15+AN ACT
1616 Relating to Calhoun County; to authorize the sheriff
1717 and commissioner of licenses to obtain and use a credit card
1818 for official uses.
1919 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2020 Section 1. (a) For the purposes of this section, the
2121 term "credit card" means a line of credit issued by a domestic
2222 lender or credit card bank.
2323 (b) To provide for convenience in making purchases of
2424 tangible personal property or services approved by the
2525 sheriff, in Calhoun County the sheriff may establish
2626 procedures to make certain purchases through the use of a
2727 credit card issued to the Calhoun County Sheriff's Office. The
2828 sheriff shall adopt written policies and procedures governing
2929 the use of credit cards which, at a minimum, shall include
3030 each of the following:
3131 (1) A monetary limit on the amount of any individual
3232 purchase which may be made with a credit card.
3333 (2) A monetary limit on the total monthly amount that
3434 may be purchased with a credit card taking into consideration
3535 the monetary limit of the fund to be used to pay any credit
36-card charges.
37-(3) Procedures to ensure that the sheriff has sole
38-access to any credit card, credit card number, access code, or
39-security code.
40-(4) Procedures to keep accurate records of all
41-purchases made with a credit card which shall be periodically

66+(3) Procedures to ensure that the sheriff has sole
67+access to any credit card, credit card number, access code, or
68+security code.
69+(4) Procedures to keep accurate records of all
70+purchases made with a credit card which shall be periodically
7171 reviewed during required audits.
7272 (5) Procedures to ensure that all credit card bills are
7373 carefully reviewed by the sheriff each month to ensure that no
7474 unauthorized charges appear on any bill.
7575 (6) Procedures to ensure that all credit card bills are
7676 paid in full on a timely basis each month to avoid service
7777 charges, late fees, or interest payments.
7878 (c) The sheriff shall select the credit card provider
7979 or providers taking into consideration each of the following:
8080 (1) Whether the credit card issuer requires an annual
8181 fee to use the account.
8282 (2) Whether the credit card issuer offers rewards or
8383 rebates based upon purchases made using the account.
8484 (3) The interest rates, service charges, finance
8585 charges, or late fees that may be assessed in the event a bill
8686 from the credit card issuer is paid late or the balance is not
8787 paid in full each month.
8888 (4) Whether penalties or fees will be assessed against
8989 the sheriff in the event he or she decides to terminate the
9090 credit card account.
9191 (5) Any other consideration deemed relevant by the
9292 sheriff.
93-(d) In the event that a credit card provides rewards or
94-rebates based upon the use of the card, any rewards or rebates
95-earned from the card shall be deposited in the Law Enforcement
96-Fund or redeemed for a legitimate public purpose.
97-Section 2. (a) For the purpose of this section, "credit
98-card" means a line of credit issued by a domestic lender or

122+(d) In the event that a credit card provides rewards or
123+rebates based upon the use of the card, any rewards or rebates
124+earned from the card shall be deposited in the Law Enforcement
125+Fund or redeemed for a legitimate public purpose.

206206 day of the third month following its passage and approval by
