14	14	This bill would propose an amendment to the
15	15	Constitution of Alabama of 2022, relating to Baldwin
16	16	County to define the Bon Secour Landmark District
17	17	within the county and to prohibit the annexation by
18	18	local law of any property within the district into any
19	19	municipality except under certain conditions.
20	20	A BILL
21	21	TO BE ENTITLED
22	22	AN ACT
23	23	This bill would propose an amendment to the
24	24	Constitution of Alabama of 2022, relating to Baldwin County,
25	25	to define the Bon Secour Landmark District within the county
26	26	and to prohibit the annexation by local law of any property
27	27	within the district into any municipality except under certain
28	28	conditions.
29	29	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
30	30	Section 1. The following amendment to the Constitution
31	31	of Alabama of 2022, is proposed and shall become valid as a
32	32	part of the constitution when all requirements of this act are
33	33	fulfilled:

64	64	(a) For the purposes of this amendment, the "Bon Secour
65	65	Landmark District" in Baldwin County is defined as follows:
66	66	Beginning at the intersection of the centerline of
67	67	County Road 12 S and the centerline County Road 49; thence run
68	68	Easterly along the centerline of County Road 12 S to the
69	69	intersection of the centerline of County Road 12 S and the
70	70	centerline of County Road 65; thence run Southerly along the
71	71	centerline of County Road 65 a distance of 3,192 feet, more or
72	72	less, to a point; thence run Easterly 30 feet, more or less,
73	73	to the projected west boundary line of parcel
74	74	05-61-04-39-0-000-001.000; thence run Easterly along the north
75	75	line of said parcel to the centerline of Bon Secour River;
76	76	thence run Southwesterly following the meanderings along the
77	77	centerline and of Bon Secour River approximately 2,500 feet,
78	78	more of less, to the intersection of Keller Road; thence run
79	79	Easterly along the centerline of Keller Rd to the intersection
80	80	of the centerline of Keller Road and the centerline of Helton
81	81	Drive; thence run Southerly along the centerline of Helton

191	191	(b) No property within the Bon Secour Landmark District
192	192	may be annexed into any municipality by local law.
193	193	(c) Subsection (b) shall not apply to any municipality
194	194	incorporated after the ratification of this amendment which
195	195	includes any part of the Bon Secour Landmark District.
196	196	(d) The Bon Secour Landmark District shall not be
197	197	considered a legal entity and shall not have any of the
198	198	following powers or authority:
199	199	(1) Standing to sue or be sued.
200	200	(2) Taxing authority.
201	201	(3) Zoning authority.
202	202	(4) Police power and public safety authority.
203	203	(5) Authority to adopt ordinances, rules, or
204	204	regulations within its boundaries.

234	234	(6) Any other authority or power commonly associated
235	235	with a legal entity.
236	236	Upon ratification of this constitutional amendment, the
237	237	Code Commissioner shall number and place this amendment as
238	238	appropriate in the constitution omitting this instructional
239	239	paragraph and may make the following nonsubstantive revisions:
240	240	change capitalization, spelling, and punctuation for purposes
241	241	of style and uniformity; correct manifest grammatical,
242	242	clerical, and typographical errors; and correct incorrect
243	243	cross-references.
244	244	Section 2. An election upon the proposed amendment
245	245	shall be held in accordance with Sections 284 and 284.01 of
246	246	the Constitution of Alabama of 2022, and the election laws of
247	247	this state.
248	248	Section 3. The appropriate election official shall
249	249	assign a ballot number for the proposed constitutional
250	250	amendment on the election ballot and shall set forth the
251	251	following description of the substance or subject matter of
252	252	the proposed constitutional amendment:
253	253	"Relating to Baldwin County, proposing an amendment to
254	254	the Constitution of Alabama of 2022, to define the Bon Secour
255	255	Landmark District within the county and to prohibit the
256	256	annexation by local law of any property within the district
257	257	into any municipality except under certain conditions.
258	258	Proposed by Act ____."
259	259	This description shall be followed by the following
260	260	language:
