Introduced
2/23/23

Caption

Relating to firearms; to amend Section 13A-11-72, Code of Alabama 1975, to further provide for the unlawful possession of a firearm on the premises of a public school; to remove exemption for persons with pistol permits; to make nonsubstantive, technical revisions to update the existing code language to current style; and in connection therewith would have as its purpose or effect the requirement of a new or increased expenditure of local funds within the meaning of Section 111.05 of the Constitution of Alabama of 2022.

Impact

If enacted, HB28 will have significant implications for state laws governing firearm possession, particularly concerning public safety and educational facilities. The removal of the exemption for pistol permit holders indicates a stricter enforcement approach towards gun regulations within schools. This change is designed to create a more secure environment for students, educators, and school staff by limiting access to firearms in areas designated for learning.

Summary

House Bill 28 (HB28) seeks to amend Section 13A-11-72 of the Code of Alabama 1975 regarding the unlawful possession of a firearm on the premises of public schools. The proposed amendment aims to remove the existing exemption for individuals possessing pistol permits, thereby reinforcing restrictions on firearm ownership within educational environments. By updating the language to reflect current styles, the bill demonstrates a commitment to addressing safety concerns associated with firearms in schools.

Contention

The discussion around HB28 may spark contentious debates among legislators and the public. Proponents of the bill would argue that ensuring a firearm-free school environment is crucial for the well-being of students and educators. Conversely, opponents may view the removal of the exemption for permit holders as an infringement on individual rights and an overreach that could impact responsible gun owners. The balance between public safety and gun ownership rights is likely to be a central theme in the discussions leading up to the bill's potential enactment.
