	15	+	AN ACT
16	16		Relating to the City of Tuscaloosa; to authorize the
17	17		City of Tuscaloosa to join the Employees’ Retirement System of
18	18		Alabama for its police and firefighter employees and transfer
19	19		assets and liabilities of the existing Tuscaloosa Police and
20	20		Firefighters Retirement Plan to the Employees' Retirement
21	21		System of Alabama as set forth in Chapter 27 of Title 36, Code
22	22		of Alabama 1975.
23	23		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
24	24		Section 1. (a) The City of Tuscaloosa, by action of the
25	25		city council, may take any action necessary for its police and
26	26		firefighter employees to participate in the City of Tuscaloosa
27	27		pension plan administered by the Employees' Retirement System
28	28		of Alabama pursuant to Section 36-27-6, Code of Alabama 1975,
29	29		and the remaining provisions of Chapter 27 of Title 36, Code
30	30		of Alabama 1975, and the board for the Tuscaloosa Police and
31	31		Firefighters Retirement Plan may transfer any asset and
32	32		liability of the Tuscaloosa Police and Firefighters Retirement
33	33		Plan to the City of Tuscaloosa pension plan administered by
34	34		Employees' Retirement System of Alabama, as necessary for the
35	35		police and firefighter employees of the City of Tuscaloosa to
36		-	participate in the Employees' Retirement System of Alabama.
37		-	(b) Upon acceptance of the police and firefighter
38		-	employees of the City of Tuscaloosa into the city's plan
39		-	administered by the Employees' Retirement System of Alabama
40		-	and the transfer of all assets and liabilities of the
41		-	Tuscaloosa Police and Firefighters Retirement Plan to the

	65	+	participate in the Employees' Retirement System of Alabama.
	66	+	(b) Upon acceptance of the police and firefighter
	67	+	employees of the City of Tuscaloosa into the city's plan
	68	+	administered by the Employees' Retirement System of Alabama
	69	+	and the transfer of all assets and liabilities of the
	70	+	Tuscaloosa Police and Firefighters Retirement Plan to the
71	71		Employees' Retirement System of Alabama, the City of
72	72		Tuscaloosa shall terminate the retirement system established
73	73		under Act 1999-568, 1999 Regular Sessions (Acts 1999, p.
74	74		1220), as amended, according to the terms and conditions of
75	75		the City of Tuscaloosa Police and Firefighters Retirement
76	76		Plan.
77	77		Section 2. (a) Members who began participation in the
78	78		City of Tuscaloosa Police and Firefighters Retirement Plan
79	79		prior to January 1, 2013, and who elect to join the Employees'
80	80		Retirement System in accordance with Section 36-27-6(b), Code
81	81		of Alabama 1975, shall be Tier I plan participants as set
82	82		forth in Chapter 27 of Title 36, Code of Alabama 1975.
83	83		(b) Members who began participation in the City of
84	84		Tuscaloosa Police and Firefighters Retirement Plan on or after
85	85		January 1, 2013, and who elect to join the Employees'
86	86		Retirement System in accordance with Section 36-27-6(b), Code
87	87		of Alabama 1975, shall be Tier II plan participants, unless
88	88		prior employment with a participating employer establishes
89	89		them as Tier I participants, as set forth in Chapter 27 of
90	90		Title 36, Code of Alabama 1975.
91	91		(c) Police or firefighter employees who begin
92	92		employment with the City of Tuscaloosa on or after the date
93		-	that police and firefighter employees of the City of
94		-	Tuscaloosa begin participation in the Employees’ Retirement
95		-	System of Alabama shall participate in the Employees’
96		-	Retirement System of Alabama in accordance with Section
97		-	36-27-6(c), Code of Alabama 1975.
98		-	Section 3. The amounts certified each year to the chief

	122	+	that police and firefighter employees of the City of
	123	+	Tuscaloosa begin participation in the Employees’ Retirement
	124	+	System of Alabama shall participate in the Employees’
	125	+	Retirement System of Alabama in accordance with Section
	126	+	36-27-6(c), Code of Alabama 1975.
	127	+	Section 3. The amounts certified each year to the chief
128	128		financial officer of the City of Tuscaloosa pursuant to
129	129		Section 36-27-6(f), Code of Alabama, 1975, shall be included
130	130		in the respective budget of the city in accordance with the
131	131		city’s legal budget procedure.
132	132		Section 4. The provisions of this act are severable. If
133	133		any part of this act is declared invalid or unconstitutional,
134	134		that declaration shall not affect the part which remains.
135	135		Section 5. All laws or parts of laws which conflict
136	136		with this act are repealed.
137	137		Section 6. This act shall become effective on the first
138	138		day of the third month following its passage and approval by
139	139		the Governor, or its otherwise becoming law.
