1313 SYNOPSIS:
1414 This bill would propose an amendment to the
1515 Constitution of Alabama of 2022, relating to Baldwin
1616 County to define the Bon Secour Landmark District
1717 within the county and to prohibit the annexation by
1818 local law of any property within the district into any
1919 municipality except under certain conditions.

2323 This bill would propose an amendment to the
2424 Constitution of Alabama of 2022, relating to Baldwin County,
2525 to define the Bon Secour Landmark District within the county
2626 and to prohibit the annexation by local law of any property
2727 within the district into any municipality except under certain
2828 conditions.
2929 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3030 Section 1. The following amendment to the Constitution
3131 of Alabama of 2022, is proposed and shall become valid as a
3232 part of the constitution when all requirements of this act are
3333 fulfilled:

6464 (a) For the purposes of this amendment, the "Bon Secour
6565 Landmark District" in Baldwin County is defined as follows:
6666 Beginning at the intersection of the centerline of
6767 County Road 12 S and the centerline County Road 49; thence run
6868 Easterly along the centerline of County Road 12 S to the
6969 intersection of the centerline of County Road 12 S and the
7070 centerline of County Road 65; thence run Southerly along the
7171 centerline of County Road 65 a distance of 3,192 feet, more or
7272 less, to a point; thence run Easterly 30 feet, more or less,
7373 to the projected west boundary line of parcel
7474 05-61-04-39-0-000-001.000; thence run Easterly along the north
7575 line of said parcel to the centerline of Bon Secour River;
7676 thence run Southwesterly following the meanderings along the
7777 centerline and of Bon Secour River approximately 2,500 feet,
7878 more of less, to the intersection of Keller Road; thence run
7979 Easterly along the centerline of Keller Rd to the intersection
8080 of the centerline of Keller Road and the centerline of Helton
8181 Drive; thence run Southerly along the centerline of Helton
8282 Drive to the intersection of the centerline of Helton Drive
8383 and the centerline of County Road 10; thence run Westerly

191191 (b) No property within the Bon Secour Landmark District
192192 may be annexed into any municipality by local law.
193193 (c) Subsection (b) shall not apply to any municipality
194194 incorporated after the ratification of this amendment which
195195 includes any part of the Bon Secour Landmark District.
196196 (d) The Bon Secour Landmark District shall not be
197197 considered a legal entity and shall not have any of the
198198 following powers or authority:
199199 (1) Standing to sue or be sued.
200200 (2) Taxing authority.
201201 (3) Zoning authority.
202202 (4) Police power and public safety authority.
203203 (5) Authority to adopt ordinances, rules, or
204204 regulations within its boundaries.

234234 (6) Any other authority or power commonly associated
235235 with a legal entity.
236236 Upon ratification of this constitutional amendment, the
237237 Code Commissioner shall number and place this amendment as
238238 appropriate in the constitution omitting this instructional
239239 paragraph and may make the following nonsubstantive revisions:
240240 change capitalization, spelling, and punctuation for purposes
241241 of style and uniformity; correct manifest grammatical,
242242 clerical, and typographical errors; and correct incorrect
243243 cross-references.
244244 Section 2. An election upon the proposed amendment
245245 shall be held in accordance with Sections 284 and 284.01 of
246246 the Constitution of Alabama of 2022, and the election laws of
247247 this state.
248248 Section 3. The appropriate election official shall
249249 assign a ballot number for the proposed constitutional
250250 amendment on the election ballot and shall set forth the
251251 following description of the substance or subject matter of
252252 the proposed constitutional amendment:
253253 "Relating to Baldwin County, proposing an amendment to
254254 the Constitution of Alabama of 2022, to define the Bon Secour
255255 Landmark District within the county and to prohibit the
256256 annexation by local law of any property within the district
257257 into any municipality except under certain conditions.
258258 Proposed by Act ____."
259259 This description shall be followed by the following
260260 language:
261261 "Yes ( ) No( )."
