19+AN ACT
1720 Relating to Morgan County; to provide further for the
1821 distribution and expenditure of in-lieu-of-taxes payments
1922 received from the Tennessee Valley Authority distributed to
2023 Morgan County.
2124 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2225 Section 1.(a) Any provision of law to the contrary
2326 notwithstanding, the proceeds allocated to Morgan County,
2427 pursuant to Act 2010-135, 2010 Regular Session, from the
2528 in-lieu-of-taxes payments made by the Tennessee Valley
2629 Authority shall be distributed as follows for the fiscal years
2730 specified below in the following order:
2831 (1) For each fiscal year beginning October 1, 2023,
2932 until the fiscal year beginning October 1, 2032, four hundred
3033 thousand dollars ($400,000) shall be distributed to Calhoun
3134 Community College for the purpose of securing funding to build
3235 a Phase III for the Alabama Center for the Arts in downtown
3336 Decatur to support higher education in Morgan County and to
3437 support dual enrollment with the public school systems of the
3538 City of Decatur, the City of Hartselle, and the Morgan County
3639 Board of Education. The disbursement to each school shall be
37-conditional upon the school initiating the project before or
38-during the 2023-2024 fiscal year. Should the project not
39-commence before October 1, 2024, the funds shall remain in an
40-account until otherwise appropriated by legislative act.
41-(2) After the distribution in subdivision (1) and any
42-remaining distribution provided by Act 2013-199, 2013 Regular

69+conditional upon the school initiating the project before or
70+during the 2023-2024 fiscal year. Should the project not
71+commence before October 1, 2024, the funds shall remain in an
72+account until otherwise appropriated by legislative act.
73+(2) After the distribution in subdivision (1) and any
74+remaining distribution provided by Act 2013-199, 2013 Regular
7275 Session, for the fiscal years beginning October 1, 2022;
7376 October 1, 2023; October 1, 2024; October 1, 2025; and October
7477 1, 2026, the remaining proceeds up to a total of two hundred
7578 seventy-five thousand dollars ($275,000) each year shall be
7679 distributed to the Community Foundation of Greater Decatur,
7780 Inc., to be distributed by the community foundation based on
7881 recommendations for expenditure from the member representing
7982 each House of Representatives District and the Senate District
8083 comprised of territory in Morgan County as follows: The funds
8184 shall be divided into two shares, with one share to be
8285 expended in the Senate District and one share to be expended
8386 in the House of Representatives Districts based on the
8487 approximate population of each House of Representatives
8588 District in Morgan County as a percentage of the total
8689 population of Morgan County. Any distributions pursuant to
8790 this subdivision shall be at the sole discretion of the
8891 Community Foundation of Greater Decatur, Inc.
8992 (3) Any funds distributed to Morgan County pursuant to
9093 Act 2010-135, 2010 Regular Session, after the appropriations
9194 provided in this section shall be distributed each year to the
9295 Morgan County legislative delegation office.
9396 Section 2. This act shall become effective immediately
94-following its passage and approval by the Governor, or its
95-otherwise becoming law.
