13	13	SYNOPSIS: Under existing law, municipal and county
14	14	governing bodies may adopt and enforce local building
15	15	codes governing the construction of residential
16	16	structures.
17	17	This bill would provide that a municipal or
18	18	county governing body, or any agency thereof, may not
19	19	directly or indirectly adopt or enforce any
20	20	ordinance, rule, bylaw, order, or local building code
21	21	provision that would require, in the construction of
22	22	a residential structure, certain latent features,
23	23	including wiring, plumbing, gas tubing, or framing,
24	24	which features would not be operational at the time
25	25	of completion.

28	28	AN ACT
29	29	Relating to county and local government; to provide
30	30	prohibitions on the adoption or enforcement of certain
31	31	building codes requiring the installation of certain latent,
32	32	non-operable features in a residential structure.
33	33	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
34	34	Section 1. (a) For the purposes of this act, the

64	64	following terms have the following meanings:
65	65	(1) LATENT FEATURE. Any technology, appliance,
66	66	electrical circuit, wiring, plumbing, gas tubing, framing, or
67	67	other item, installed in or connected to a residential
68	68	structure, that will not be placed in a state of active
69	69	operation or that will not be utilized by the homeowner at the
70	70	time of the residential structure's completion.
71	71	(2) RESIDENTIAL STRUCTURE. A residence on a single lot,
72	72	including a site-built home, a condominium, duplex, apartment,
73	73	or any other single-unit or multi-unit residential building.
74	74	(b) The governing body of any municipality or county,
75	75	or any agency thereof, may not directly or indirectly adopt or
76	76	enforce any ordinance, rule, bylaw, order, or state or local
77	77	building code provision requiring the installation of any
78	78	latent feature in any residential structure.
79	79	Section 2. This act shall become effective on the first
80	80	day of the third month following its passage and approval by
81	81	the Governor, or its otherwise becoming law.
