19 | 22 | | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: |

20 | 23 | | Section 1. Section 1 of Act 2020-190, 2020 Regular |
---|
21 | 24 | | Session, is amended to read as follows: |
---|
22 | 25 | | "Section 1. (a) In addition to any filing or recording |
---|
23 | 26 | | fee currently assessed, the Probate Office of St. Clair County |
---|
24 | 27 | | shall charge an additional fee of six dollars and fifty cents |
---|
25 | 28 | | ($6.50) for each matter filed or recorded in the Probate |
---|
26 | 29 | | Office of St. Clair County probate office. After the first year |
---|
27 | 30 | | of the operation of this act August 1, 2021, the St. Clair |
---|
28 | 31 | | County Mental Health Advisory Board may increase or lower the |
---|
29 | 32 | | fee; provided, the fee may not exceed eight dollars and fifty |
---|
30 | 33 | | cents ($8.50). |
---|
31 | 34 | | (b) There is established the St. Clair County Mental |
---|
32 | 35 | | Health Advisory Board, which shall have three five members as |
---|
33 | 36 | | follows: |
---|
34 | 37 | | (1) The Chair of the St. Clair County Commission, or |
---|
70 | 73 | | Commission. |

71 | 74 | | (c) By the twentieth of each month following the |

72 | 75 | | collection of the fee, the proceeds of the fee shall be |

73 | 76 | | disbursed by the judge of probate to the St. Clair County |

74 | 77 | | Commissioncounty commission . The fees collected under this |
---|
75 | 78 | | section shall be expensed as the St. Clair County Mental |
---|
76 | 79 | | Health Advisory Board advisory board directs and shall be |
---|
77 | 80 | | expended for crisis intervention services, which may include, |
---|
78 | 81 | | but are expressly not limited to, any of the following: |
---|
79 | 82 | | (1) A mental health officer, who shall be an employee |
---|
80 | 83 | | of the Sheriff of St. Clair County sheriff and appointed by |
---|
81 | 84 | | the St. Clair County Mental Health Advisory Board advisory |
---|
82 | 85 | | board to serve at the advisory board's pleasure and under the |
---|
83 | 86 | | day to day direction of the judge of probate of St. Clair |
---|
84 | 87 | | County. The duties, education, qualifications, training, and |
---|
85 | 88 | | experience requirements of the position shall be set by the |
---|
86 | 89 | | advisory board. All necessary equipment, supplies, and |
---|
87 | 90 | | training, including an appropriately equipped vehicle, shall |
---|
88 | 91 | | also be provided as determined by the advisory board. The |
---|
89 | 92 | | advisory board may appoint assistant mental health officers |
---|
90 | 93 | | and support staff as the advisory board may deem necessary. |
---|
91 | 94 | | The assistant mental health officers and support staff shall |
---|
127 | 130 | | therewith. |

128 | 131 | | (2) Admissions at a certified psychiatric inpatient |
---|
129 | 132 | | unit, which shall be directed or approved by the judge of |
---|
130 | 133 | | probate, the mental health officer, or an assistant mental |
---|
131 | 134 | | health officer and shall be based upon available funds as |
---|
132 | 135 | | determined by the St. Clair County Mental Health Advisory |
---|
133 | 136 | | Boardadvisory board. |

134 | 137 | | (3) Crisis intervention, which shall be provided |
---|
135 | 138 | | through programs of the advisory board or otherwise , shall |
---|
136 | 139 | | include, but not be limited to, salaries, equipment, and other |
---|
137 | 140 | | expenses related to mental health related services and |
---|
138 | 141 | | treatment. |
---|
139 | 142 | | (4) Contracting with other entities for services that |
---|
140 | 143 | | would otherwise be provided by the mental health officer or |
---|
141 | 144 | | assistant mental health officers. The St. Clair County Mental |
---|
142 | 145 | | Health Advisory Board advisory board may purchase other |
---|
143 | 146 | | necessary services or pay necessary expenses, including, but |
---|
144 | 147 | | not limited to, the obtaining of liability insurance for the |
---|
145 | 148 | | advisory board, its members, and its employees, if any." |
---|
146 | 149 | | Section 2. This act shall become effective immediately |
---|
147 | 150 | | following its passage and approval by the Governor, or its |
---|
148 | 151 | | otherwise becoming law. |
