13+SYNOPSIS:
14+This bill would create the Healthier Homes
15+Construction Practices Act to authorize a county or
16+municipality to adopt procedures for the installation
17+and activation of temporary-permanent electricity or
18+temporary-permanent gas under certain
19+conditions.

22+AN ACT
1623 Relating to building codes; to create the Healthier
1724 Homes Construction Practices Act; to authorize counties and
1825 municipalities to adopt procedures for the installation and
1926 activation of temporary-permanent electricity or
2027 temporary-permanent gas under certain conditions; and to
2128 provide certain requirements for the activation.
2229 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2330 Section 1. (a) This act shall be known and may be cited
2431 as the Healthier Homes Construction Practices Act.
2532 (b) The Legislature finds and declares that indoor air
2633 quality in homes under construction is of prime importance for
2734 the long-term durability of the home and health of the
28-consumer. It is the intent of the Legislature to address the
29-following issues related to the lack of temporary-permanent
30-electricity and temporary-permanent gas:
31-(1) Mold build-up due to temperature and humidity
32-within the structure.
33-(2) Component damage due to temperature and humidity.
34-(3) Warping and disfigurement of wood within the
35-structure due to temperature and humidity.
36-(c) Any municipality or county that adopts and enforces
37-building codes shall enact a procedure allowing for the
38-installation and activation, on a temporary basis in
39-accordance with the requirements of this act, of electricity
40-("temporary-permanent electricity") or gas
41-("temporary-permanent gas") in any dwelling, covered by the

64+consumer. It is the intent of the Legislature to address the
65+following issues related to the lack of temporary-permanent
66+electricity and temporary-permanent gas:
67+(1) Mold build-up due to temperature and humidity
68+within the structure.
69+(2) Component damage due to temperature and humidity.
70+(3) Warping and disfigurement of wood within the
71+structure due to temperature and humidity.
72+(c) Any municipality or county that adopts and enforces
73+building codes shall enact a procedure allowing for the
74+installation and activation, on a temporary basis in
75+accordance with the requirements of this act, of electricity
76+("temporary-permanent electricity") or gas
77+("temporary-permanent gas") in any dwelling, covered by the
7178 scope of the International Residential Code, under
7279 construction in its jurisdiction.
7380 (d) The municipality or county may require any of the
7481 following to occur prior to the installation or activation of
7582 temporary-permanent electricity:
7683 (1) The structure be secured from unauthorized entry.
7784 (2) The electrical service code be compliant and
7885 complete.
7986 (3) All rough plumbing, electrical, mechanical, and
8087 framing inspections be completed and approved.
8188 (4) All drywall be installed, with the exception of
8289 finishing.
8390 (5) All electrical circuit wires that are not energized
8491 be secured to the side of the panel box.
85-(6) Any exterior outlet which has been energized have
86-ground fault breakers installed. A minimum of one exterior
87-outlet shall be provided.
88-(7) All electrical service be ready for service, as
89-certified by a state licensed electrical contractor.
90-(8) All heating and cooling equipment be installed
91-in-structure. Equipment shall be vented based on manufacturing
92-specifications. Forced air equipment shall have a return air
93-with a MERV 4 filter, and plenum and supply air.
94-(9) The building permit be obtained by a licensed
95-residential home builder, as defined by Section 34-14A-2, or a
96-general contractor.
97-(10) A request for temporary-permanent electricity be
98-made by the permittee.

128135 (11) The electrical service be obtained in the name of
129136 the permittee.
130137 (12) Compliance with any requirements set forth by the
131138 provider of electricity.
132139 (e) In addition to any requirement for the installation
133140 or activation of temporary-permanent electricity under
134141 subsection (d), any municipality or county that enforces and
135142 adopts building codes may require any of the following prior
136143 to the installation or activation of temporary-permanent gas:
137144 (1) The structure be secured from unauthorized entry.
138145 (2) A gas line be installed in accordance with
139146 applicable codes between the heating equipment and the gas
140147 meter location.
141148 (3) Gas lines not connected to an appliance be capped.
142-(4) A temporary pressure test be performed for the
143-purposes of installing temporary gas for heat.
144-(5) A final pressure test be performed for permanent
145-gas service.
146-(6) Gas service be certified by a licensed gas fitter
147-as being ready for service.
148-(7) Heating and cooling equipment be installed
149-in-structure and be vented based on manufacturing
150-specifications.
151-(8) Forced air equipment have a return air with a MERV
152-4 filter, and plenum and supply air.
153-(9) A building permit be obtained by a licensed
154-residential home builder, as defined by Section 34-14A-2, or
155-general contractor.

178+(4) A temporary pressure test be performed for the
179+purposes of installing temporary gas for heat.
180+(5) A final pressure test be performed for permanent
181+gas service.
182+(6) Gas service be certified by a licensed gas fitter
183+as being ready for service.
184+(7) Heating and cooling equipment be installed
185+in-structure and be vented based on manufacturing
186+specifications.
187+(8) Forced air equipment have a return air with a MERV

185192 (10) A request for temporary-permanent gas be made by
186193 the permittee.
187194 (11) Electrical service be obtained in the name of the
188195 permittee.
189196 (12) Proof that the gas system is complete, is code
190197 compliant, and has passed all required inspections.
191198 (13) Compliance with any other requirements of the
192199 provider of gas.
193200 (f) For the installation or activation of
194201 temporary-permanent electricity or temporary-permanent gas, no
195202 additional requirements may be placed on the contractor beyond
196203 the requirements of this section.
197204 (g) Any structure granted temporary-permanent
198205 electricity or temporary-permanent gas pursuant to this
199-section shall not be occupied, and permanent electricity or
200-permanent gas shall be permitted, only upon proof that all
201-required final inspections by the municipality or county have
202-been completed.
203-(h) Where sewer service is not available, a request for
204-temporary-permanent electricity or temporary-permanent gas
205-must be accompanied by copies of all septic system plans and
206-permits, approved by the local health department.
207-Section 2. This act shall become effective on the first
208-day of the third month following its passage and approval by
209-the Governor, or its otherwise becoming law.
