16+AN ACT
1717 Relating to Marion County; to amend Section
1818 45-47-245.05, providing for the distribution of the proceeds
1919 of a local tobacco tax in the county, to further provide for
2020 the distribution of a portion of the proceeds to the Marion
2121 County Firefighters Association.
2222 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2323 Section 1. Section 45-47-245.05 of the Code of Alabama
2424 1975, is amended to read as follows:
2525 "ยง45-47-245.05
2626 (a) The proceeds from the tax hereby levied, less the
2727 actual costs of collection not to exceed 10 per centum, shall
2828 be paid by the State Department of Revenue to the Marion
2929 County Commission to be deposited in two separate accounts to
3030 the credit of either the Marion County Water Coordinating and
3131 Fire Prevention Authority or the Marion County Volunteer Fire
3232 and Rescue Association as follows:
3333 (1) Sixty percent to the Marion County Water
3434 Coordinating and Fire Prevention Authority.
3535 (2) Forty percent to the Marion County Volunteer Fire
3636 and Rescue Association, to be divided as follows:
37-a. Twenty-five Thirty percent of the total net proceeds
38-to the Marion County Firefighters Association.
39-b. Ten percent of the total net proceeds to rescue
40-squad associations.
41-c. Five percent to public licensed ambulance services
42-if such services are authorized and created by such

66+a. Twenty-five Thirty percent of the total net proceeds
67+to the Marion County Firefighters Association.
68+b. Ten percent of the total net proceeds to rescue
69+squad associations.

7272 association.Any portion of the net proceeds held and not
7373 distributed to public licensed ambulance services before the
7474 effective date of the act adding this amendatory language
7575 shall be distributed to the Marion County Firefighters
7676 Association.
7777 (b) The Marion County Volunteer Fire and Rescue
7878 Association shall have authority to promulgate may adopt rules
7979 and regulations having the force and effect of law for the
8080 distribution of the funds under subdivision (a)(2) of
8181 subsection (a).
8282 (c) Distribution shall be made by the Marion County
8383 Commission to the separate accounts upon written request of
8484 the chair of the respective Marion County Water Coordinating
8585 and Fire Prevention Authority and the Marion County Volunteer
8686 Fire and Rescue Association. The written request shall be
8787 submitted to the Marion County Commission and shall become a
8888 permanent part of the minutes of the commission. A copy of the
8989 written request shall be retained by the requesting authority
9090 or association to be entered in their permanent records."
9191 Section 2. This act shall become effective on the first
9292 day of the third month following its passage and approval by
9393 the Governor, or its otherwise becoming law.
