1515 SYNOPSIS:
1616 Under existing law, hemp and products derived
1717 from hemp may be sold at retail in Alabama.
1818 This bill would prohibit the sale, distribution,
1919 marketing, or possession of psychoactive cannabinoids
2020 derived from or found in hemp to any individual under
2121 21 years of age.
2222 This bill would also levy a five percent tax on
2323 the gross proceeds of the sale of products containing
2424 psychoactive cannabinoids.
2525 Section 111.05 of the Constitution of Alabama of
2626 2022, prohibits a general law whose purpose or effect
2727 would be to require a new or increased expenditure of
2828 local funds from becoming effective with regard to a
2929 local governmental entity without enactment by a 2/3
3030 vote unless: it comes within one of a number of
3131 specified exceptions; it is approved by the affected
3232 entity; or the Legislature appropriates funds, or
3333 provides a local source of revenue, to the entity for
3434 the purpose.
3535 The purpose or effect of this bill would be to
3636 require a new or increased expenditure of local funds
3737 within the meaning of the amendment. However, the bill
3838 does not require approval of a local governmental
3939 entity or enactment by a 2/3 vote to become effective

7373 AN ACT
7474 Relating to cannabis; to prohibit the sale,
7575 distribution, marketing, or possession of psychoactive
7676 cannabinoids found in hemp for certain age groups; to levy a
7777 five percent tax on the gross proceeds of products containing
7878 psychoactive cannabinoids sold at retail; and in connection
7979 therewith would have as its purpose or effect the requirement
8080 of a new or increased expenditure of local funds within the
8181 meaning of Section 111.05 of the Constitution of Alabama of
8282 2022.
8383 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
8484 Section 1. (a) Except as provided in Chapter 2A of
8585 Title 20, Code of Alabama 1975, psychoactive cannabinoids
8686 derived from or found in hemp as defined in Section 2-8-381,
8787 Code of Alabama 1975, including, but not limited to,
8888 delta-8-tetrahydrocannabinol and
8989 delta-10-tetrahydrocannabinol, shall not be sold, distributed,
9090 marketed to, or possessed by an individual who is under 21
9191 years of age.
9292 (b) A violation of subsection (a) shall be a Class B
9393 misdemeanor.

123123 Section 2. Commencing October 1, 2023, there is levied,
124124 in addition to all other taxes of every kind now imposed by
125125 law, and shall be collected and remitted in accordance with
126126 Article 1, commencing with Section 40-23-1, of Chapter 23 of
127127 Title 40, Code of Alabama 1975, a tax on the gross proceeds of
128128 the sales of any product containing psychoactive cannabinoids
129129 when sold at retail in this state at the rate of five percent
130130 of the gross proceeds of the sales. For purposes of this
131131 section, "psychoactive cannabinoids" means psychoactive
132132 cannabinoids derived from or found in hemp as defined in
133133 Section 2-8-381, Code of Alabama 1975, including, but not
134134 limited to, delta-8-tetrahydrocannabinol and
135135 delta-10-tetrahydrocannabinol, but does not include medical
136136 cannabis regulated under Chapter 2A of Title 20, Code of
137137 Alabama 1975.
138138 Section 3. Although this bill would have as its purpose
139139 or effect the requirement of a new or increased expenditure of
140140 local funds, the bill is excluded from further requirements
141141 and application under Section 111.05 of the Constitution of
142142 Alabama of 2022, because the bill defines a new crime or
143143 amends the definition of an existing crime.
144144 Section 4. This act shall become effective on the first
145145 day of the third month, following its passage and approval by
146146 the Governor or its otherwise becoming law.
