	15	+	AN ACT
16	16		Relating to Blount County; to provide for a new court
17	17		cost to fund payments to employees of the sheriff's office who
18	18		perform hazardous duties; and conditioning operation on voter
19	19		approval at a referendum.
20	20		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
21	21		Section 1. (a) Immediately upon approval by a majority
22	22		of the voting qualified electors of Blount County, in addition
23	23		to any other court costs authorized in Blount County, there
24	24		shall be taxed a fee as follows:
25	25		(1) Twenty-five dollars ($25) in each civil case filed
26	26		in any court, except for the small claims division of the
27	27		district court.
28	28		(2) Twenty-five dollars ($25) in all misdemeanor and
29	29		felony criminal cases, including traffic offenses, upon
30	30		conviction.
31	31		(3) Ten dollars ($10) for each case filed in the small
32	32		claims division of the district court.
33	33		(b) This fee shall not be waived by any court unless
34	34		all other fees, assessments, costs, fines, and charges
35	35		associated with the case are waived.
36		-	(c) The fee collected pursuant to this section by the
37		-	clerk of each court shall be paid into a special fund
38		-	designated by the Blount County Commission as the Sheriff's
39		-	Department Hazardous Duty Fund, and shall be earmarked for
40		-	hazardous duty payment to the nonclerical employees of the
41		-	sheriff's office, excluding the sheriff, who perform hazardous

	65	+	(c) The fee collected pursuant to this section by the
	66	+	clerk of each court shall be paid into a special fund
	67	+	designated by the Blount County Commission as the Sheriff's
	68	+	Department Hazardous Duty Fund, and shall be earmarked for
	69	+	hazardous duty payment to the nonclerical employees of the
	70	+	sheriff's office, excluding the sheriff, who perform hazardous
71	71		duties.
72	72		(d)(1) No earlier than October 1, 2024, the sheriff
73	73		shall certify to the county commission each employee who has
74	74		engaged in hazardous duty, and an amount sufficient to pay an
75	75		equal amount to each employee shall be disbursed from the
76	76		Hazardous Duty Fund.
77	77		(2) At any time after the first disbursement of
78	78		hazardous duty pay by the county commission, the commission
79	79		and the sheriff may make hazardous duty payments annually, or
80	80		may determine to make such payments at semi-annual, quarterly,
81	81		or monthly intervals as they agree circumstances warrant.
82	82		Section 2. Section 1 of this act shall become operative
83	83		only if approved by a majority of the qualified electors of
84	84		Blount County who vote in an election to be held on the day
85	85		designated by the Judge of Probate of Blount County. The
86	86		notice of the election shall be given by the judge of probate,
87	87		and the election shall be held, conducted, and the results
88	88		canvassed in the same manner as other county elections. The
89	89		election shall be held in conjunction with the next regularly
90	90		scheduled election to be held in the county. The question
91	91		shall be, "Do you favor the adoption of Act No.___, of the
92	92		2023 Regular Session of the Alabama Legislature, to provide
93		-	hazardous duty pay to the nonclerical employees of the Blount
94		-	County Sheriff's Office, excluding the Sheriff, by issuing a
95		-	new court cost in Blount County of no more than twenty-five
96		-	dollars ($25)? Yes ( ) No ( )." The county shall pay any costs
97		-	and expenses not otherwise reimbursed by a governmental agency
98		-	which are incidental to the election. If a majority of the

	123	+	County Sheriff's Office, excluding the Sheriff, by issuing a
	124	+	new court cost in Blount County of no more than twenty-five
	125	+	dollars ($25)? Yes ( ) No ( )." The county shall pay any costs
	126	+	and expenses not otherwise reimbursed by a governmental agency
	127	+	which are incidental to the election. If a majority of the
128	128		votes cast in the election are "Yes," Section 1 of this act
129	129		shall become operative immediately. If the majority of the
130	130		votes are "No," this act shall be repealed and shall have no
131	131		further effect. The Judge of Probate of Blount County shall
132	132		certify the results of the election to the Secretary of State.
133	133		Section 3. This act shall become effective immediately
134	134		following its passage and approval by the Governor, or its
135	135		otherwise becoming law.
