365365 a company's workforce, that are undertaken to induce companies to locate and expand
366366 their operations in Alabama (described hereinafter as a "Project") and to develop
367367 and implement training, placement and recruitment programs that will improve
368368 development and expand the State's workforce. Such costs include, but are not
369369 limited to: (i) AIDT operating costs directly related to a Project; (ii) wages and
370370 benefits for trainers engaged by AIDT for the purpose of a Project; (iii) costs

406406 which the State has agreed to pay under the terms of a Project Agreement with a
407407 company that are necessary and reasonable charges incurred by the company or its
408408 affiliates for personnel providing training to the company's employees, whether
409409 those trainers are employees of the company or its vendors or suppliers, including
410410 wages, benefits and travel (domestic and, when necessary, international); (iv) any
411411 necessary materials, equipment, manuals, or other relevant training materials; (v)
412412 the costs incurred for purchasing or repairing or replacing training tools and
413413 equipment; (vi) costs incurred for the purchase or construction and maintenance of
414414 training facilities; (vii) travel expenses for prospective and current employees and
415415 trainees, including travel, food, lodging, relocation, and other costs necessary and
416416 reasonable to enable the company to secure a qualified workforce; and (viii) outside
417417 training fees. The above funds appropriated for Workforce Development shall be
418418 expended primarily for the training of Alabama residents. It is further the intent
419419 that contracts with vendors to provide workforce training shall be inclusive and
420420 reflect the racial and gender diversity of the State. The Secretary of the
421421 Department of Commerce shall report semi-annually to the Chairs of the Senate
422422 Committee on Finance and Taxation-Education, the House Ways and Means-Education
423423 Committee and the Legislative Fiscal Officer any funds allocated for workforce
424424 training. Such report shall include a summary of the persons trained and the vendors
425425 providing the training. The report shall contain information including the
426426 residence, race and gender of the persons trained and of the principal or majority
427427 owner of the firm or business contracted with to provide the training services.

698698 administration of the scholarships. Scholarship recipients shall be selected
699699 by the Board, in consultation with a scholarship committee, comprised of
700700 members of the Board of Directors of the Alabama Automotive Manufacturers
701701 Association, from applications submitted to the association. The Board shall

962962 shall give preference to dentists that reside in a county with a dentist shortage, and shall

965965 counties eligible for the loan recipient. Annually the Board shall compile a list of ten
966966 counties for the loan recipient to choose from to practice. The recipient must spend an average
967967 of 20 hours a week on an annual basis practicing direct patient care in the designated county
968968 for a minimum of 5 years to qualify for forgiveness of the loan. The Board shall file a report

50355035 the Elementary and Secondary School Emergency Relief Fund for
50365036 one-time, non-recurring allowable expenses to address the
50375037 coronavirus pandemic in Alabama public schools. The
50385038 Superintendent shall periodically report to the Finance
50395039 Director, Chairs of the Senate Finance and Taxation-Education
50405040 Committee, the House Ways and Means-Education Committee, and
50415041 the Legislative Fiscal Officer, regarding the planned and
50425042 actual expenditures of these funds by the Local Education
50435043 Agencies.
50445044 (c) The Local Education Agencies shall expend no less
50455045 than $100,000,000 of all federal stimulus funds provided by
50465046 the Congress of the United States to address the coronavirus
50475047 pandemic in Alabama public schools to implement the safely
50485048 opening schools program, to include, but not limited to:
50495049 screening, testing, isolation and quarantine of students and
50505050 school personnel with symptoms, in order to protect students,
50515051 teachers, and support personnel for schools to return to
50525052 full-time in-person education. Local school boards shall have
50535053 the choice to utilize the funds for the above purposes to the
50545054 degree that meets their individual needs.
50555055 Section 5. The State Superintendent of Education shall
50565056 make requisitions to the State Comptroller in favor of the
50575057 proper beneficiary in accordance with the law and rules and
50585058 regulations governing the expenditure or disbursement of any
50595059 and all funds appropriated to the State Department of
50605060 Education and/or the State Board of Education in this act,
50615061 whereupon the Comptroller shall issue her warrant therefor.

50935093 Section 6. Nothing in this act shall be construed to
50945094 affect or repeal any law authorizing or permitting any

50965096 of the State to receive, collect or disburse any fees,
50975097 tuitions, charges, sales, endowments, trusts or income

51045104 Section 7. The appropriations made herein to the

51065106 include the amounts necessary and said departments, boards,
51075107 offices, commissions, and agencies are hereby directed to make
51085108 the transfer of funds to the State Personnel Department in the
51095109 amounts enumerated in the general appropriations act for the
51105110 fiscal year ending September 30, 2024. All agencies and
51115111 institutions enumerated in this act that receive services from
51125112 other governmental agencies enumerated in this act or the
51135113 general appropriations act shall make full payment in a timely

51455145 year appropriation other than the exclusions authorized by the

52025202 Section 12. The appropriations made herein to the

52185218 Section 14. (a) The At-Risk and High Hopes
52195219 appropriations made to the State Department of Education shall
52205220 be expended as follows: 50% shall be at the discretion of the
52215221 State Superintendent of Education and 50% shall be awarded in
52225222 the form of grants to school systems/entities for activities
52235223 or programs designed to enhance outcomes for At-Risk Students.
52245224 At-Risk Students shall be defined as students who have not met

52635263 reading and mathematics abilities in students, activities that

52685268 criterion. Funds should be awarded on a per-pupil basis, with
52695269 no more than ten percent of the grant award going toward

52715271 (b) In an effort to provide the best and most efficient
52725272 implementation for intervention and innovation in schools,
52735273 administration of the grant awards shall be assigned to the
52745274 Alabama State Department of Education's Division of
52755275 Administrative and Financial Support with evaluative input
52765276 from other Alabama State Department of Education advisory
52775277 personnel, including the State Superintendent of Education, as
52785278 appropriate. The grant application process must require
52795279 districts to submit plans to the Alabama State Department of
52805280 Education detailing their intended use of the grant funds with

53115311 new school year. Notwithstanding the foregoing, the Alabama
53125312 State Department of Education's Division of Administrative and
53135313 Financial Support shall make every reasonable effort to notify

53155315 be available until October 1, 2023. Grantees will have no
53165316 guarantee of funding until October 1, 2023.
53175317 (c) Upon the awarding of any grant funds, the Alabama
53185318 State Department of Education must submit a report to the
53195319 Chairs of the House Ways and Means-Education Committee, the
53205320 Senate Committee on Finance and Taxation-Education and the
53215321 Legislative Fiscal Officer that shall indicate the
53225322 grant-recipient districts and each district’s plan for those
53235323 funds. Those districts shall submit follow-up reports
53245324 indicating the results of those plans from the previous school
53255325 year by July 31, 2024.
53265326 Section 15. (a) All nongovernmental entities,
53275327 identified by the Legislative Services Agency, which are
53285328 allocated funds in Section 3 of this act shall file a report
53295329 with the Chairs of the House Ways and Means-Education
53305330 Committee, the Senate Committee on Finance and
53315331 Taxation-Education, Finance Director, and the Legislative
53325332 Fiscal Officer prior to the start of the 2024 Regular Session,
53335333 regarding the proposed expenditures and usage of the funds
53345334 appropriated in the fiscal year ending September 30, 2024. The
53355335 Legislative Services Agency shall provide notice to the

53685368 (b) In the event an entity was appropriated funds from
53695369 the Education Trust Fund in the fiscal year ending September
53705370 30, 2023, the entity shall also include in its report a
53715371 detailed breakdown of the expenditure and use of those funds,
53725372 including an inventory of the services delivered and number of
53735373 clients served, pursuant to guidelines established by the
53745374 Legislative Services Agency.
53755375 Section 16. The State Superintendent of Education shall
53765376 notify each local superintendent and finance officer of each
53775377 local education agency by email regarding the availability and
53785378 application process, including any required forms, for any
53795379 available grant opportunities during FY 2024. The State
53805380 Superintendent shall notify all members of the local
53815381 legislative delegation five days prior to the announcement of
53825382 any grant made to any entity located in the legislative
53835383 jurisdiction. The five days prior notice requirement shall be
53845384 waived in the event of a declared emergency. The Governor
53855385 shall encourage the Department to disburse the funds provided
53865386 herein on a nondiscriminatory basis.
53875387 Section 17. If any section, paragraph, sentence,
53885388 clause, provision or portion of this act or all or any portion
53895389 of the appropriations herein made is held unconstitutional or
