17	18		Relating to Montgomery County; to amend Section
18	19		45-51-231 of the Code of Alabama 1975, relating to an expense
19	20		allowance and salary of the sheriff, to restate the current
20	21		salary of the sheriff and to delete an expired expense
21	22		allowance; and to provide a new expense allowance for the
22	23		sheriff and for the salary of the sheriff if the sheriff has
23	24		served two or more full consecutive terms as sheriff.
24	25		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
25	26		Section 1. Section 45-51-231 of the Code of Alabama
26	27		1975, is amended to read as follows:
27	28		"§45-51-231
28	29		(a) The Sheriff of Montgomery County shall receive an
29	30		expense allowance of twenty thousand dollars ($20,000) per
30	31		year, payable in equal monthly installments from the general
31	32		fund of the county. This expense allowance shall be in
32	33		addition to all other compensation or benefits granted to the
33	34		sheriff and may be treated as compensation for retirement
34	35		contributions.
35	36		(b) Effective beginning the next term of office,
36		-	theExcept as provided in Section 2 of the act adding this
37		-	language, the annual salary of the Sheriff of Montgomery
38		-	County shall be one hundred fifty-five thousand dollars
39		-	($155,000) and the expense allowance provided for in
40		-	subsection (a) shall become null and void .

	68	+	County shall be one hundred fifty-five thousand dollars
	69	+	($155,000) and the expense allowance provided for in

	71	+	Section 2.(a)(1) Any Sheriff of Montgomery County who
71	72		has served two consecutive full terms shall receive an
72	73		additional expense allowance of twenty thousand dollars
73	74		($20,000) per year, payable in equal monthly installments from
74	75		the general fund of the county. This expense allowance shall
75	76		be in addition to all other compensation or benefits granted
76	77		to the sheriff and may be treated as compensation for
77	78		retirement contributions.
78	79		(2) This subsection shall be void at the end of the
79	80		current term of the sheriff or on a vacancy in the office of
80	81		sheriff for any reason.
81	82		(b) Effective beginning the next term of office of the
82	83		Sheriff of Montgomery County, and thereafter, any sheriff who
83	84		has served two or more consecutive full terms as sheriff,
84	85		shall receive an annual salary in the amount of one hundred
85	86		seventy-five thousand dollars ($175,000). The salary shall be
86	87		paid from the general fund of the county.
87	88		Section 3. This act shall become effective on the first
88	89		day of the third month following its passage and approval by
89	90		the Governor, or its otherwise becoming law.
