22 | 24 | | enforcement of this requirement. |

23 | 25 | | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: |
---|
24 | 26 | | Section 1. This act shall apply only in Autauga County |
---|
25 | 27 | | in the unincorporated areas of the county. |
---|
26 | 28 | | Section 2. For the purposes of this act, the term |
---|
27 | 29 | | "unincorporated area of the county" means any area of the |
---|
28 | 30 | | county outside of the corporate limits of an operating |
---|
29 | 31 | | municipality with an elected mayor and municipal council. |
---|
30 | 32 | | Section 3. In the unincorporated areas of Autauga |
---|
31 | 33 | | County, the Autauga County Commission may authorize the sale |
---|
32 | 34 | | of draft or keg beer for on-premises or off-premises |
---|
33 | 35 | | consumption, or both, by any retail licensee of the Alabama |
---|
68 | 70 | | of the ABC Board selling draft beer shall be in compliance |
---|
69 | 71 | | with the requirements of the Responsible Vendor Program of the |
---|
70 | 72 | | board. |
---|
71 | 73 | | Section 4. In the unincorporated areas of Autauga |
---|
72 | 74 | | County, the Autauga County Commission may authorize any |
---|
73 | 75 | | properly licensed retail licensee of the ABC Board serving the |
---|
74 | 76 | | general public to sell alcoholic beverages for on-premises or |
---|
75 | 77 | | off-premises consumption, or both, on Sunday after 12:00 p.m. |
---|
76 | 78 | | Any licensee selling alcoholic beverages on Sunday shall be in |
---|
77 | 79 | | compliance with the requirements of the Responsible Vendor |
---|
78 | 80 | | Program of the board. |
---|
79 | 81 | | Section 5. (1) Effective October 1, 2023, the Autauga |
---|
80 | 82 | | County Commission, by resolution of the county commission, may |
---|
81 | 83 | | require each individual or entity selling alcoholic beverages |
---|
82 | 84 | | in the unincorporated area of the county for on-premises |
---|
83 | 85 | | consumption to have a separate business license to sell |
---|
84 | 86 | | alcoholic beverages. The Autauga County Commission may set the |
---|
85 | 87 | | requirements for the individual or entity to sell alcoholic |
---|
86 | 88 | | beverages for on-premises consumption in addition to the |
---|
87 | 89 | | requirements for a license from the ABC Board. |
---|
88 | 90 | | (2) After the implementation of the license required by |
---|
89 | 91 | | this section, no individual or entity may sell alcoholic |
---|
90 | 92 | | beverages in the unincorporated area of the county for |
---|
125 | 127 | | (3) The requirements for a business license pursuant to |
---|
126 | 128 | | this section may include the following: |

127 | 129 | | a. Inspections relating to fire safety as determined |
---|
128 | 130 | | necessary by the State Fire Marshal and compliance with any |
---|
129 | 131 | | requirements of the inspection, including maximum occupancy of |
---|
130 | 132 | | the premises. |
---|
131 | 133 | | b. Compliance with all requirements and inspections of |
---|
132 | 134 | | the Autauga County Health Department relating to food and |
---|
133 | 135 | | beverage service and septic or sewer service. |
---|
134 | 136 | | (4) Any violations of the requirements of this section |
---|
135 | 137 | | may result in the denial of a license or the revocation of the |
---|
136 | 138 | | license. The Autauga County Commission may enforce the |
---|
137 | 139 | | provisions of this section by appropriate injunctive relief in |
---|
138 | 140 | | the Circuit Court of Autauga County. |
---|
139 | 141 | | Section 6. This act is enacted pursuant to the |
---|
140 | 142 | | authority of Section 104 of the Constitution of Alabama of |
---|
141 | 143 | | 2022. |

142 | 144 | | Section 7. This act shall become effective on the first |
---|
143 | 145 | | day of the third month following its passage and approval by |
---|
144 | 146 | | the Governor, or its otherwise becoming law. |
