1518 Relating to St. Clair County; to amend Section 1 of Act
1619 2020-190, 2020 Regular Session, to provide for the nomination
1720 and appointment of additional members to the St. Clair County
1821 Mental Health Advisory Board.
1922 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2023 Section 1. Section 1 of Act 2020-190, 2020 Regular
2124 Session, is amended to read as follows:
2225 "Section 1. (a) In addition to any filing or recording
2326 fee currently assessed, the Probate Office of St. Clair County
2427 shall charge an additional fee of six dollars and fifty cents
2528 ($6.50) for each matter filed or recorded in the Probate
2629 Office of St. Clair County probate office. After the first year
2730 of the operation of this act August 1, 2021, the St. Clair
2831 County Mental Health Advisory Board may increase or lower the
2932 fee; provided, the fee may not exceed eight dollars and fifty
3033 cents ($8.50).
3134 (b) There is established the St. Clair County Mental
3235 Health Advisory Board, which shall have three five members as
3336 follows:
3437 (1) The Chair of the St. Clair County Commission, or
35-his or her designee.
36-(2) The Sheriff of St. Clair County.
37-(3) The St. Clair County Judge of Probate.
38-(4) Two at-large members, who shall reside in St. Clair
39-County and shall be nominated by the sitting members of the
40-advisory board and appointed by the St. Clair County

68+(2) The Sheriff of St. Clair County.
69+(3) The St. Clair County Judge of Probate.
70+(4) Two at-large members, who shall reside in St. Clair
71+County and shall be nominated by the sitting members of the
72+advisory board and appointed by the St. Clair County
7073 Commission.
7174 (c) By the twentieth of each month following the
7275 collection of the fee, the proceeds of the fee shall be
7376 disbursed by the judge of probate to the St. Clair County
7477 Commissioncounty commission . The fees collected under this
7578 section shall be expensed as the St. Clair County Mental
7679 Health Advisory Board advisory board directs and shall be
7780 expended for crisis intervention services, which may include,
7881 but are expressly not limited to, any of the following:
7982 (1) A mental health officer, who shall be an employee
8083 of the Sheriff of St. Clair County sheriff and appointed by
8184 the St. Clair County Mental Health Advisory Board advisory
8285 board to serve at the advisory board's pleasure and under the
8386 day to day direction of the judge of probate of St. Clair
8487 County. The duties, education, qualifications, training, and
8588 experience requirements of the position shall be set by the
8689 advisory board. All necessary equipment, supplies, and
8790 training, including an appropriately equipped vehicle, shall
8891 also be provided as determined by the advisory board. The
8992 advisory board may appoint assistant mental health officers
9093 and support staff as the advisory board may deem necessary.
9194 The assistant mental health officers and support staff shall
92-be employees of St. Clair County. The advisory board shall set
93-the salary or compensation for the mental health officer and
94-assistant mental health officers, if any. The advisory board
95-may also set performance standards and take personnel actions
96-as may be necessary, up to and including termination of the
97-mental health officer duties and responsibilities associated

124+be employees of St. Clair County. The advisory board shall set
125+the salary or compensation for the mental health officer and
126+assistant mental health officers, if any. The advisory board
127+may also set performance standards and take personnel actions
128+as may be necessary, up to and including termination of the
129+mental health officer duties and responsibilities associated
127130 therewith.
128131 (2) Admissions at a certified psychiatric inpatient
129132 unit, which shall be directed or approved by the judge of
130133 probate, the mental health officer, or an assistant mental
131134 health officer and shall be based upon available funds as
132135 determined by the St. Clair County Mental Health Advisory
133136 Boardadvisory board.
134137 (3) Crisis intervention, which shall be provided
135138 through programs of the advisory board or otherwise , shall
136139 include, but not be limited to, salaries, equipment, and other
137140 expenses related to mental health related services and
138141 treatment.
139142 (4) Contracting with other entities for services that
140143 would otherwise be provided by the mental health officer or
141144 assistant mental health officers. The St. Clair County Mental
142145 Health Advisory Board advisory board may purchase other
143146 necessary services or pay necessary expenses, including, but
144147 not limited to, the obtaining of liability insurance for the
145148 advisory board, its members, and its employees, if any."
146149 Section 2. This act shall become effective immediately
147150 following its passage and approval by the Governor, or its
148151 otherwise becoming law.
