15+AN ACT
1616 Relating to Cherokee County; to amend Section
1717 45-10-201, Code of Alabama 1975, to provide for the transfer
1818 of the duties of the license commissioner to the revenue
1919 commissioner; and to make nonsubstantive, technical revisions
2020 to update the existing code language to current style.
2121 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2222 Section 1. Section 45-10-201, Code of Alabama 1975, is
2323 amended to read as follows:
2424 "ยง45-10-201
2525 There is hereby created within the Cherokee County
2626 Courthouse the permanent office of license commissioner. The
2727 duties and responsibilities of the office shall be performed
2828 by the Probate Judge Revenue Commissioner of Cherokee County
2929 as herein provided. The county commission shall furnish the
3030 license commissioner with suitable quarters and provide the
3131 necessary forms, books, stationery, records, equipment, and
3232 supplies, except such stationery, forms, and supplies as are
3333 furnished pursuant to law by the state Department of Finance
3434 or the state Comptroller. The county commission shall insure
3535 ensure that the office has sufficient help and shall provide
36-clerks and other assistants for the office as shall be
37-necessary, from time to time, for the proper and efficient
38-performance of the duties of the office. The probate judge
39-license commissioner is hereby authorized to employ the clerks
40-and other assistants, and to fix their compensation; however,
41-the number and compensation of clerks and other assistants

65+clerks and other assistants for the office as shall be
66+necessary, from time to time, for the proper and efficient
67+performance of the duties of the office. The probate judge
68+license commissioner is hereby authorized to employ the clerks
69+and other assistants, and to fix their compensation; however,
70+the number and compensation of clerks and other assistants
7171 shall be subject to the approval of the county commission. The
7272 compensation of the clerks and assistants shall be paid
7373 monthly biweekly out of the general fund of the county in the
7474 same manner as other county employees are paid. The duties of
7575 the license commissioner shall not include the renewal of
7676 driver licenses or the issuance or renewal of business,
7777 hunting, or fishing licenses. "
7878 Section 2. The provisions of this act are supplemental
7979 to any laws relating to the operation of the Office of the
8080 Cherokee County License Commissioner.
8181 Section 3. This act shall become effective on July 1,
8282 2023, following its passage and approval by the Governor, or
8383 its otherwise becoming law.
