1313 SYNOPSIS: Under existing law, municipal and county
1414 governing bodies may adopt and enforce local building
1515 codes governing the construction of residential
1616 structures.
1717 This bill would provide that a municipal or
1818 county governing body, or any agency thereof, may not
1919 directly or indirectly adopt or enforce any
2020 ordinance, rule, bylaw, order, or local building code
2121 provision that would require, in the construction of
2222 a residential structure, certain latent features,
2323 including wiring, plumbing, gas tubing, or framing,
2424 which features would not be operational at the time
2525 of completion.

2929 Relating to county and local government; to provide
3030 prohibitions on the adoption or enforcement of certain
3131 building codes requiring the installation of certain latent,
3232 non-operable features in a residential structure.
3333 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3434 Section 1. (a) For the purposes of this act, the

6464 following terms have the following meanings:
6565 (1) LATENT FEATURE. Any technology, appliance,
6666 electrical circuit, wiring, plumbing, gas tubing, framing, or
6767 other item, installed in or connected to a residential
6868 structure, that will not be placed in a state of active
6969 operation or that will not be utilized by the homeowner at the
7070 time of the residential structure's completion.
7171 (2) RESIDENTIAL STRUCTURE. A residence on a single lot,
7272 including a site-built home, a condominium, duplex, apartment,
7373 or any other single-unit or multi-unit residential building.
7474 (b) The governing body of any municipality or county,
7575 or any agency thereof, may not directly or indirectly adopt or
7676 enforce any ordinance, rule, bylaw, order, or state or local
7777 building code provision requiring the installation of any
7878 latent feature in any residential structure.
7979 Section 2. This act shall become effective on the first
8080 day of the third month following its passage and approval by
8181 the Governor, or its otherwise becoming law.
