	19	+	AN ACT
17	20		Relating to Morgan County; to provide further for the
18	21		distribution and expenditure of in-lieu-of-taxes payments
19	22		received from the Tennessee Valley Authority distributed to
20	23		Morgan County.
21	24		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
22	25		Section 1.(a) Any provision of law to the contrary
23	26		notwithstanding, the proceeds allocated to Morgan County,
24	27		pursuant to Act 2010-135, 2010 Regular Session, from the
25	28		in-lieu-of-taxes payments made by the Tennessee Valley
26	29		Authority shall be distributed as follows for the fiscal years
27	30		specified below in the following order:
28	31		(1) For each fiscal year beginning October 1, 2023,
29	32		until the fiscal year beginning October 1, 2032, four hundred
30	33		thousand dollars ($400,000) shall be distributed to Calhoun
31	34		Community College for the purpose of securing funding to build
32	35		a Phase III for the Alabama Center for the Arts in downtown
33	36		Decatur to support higher education in Morgan County and to
34	37		support dual enrollment with the public school systems of the
35	38		City of Decatur, the City of Hartselle, and the Morgan County
36	39		Board of Education. The disbursement to each school shall be
37		-	conditional upon the school initiating the project before or
38		-	during the 2023-2024 fiscal year. Should the project not
39		-	commence before October 1, 2024, the funds shall remain in an
40		-	account until otherwise appropriated by legislative act.
41		-	(2) After the distribution in subdivision (1) and any
42		-	remaining distribution provided by Act 2013-199, 2013 Regular

	69	+	conditional upon the school initiating the project before or
	70	+	during the 2023-2024 fiscal year. Should the project not
	71	+	commence before October 1, 2024, the funds shall remain in an
	72	+	account until otherwise appropriated by legislative act.
	73	+	(2) After the distribution in subdivision (1) and any
	74	+	remaining distribution provided by Act 2013-199, 2013 Regular
72	75		Session, for the fiscal years beginning October 1, 2022;
73	76		October 1, 2023; October 1, 2024; October 1, 2025; and October
74	77		1, 2026, the remaining proceeds up to a total of two hundred
75	78		seventy-five thousand dollars ($275,000) each year shall be
76	79		distributed to the Community Foundation of Greater Decatur,
77	80		Inc., to be distributed by the community foundation based on
78	81		recommendations for expenditure from the member representing
79	82		each House of Representatives District and the Senate District
80	83		comprised of territory in Morgan County as follows: The funds
81	84		shall be divided into two shares, with one share to be
82	85		expended in the Senate District and one share to be expended
83	86		in the House of Representatives Districts based on the
84	87		approximate population of each House of Representatives
85	88		District in Morgan County as a percentage of the total
86	89		population of Morgan County. Any distributions pursuant to
87	90		this subdivision shall be at the sole discretion of the
88	91		Community Foundation of Greater Decatur, Inc.
89	92		(3) Any funds distributed to Morgan County pursuant to
90	93		Act 2010-135, 2010 Regular Session, after the appropriations
91	94		provided in this section shall be distributed each year to the
92	95		Morgan County legislative delegation office.
93	96		Section 2. This act shall become effective immediately
94		-	following its passage and approval by the Governor, or its
95		-	otherwise becoming law.
