15+AN ACT
1416 Relating to Autauga County; to further provide for the
1517 regulation of the sale of alcoholic beverages in the
1618 unincorporated areas of the county; to authorize the Autauga
1719 County Commission to issue a separate county business license
1820 for any person or business required to have a retail license
1921 from the Alcoholic Beverage Control (ABC) Board for the sale
2022 of alcoholic beverages in the unincorporated areas of the
2123 county; and to provide for a fee for the license and for the
2224 enforcement of this requirement.
2325 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2426 Section 1. This act shall apply only in Autauga County
2527 in the unincorporated areas of the county.
2628 Section 2. For the purposes of this act, the term
2729 "unincorporated area of the county" means any area of the
2830 county outside of the corporate limits of an operating
2931 municipality with an elected mayor and municipal council.
3032 Section 3. In the unincorporated areas of Autauga
3133 County, the Autauga County Commission may authorize the sale
3234 of draft or keg beer for on-premises or off-premises
3335 consumption, or both, by any retail licensee of the Alabama
34-Beverage Control (ABC) Board, except the county commission
35-shall not authorize the sale of draft beer in any container
36-larger than 64 ounces. Except as authorized above, the sale of
37-draft or keg beer for off-premises consumption in a keg or
38-other similar container is strictly prohibited. Any licensee

65+Beverage Control (ABC) Board, except the county commission
66+shall not authorize the sale of draft beer in any container
67+larger than 64 ounces. Except as authorized above, the sale of
68+draft or keg beer for off-premises consumption in a keg or
69+other similar container is strictly prohibited. Any licensee
6870 of the ABC Board selling draft beer shall be in compliance
6971 with the requirements of the Responsible Vendor Program of the
7072 board.
7173 Section 4. In the unincorporated areas of Autauga
7274 County, the Autauga County Commission may authorize any
7375 properly licensed retail licensee of the ABC Board serving the
7476 general public to sell alcoholic beverages for on-premises or
7577 off-premises consumption, or both, on Sunday after 12:00 p.m.
7678 Any licensee selling alcoholic beverages on Sunday shall be in
7779 compliance with the requirements of the Responsible Vendor
7880 Program of the board.
7981 Section 5. (1) Effective October 1, 2023, the Autauga
8082 County Commission, by resolution of the county commission, may
8183 require each individual or entity selling alcoholic beverages
8284 in the unincorporated area of the county for on-premises
8385 consumption to have a separate business license to sell
8486 alcoholic beverages. The Autauga County Commission may set the
8587 requirements for the individual or entity to sell alcoholic
8688 beverages for on-premises consumption in addition to the
8789 requirements for a license from the ABC Board.
8890 (2) After the implementation of the license required by
8991 this section, no individual or entity may sell alcoholic
9092 beverages in the unincorporated area of the county for
91-on-premises consumption without a valid county business
92-license. The fees for the issuance of the business license
93-shall not exceed two hundred dollars ($200) per year as set by
94-the county commission. The fee for a business license may vary
95-based on the type of license issued by the ABC Board.

122+on-premises consumption without a valid county business
123+license. The fees for the issuance of the business license
124+shall not exceed two hundred dollars ($200) per year as set by
125+the county commission. The fee for a business license may vary
126+based on the type of license issued by the ABC Board.
125127 (3) The requirements for a business license pursuant to
126128 this section may include the following:
127129 a. Inspections relating to fire safety as determined
128130 necessary by the State Fire Marshal and compliance with any
129131 requirements of the inspection, including maximum occupancy of
130132 the premises.
131133 b. Compliance with all requirements and inspections of
132134 the Autauga County Health Department relating to food and
133135 beverage service and septic or sewer service.
134136 (4) Any violations of the requirements of this section
135137 may result in the denial of a license or the revocation of the
136138 license. The Autauga County Commission may enforce the
137139 provisions of this section by appropriate injunctive relief in
138140 the Circuit Court of Autauga County.
139141 Section 6. This act is enacted pursuant to the
140142 authority of Section 104 of the Constitution of Alabama of
141143 2022.
142144 Section 7. This act shall become effective on the first
143145 day of the third month following its passage and approval by
144146 the Governor, or its otherwise becoming law.
