17+SYNOPSIS:
18+Under existing law, certain motor vehicles and
19+operators are exempt from the requirement that every
20+motor vehicle registered in this state shall be covered
21+by a liability insurance policy, a commercial
22+automobile liability insurance policy, motor vehicle
23+liability bond, or deposit of cash of minimum coverage
24+limits.
25+This bill would provide an additional exception
26+to allow an individual on active military duty, whose
27+motor vehicle is registered in Alabama but who, as a
28+result of his or her military assignment, is required
29+to reside in another state, to satisfy the requirement
30+for mandatory motor vehicle liability insurance by
31+purchasing liability coverage in the state where
32+residing on active military duty or assignment in an
33+amount equal to or greater than the minimum amount
34+required in Alabama.

2038 Relating to mandatory motor vehicle liability
21-insurance; to amend Section 32-7A-5, Code of Alabama 1975, to
22-provide an exception to allow an individual on active military
23-duty, whose motor vehicle is registered in Alabama but who, as
24-a result of his or her military assignment, is required to
25-reside in another state, to satisfy the requirement for
26-mandatory motor vehicle liability insurance by purchasing
27-liability coverage in the state where residing on active
28-military duty or assignment in an amount equal to or greater
29-than the minimum amount required in Alabama.
30-BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
31-Section 1. Section 32-7A-5, Code of Alabama 1975, is
32-amended to read as follows:
33-"§32-7A-5
34-(a) This chapter shall not apply to any of the
35-following vehicles or operators:
36-(1) Trailers as defined in Section 40-12-240,
37-including, but not limited to, semitrailers, travel trailers,
38-boat trailers, pole trailers, and utility trailers.
39-(2) Motor vehicles owned and operated by the United
40-States or any agency thereof, the State of Alabama, or any
41-political or governmental subdivision thereof.
42-(3) Any motor vehicle which is subject to the
43-supervision and regulation of the Federal Motor Carrier Safety
44-Administration or the Alabama Public Service Commission and

68+insurance; to amend Section 32-7A-5, Code of Alabama 1975, to

77+BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
78+Section 1. Section 32-7A-5, Code of Alabama 1975, is
79+amended to read as follows:
80+"§32-7A-5
81+(a) This chapter shall not apply to any of the
82+following vehicles or operators:
83+(1) Trailers as defined in Section 40-12-240,
84+including, but not limited to, semitrailers, travel trailers,
85+boat trailers, pole trailers, and utility trailers.
86+(2) Motor vehicles owned and operated by the United
87+States or any agency thereof, the State of Alabama, or any

89+(3) Any motor vehicle which is subject to the
90+supervision and regulation of the Federal Motor Carrier Safety
91+Administration or the Alabama Public Service Commission and
7492 for which the owner and/or operator has filed evidence of
7593 financial responsibility, the liability under which is not
7694 less than that required of the operator of a motor vehicle
7795 under the terms of this chapter.
78-(4) Motor vehicles covered by a certificate of
79-self-insurance issued by the director under the provisions of
80-Section 32-7-34.
81-(5) Other motor vehicles complying with laws which
82-require the vehicles to be insured in amounts meeting or
83-exceeding the minimum amounts required under Section
84-32-7-6(c).
85-(6) Implements of husbandry as defined in Section
86-32-8-2.
87-(7) Any vehicle moved solely by animal power.
88-(8) Special mobile equipment, as defined in Section
89-32-8-2.
90-(9) Inoperable or stored motor vehicles for which the
91-registrant has surrendered the registration and associated
92-license plate in accordance with the rules adopted by the
93-department prior to the motor vehicle no longer being covered
94-by a liability insurance policy required by this chapter.
95-(10) Motor vehicles owned by a licensed motor vehicle
96-dealer, wholesaler, or rebuilder and held in inventory that
97-are covered by a blanket liability insurance policy or
98-commercial automobile liability insurance policy.
99-(11) Vehicles properly registered in another
100-jurisdiction and not legally required to be registered
101-pursuant to Chapter 12 of Title 40.

125+(4) Motor vehicles covered by a certificate of

131149 (12) Vehicles owned by a bank, a subsidiary or
132150 affiliate of a bank, or finance company, acquired as an
133151 incident to their regular business, that are covered by a
134152 blanket liability insurance policy or commercial automobile
135-liability insurance policy.
136-(13) Vehicles as prescribed by the commissioner that
137-are covered by a blanket liability insurance policy or
138-commercial automobile liability insurance policy.
139-(b) An individual on active duty with the United States
140-Armed Forces whose motor vehicle is registered in this state
141-but who, as a result of his or her military duty or assignment
142-is required to reside in another state during the registration
143-period as defined under Section 32-6-61, may satisfy the
144-requirements of this chapter by purchasing liability coverage
145-in the state where residing on active military duty or
146-assignment equal to or greater than the minimum amount
147-required by Section 32-7A-4 and providing proof of coverage.
148-An individual's purchase of liability coverage under this
149-subsection shall not invalidate his or her license or
150-registration in this state pursuant to Chapter 6 of Title 32. "
151-Section 2. This act shall become effective January 1,
152-2024, following its passage and approval by the Governor, or
153-its otherwise becoming law.
