1414 SYNOPSIS:
1515 Under existing law, a local board of education
1616 is required to develop a comprehensive school emergency
1717 operations plan for each school under its jurisdiction.
1818 This bill would require regularly scheduled
1919 lockdown drills conducted under the plan to include the
2020 participation of school resource officers and law
2121 enforcement and would designate those days on which
2222 drills are conducted as school safety and awareness
2323 days.

2626 AN ACT
2727 Relating to public K-12 education; to amend Section
2828 16-1-44, Code of Alabama 1975, providing for comprehensive
2929 school emergency operations plans; to require the
3030 participation of school resource officers and law enforcement
3131 agencies in regularly scheduled lockdown drills; and to
3232 designate the days on which lockdown drills are conducted as
3333 school safety and awareness days.

6767 (a)(1) Each local board of education shall develop and
6868 adopt a comprehensive school emergency operations plan for
6969 each school under the authority of the board.
7070 (2) The local board or its agent shall examine the
7171 conditions and operations of each school under the authority
7272 of the local board to determine hazards to student and staff
7373 safety and shall propose changes, if needed to promote the
7474 prevention of dangerous problems and circumstances.
7575 (3) In developing the plan for each school, the local
7676 board or its agent shall involve community law enforcement and
7777 safety officials, including community fire and emergency
7878 management assigned to the school.
7979 (b)(1) The board shall incorporate into each
8080 comprehensive school emergency operations plan the following:
8181 a. Protocols for addressing each type of serious
8282 threats to the safety of school property, students, employees,
8383 or administrators which shall include, but not be limited to:
8484 Security-related threats addressed within a school lockdown
8585 plan, fire-related threats addressed within a fire safety
8686 plan, and severe weather-related threats addressed within a
8787 severe weather safety plan.
8888 b. A protocol for responding to emergency events that
8989 compromise the safety of school property, students, and
9090 employees.
9191 (2) Each protocol shall include procedures for
9292 notification and responding to threats and emergency events,

122122 respectively, including such action as notification of
123123 appropriate law enforcement and emergency response personnel
124124 for assistance, and informing parents of affected students.
125125 (3) Each comprehensive school emergency operations plan
126126 shall include and use the following four alert levels, along
127127 with set plans of notification, action, and procedures for
128128 school personnel to follow in each circumstance:
129129 1.a. Heightened Awareness. This means a potential may
130130 exist for an unusual situation and all parties should have
131131 heightened awareness to react as needed.
132132 2.b. Secure Your Area of Responsibility. This means a
133133 specific incident has occurred, such as a medical emergency or
134134 a threat to one's self, and school personnel shall secure
135135 their area of responsibility in order to decrease risk of
136136 further incidents.
137137 3.c. Secure Perimeter. A potential threat or danger
138138 does exist or has occurred within the community or
139139 neighborhood, and all parties should be aware to react as
140140 needed.
141141 4.d. Lockdown. Recognition of potential immediate
142142 danger. Take immediate action using the safest and best option
143143 for survival.
144144 (c)(1) The board shall update the emergency operations
145145 plan whenever a major modification to the building requires
146146 changes in the procedures outlined in the plan and at other
147147 necessary times. The school emergency operations safety plan
148148 shall be reviewed and revised annually, as needed, by the
149149 local board of education in consultation with the principal,

179179 administrative staff, faculty, and employees of the school.
180180 (2) Upon request of law enforcement or safety
181181 officials, or both, the local board shall provide a copy of
182182 the current school emergency operations plan, which shall be
183183 kept in a secure place and not considered public record.
184184 (d) The local board shall grant access to each school
185185 under its control to law enforcement and fire department
186186 personnel to enable them to prepare for responding to threats
187187 and emergency events affecting the school.
188188 (e) The principal or his or her designee shall instruct
189189 and train students concerning procedures to be used for
190190 emergency drills and evacuations. The principal or his or her
191191 designee shall ensure that all safety and security drills and
192192 procedures are conducted and performed no less than what is
193193 required by state or federal law, or both. The doors and exits
194194 of each school may be locked from the outside but shall allow
195195 for immediate egress by those inside the building during
196196 school hours and at all school functions. An emergency drill
197197 shall include, but not be limited to, safety, security, severe
198198 weather, fire, and school lockdown drills.
199199 (f) In conjunction with drills or evacuations required
200200 by subsection (e), a principal or his or her designee shall
201201 instruct students in safety precautions to be taken in case of
202202 a severe weather watch, alert, or warning. A principal or his
203203 or her designee shall designate, in accordance with standards
204204 prescribed by the local superintendent of education in
205205 conjunction with local public safety officials and the fire
206206 marshal, or appropriate local fire safety official in counties

236236 that do not have a fire marshal, appropriate locations to be
237237 used to shelter students in case of a severe weather watch,
238238 alert, or warning.
239239 (g) In the event of an immediate threat to a school
240240 involving acts of violence, such as terrorism, a person
241241 possessing a firearm or a deadly weapon, or any other threat
242242 of violence, any person who perceives the threat, or his or
243243 her designee, may institute a lockdown alert level for the
244244 school.
245245 (h) In addition to the requirements of subsection (e),
246246 the principal or his or her designee shall conduct a school
247247 lockdown drill during the first six weeks of the fall and
248248 spring semesters of each school year to provide students with
249249 instruction in the procedures to follow in the case of a
250250 school lockdown. The principal or his or her designee shall
251251 also hold an annual training session for employees of the
252252 school regarding the school lockdown plan, drills, and
253253 procedures to be conducted during a school year. The annual
254254 training session shall include mental health awareness.
255255 (1) School resource officers, school safety personnel,
256256 and local and state law enforcement agencies shall participate
257257 in regularly scheduled school lockdown drills.
258258 (2) A day on which a lockdown drill is scheduled and
259259 the importance of school safety and safety awareness is
260260 emphasized shall be designated as a school safety and
261261 awareness day.
262262 (h)(i) Appropriate disciplinary action shall be taken
263263 against any principal or his or her designee who knowingly

293293 neglects or refuses to comply with the requirements of this
294294 section.
295295 (i)(j) This section shall be read in pari materia with
296296 other laws relating to school safety and emergency planning."
297297 Section 2. This act shall become effective on the first
298298 day of the third month following its passage and approval by
299299 the Governor, or its otherwise becoming law.
