2727 SYNOPSIS:
2828 Under existing law, the Code of Ethics prohibits
2929 certain public employees and officials engaging in
3030 certain unethical acts and practices. Specifically,
3131 public officials and public employees may not enter
3232 into any contract to provide goods or services when the
3333 contract is to be paid out of public funds, unless
3434 certain requirements are satisfied.
3535 This bill would provide that when an individual,
3636 through a public contract, provides services as a
3737 design professional to a state agency, whether as an
3838 employee or a contractor, a conflict of interest exists
3939 if the individual is also employed by, or contractor
4040 to, a vendor for any materials, products, or other
4141 tangible property used for or to be incorporated into
4242 the design of that public contract.
4343 This bill would also provide that a violation
4444 would be a violation of the state Ethics Law.
4545 Section 111.05 of the Constitution of Alabama of
4646 2022, prohibits a general law whose purpose or effect
4747 would be to require a new or increased expenditure of
4848 local funds from becoming effective with regard to a
4949 local governmental entity without enactment by a 2/3
5050 vote unless: it comes within one of a number of
5151 specified exceptions; it is approved by the affected

8181 entity; or the Legislature appropriates funds, or
8282 provides a local source of revenue, to the entity for
8383 the purpose.
8484 The purpose or effect of this bill would be to
8585 require a new or increased expenditure of local funds
8686 within the meaning of the amendment. However, the bill
8787 does not require approval of a local governmental
8888 entity or enactment by a 2/3 vote to become effective
8989 because it comes within one of the specified exceptions
9090 contained in the amendment.

9393 AN ACT
9494 Relating to public contracts; to provide circumstances
9595 under which a conflict of interest exists in the procurement
9696 of a public contract; to provide criminal penalties for a
9797 violation; and in connection therewith would have as its
9898 purpose or effect the requirement of a new or increased
9999 expenditure of local funds within the meaning of Section
100100 111.05 of the Constitution of Alabama of 2022.
101101 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
102102 Section 1. (a) When an individual, through a public
103103 contract, provides services as a design professional, as
104104 defined under Section 41-9A-3, Code of Alabama 1975, whether
105105 as an employee or a contractor, a conflict of interest exists

135135 if the individual is also employed by, or contractor to, a
136136 vendor for any materials, products, or other tangible property
137137 used for or to be incorporated into the design of that public
138138 contract.
139139 (b) A violation of this section is a violation of the
140140 Ethics Law, Chapter 25 of Title 36, Code of Alabama 1975.
141141 Section 2. Although this bill would have as its purpose
142142 or effect the requirement of a new or increased expenditure of
143143 local funds, the bill is excluded from further requirements
144144 and application under Section 111.05 of the Constitution of
145145 Alabama of 2022, because the bill defines a new crime or
146146 amends the definition of an existing crime.
147147 Section 3. This act shall become effective on the first
148148 day of the third month following its passage and approval by
149149 the Governor, or its otherwise becoming law.
