17	17		Relating to Marion County; to amend Section
18	18		45-47-245.05, providing for the distribution of the proceeds
19	19		of a local tobacco tax in the county, to further provide for
20	20		the distribution of a portion of the proceeds to the Marion
21	21		County Firefighters Association.
22	22		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
23	23		Section 1. Section 45-47-245.05 of the Code of Alabama
24	24		1975, is amended to read as follows:
25	25		"§45-47-245.05
26	26		(a) The proceeds from the tax hereby levied, less the
27	27		actual costs of collection not to exceed 10 per centum, shall
28	28		be paid by the State Department of Revenue to the Marion
29	29		County Commission to be deposited in two separate accounts to
30	30		the credit of either the Marion County Water Coordinating and
31	31		Fire Prevention Authority or the Marion County Volunteer Fire
32	32		and Rescue Association as follows:
33	33		(1) Sixty percent to the Marion County Water
34	34		Coordinating and Fire Prevention Authority.
35	35		(2) Forty percent to the Marion County Volunteer Fire
36	36		and Rescue Association, to be divided as follows:
37		-	a. Twenty-five Thirty percent of the total net proceeds
38		-	to the Marion County Firefighters Association.
39		-	b. Ten percent of the total net proceeds to rescue
40		-	squad associations.
41		-	c. Five percent to public licensed ambulance services

	66	+	a. Twenty-five Thirty percent of the total net proceeds
	67	+	to the Marion County Firefighters Association.
	68	+	b. Ten percent of the total net proceeds to rescue
	69	+	squad associations.
	70	+	c. Five percent to public licensed ambulance services
	71	+	if such services are authorized and created by such
72	72		association.Any portion of the net proceeds held and not
73	73		distributed to public licensed ambulance services before the
74	74		effective date of the act adding this amendatory language
75	75		shall be distributed to the Marion County Firefighters
76	76		Association.
77	77		(b) The Marion County Volunteer Fire and Rescue
78	78		Association shall have authority to promulgate may adopt rules
79	79		and regulations having the force and effect of law for the
80	80		distribution of the funds under subdivision (a)(2) of
81	81		subsection (a).
82	82		(c) Distribution shall be made by the Marion County
83	83		Commission to the separate accounts upon written request of
84	84		the chair of the respective Marion County Water Coordinating
85	85		and Fire Prevention Authority and the Marion County Volunteer
86	86		Fire and Rescue Association. The written request shall be
87	87		submitted to the Marion County Commission and shall become a
88	88		permanent part of the minutes of the commission. A copy of the
89	89		written request shall be retained by the requesting authority
90	90		or association to be entered in their permanent records."
91	91		Section 2. This act shall become effective on the first
92	92		day of the third month following its passage and approval by
93	93		the Governor, or its otherwise becoming law.
