15+AN ACT
1616 Relating to the City of Tuscaloosa; to authorize the
1717 City of Tuscaloosa to join the Employees’ Retirement System of
1818 Alabama for its police and firefighter employees and transfer
1919 assets and liabilities of the existing Tuscaloosa Police and
2020 Firefighters Retirement Plan to the Employees' Retirement
2121 System of Alabama as set forth in Chapter 27 of Title 36, Code
2222 of Alabama 1975.
2323 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2424 Section 1. (a) The City of Tuscaloosa, by action of the
2525 city council, may take any action necessary for its police and
2626 firefighter employees to participate in the City of Tuscaloosa
2727 pension plan administered by the Employees' Retirement System
2828 of Alabama pursuant to Section 36-27-6, Code of Alabama 1975,
2929 and the remaining provisions of Chapter 27 of Title 36, Code
3030 of Alabama 1975, and the board for the Tuscaloosa Police and
3131 Firefighters Retirement Plan may transfer any asset and
3232 liability of the Tuscaloosa Police and Firefighters Retirement
3333 Plan to the City of Tuscaloosa pension plan administered by
3434 Employees' Retirement System of Alabama, as necessary for the
3535 police and firefighter employees of the City of Tuscaloosa to
36-participate in the Employees' Retirement System of Alabama.
37-(b) Upon acceptance of the police and firefighter
38-employees of the City of Tuscaloosa into the city's plan
39-administered by the Employees' Retirement System of Alabama
40-and the transfer of all assets and liabilities of the
41-Tuscaloosa Police and Firefighters Retirement Plan to the

65+participate in the Employees' Retirement System of Alabama.
66+(b) Upon acceptance of the police and firefighter
67+employees of the City of Tuscaloosa into the city's plan
68+administered by the Employees' Retirement System of Alabama
69+and the transfer of all assets and liabilities of the
70+Tuscaloosa Police and Firefighters Retirement Plan to the
7171 Employees' Retirement System of Alabama, the City of
7272 Tuscaloosa shall terminate the retirement system established
7373 under Act 1999-568, 1999 Regular Sessions (Acts 1999, p.
7474 1220), as amended, according to the terms and conditions of
7575 the City of Tuscaloosa Police and Firefighters Retirement
7676 Plan.
7777 Section 2. (a) Members who began participation in the
7878 City of Tuscaloosa Police and Firefighters Retirement Plan
7979 prior to January 1, 2013, and who elect to join the Employees'
8080 Retirement System in accordance with Section 36-27-6(b), Code
8181 of Alabama 1975, shall be Tier I plan participants as set
8282 forth in Chapter 27 of Title 36, Code of Alabama 1975.
8383 (b) Members who began participation in the City of
8484 Tuscaloosa Police and Firefighters Retirement Plan on or after
8585 January 1, 2013, and who elect to join the Employees'
8686 Retirement System in accordance with Section 36-27-6(b), Code
8787 of Alabama 1975, shall be Tier II plan participants, unless
8888 prior employment with a participating employer establishes
8989 them as Tier I participants, as set forth in Chapter 27 of
9090 Title 36, Code of Alabama 1975.
9191 (c) Police or firefighter employees who begin
9292 employment with the City of Tuscaloosa on or after the date
93-that police and firefighter employees of the City of
94-Tuscaloosa begin participation in the Employees’ Retirement
95-System of Alabama shall participate in the Employees’
96-Retirement System of Alabama in accordance with Section
97-36-27-6(c), Code of Alabama 1975.
98-Section 3. The amounts certified each year to the chief

122+that police and firefighter employees of the City of
123+Tuscaloosa begin participation in the Employees’ Retirement
124+System of Alabama shall participate in the Employees’
125+Retirement System of Alabama in accordance with Section
126+36-27-6(c), Code of Alabama 1975.
127+Section 3. The amounts certified each year to the chief
128128 financial officer of the City of Tuscaloosa pursuant to
129129 Section 36-27-6(f), Code of Alabama, 1975, shall be included
130130 in the respective budget of the city in accordance with the
131131 city’s legal budget procedure.
132132 Section 4. The provisions of this act are severable. If
133133 any part of this act is declared invalid or unconstitutional,
134134 that declaration shall not affect the part which remains.
135135 Section 5. All laws or parts of laws which conflict
136136 with this act are repealed.
137137 Section 6. This act shall become effective on the first
138138 day of the third month following its passage and approval by
139139 the Governor, or its otherwise becoming law.
