	15	+	AN ACT
15	16		Relating to the City of Northport in Tuscaloosa County;
16	17		to provide for a warrant recall fee to allow a municipal judge
17	18		or municipal magistrate for the City of Northport to recall,
18	19		under certain conditions, a failure to appear warrant.
19	20		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
20	21		Section 1. (a) Notwithstanding any law to the contrary,
21	22		a municipal judge or a municipal magistrate of the City of
22	23		Northport in Tuscaloosa County, Alabama, may assess a
23	24		defendant with a warrant recall fee that shall be paid in
24	25		order for a municipal judge or municipal magistrate to recall
25	26		a failure to appear warrant or failure to comply warrant
26	27		arising from any municipal ordinance violation or other
27	28		offense brought against the defendant in the municipal court
28	29		of the City of Northport.
29	30		(b) The warrant recall fee shall not exceed one hundred
30	31		dollars ($100) and is to be paid by the defendant at the time
31	32		the warrant is recalled.
32	33		(c) This section shall not be construed or interpreted
33	34		to require the City of Northport to recall a warrant that has
34	35		been issued. All orders to recall a warrant shall be issued
35		-	solely in the discretion of the municipal judge or municipal
36		-	magistrate.
37		-	(d) All fees received by the City of Northport
38		-	Municipal Court for a warrant recall fee shall be deposited
39		-	into the City of Northport Corrections Fund and allocated in
40		-	conformity with Section 11-47-7.1(a).

	67	+	(d) All fees received by the City of Northport
	68	+	Municipal Court for a warrant recall fee shall be deposited
	69	+	into the City of Northport Corrections Fund and allocated in
	70	+	conformity with Section 11-47-7.1(a).
70	71		Section 2. This act shall become effective on the first
71	72		day of the third month following its passage and approval by
72	73		the Governor, or its otherwise becoming law.
