17+AN ACT
1518 Relating to Talladega County; to amend Section 11 of
1619 Act 91-533 of the 1991 Regular Session (Acts 1991, p. 948), as
1720 last amended by Act 2019-156 of the 2019 Regular Session, to
1821 further provide for the distribution of a special county sales
1922 and use tax; and to repeal Act 2015-515 of the 2015 Regular
2023 Session, relating to the distribution of a portion of the
2124 special sales and use tax.
2225 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2326 Section 1. Section 11 of Act 91-533 of the 1991 Regular
2427 Session (Acts 1991, p. 948), as amended by Act 2019-156 of the
2528 2019 Regular Session, is amended to read as follows:
2629 "Section 11. All revenues arising from the taxes herein
2730 levied shall be deposited in a special fund, designated as the
2831 Talladega County Special Tax Fund. An amount up to fifty
2932 thousand dollars ( $50,000) annually, plus any existing funds
3033 on deposit in the fund for professional services on the
3134 effective date of the act adding this amendatory language,
3235 shall, upon approval of the Talladega County legislative
3336 delegation, shall be used for personnel and/or professional
3437 servicesas deemed necessary by the delegation to assist in
35-the administration and coordination of the projects designated
36-in this act Talladega County Commission . The term "approval of
37-the Talladega County legislative delegation" as used in this
38-paragraph and throughout this act, shall constitute the
39-approval of the Senate member and any two (2) House

67+the administration and coordination of the projects designated
68+in this act Talladega County Commission . The term "approval of
69+the Talladega County legislative delegation" as used in this
70+paragraph and throughout this act, shall constitute the
71+approval of the Senate member and any two (2) House
6972 representatives from said county. The remaining amounts shall
7073 be distributed by the county commission in the following
7174 manner:
7275 (1) Twelve percent to the Talladega County Association
7376 of Volunteer Fire Departments be further distributed equally
7477 among the certified volunteer fire departments whose principal
7578 fire station is located in the county.
7679 (2) Twelve percent , plus any existing funds in the
7780 bridge fund on the effective date of the act adding this
7881 language, to the bridge fund to be used towards the
7982 construction and/or financing of a bridge across Coosa River
8083 connecting Talladega and Shelby Counties at the site
8184 previously served by a ferry. The Talladega Economic
8285 Development Authority shall make recommendations to the
8386 Talladega County Commission as to the expenditure of these
8487 funds. Approval by the Talladega County legislative
8588 delegation, as defined above, is required prior to the
8689 expenditure of any funds. If the Talladega Economic
8790 Development Authority fails to make a recommendation
8891 acceptable to the Talladega County legislative delegation,
8992 then final disposition of said funds shall be at the sole
9093 discretion of the Talladega County legislative delegation.
9194 Distribution of these discretionary funds shall be approved by
92-the Talladega County legislative delegation, as defined above
93-at the discretion of the county commission for costs related
94-to rural county roads and bridges, to include Cheaha Road .
95-(3) Ten percent to fund the commitment made by the
96-Talladega County Commission to the Honda project.

124+the Talladega County legislative delegation, as defined above
125+at the discretion of the county commission for costs related
126+to rural county roads and bridges, to include Cheaha Road .
127+(3) Ten percent to fund the commitment made by the
128+Talladega County Commission to the Honda project.
126129 (4) Ten Four percent to the Talladega County Health
127130 Department for construction and/or financing of new facility
128131 to serve North Talladega County, and to fund maintenance and
129132 operation expenses for Talladega County health programs
130133 located in Sylacauga and Talladega. The Talladega Economic
131134 Development Authority shall make recommendations to the
132135 Talladega County Commission as to the expenditure of these
133136 funds. Approval by the Talladega County legislative
134137 delegation, as defined above, is required prior to the
135138 expenditure of any funds. If the Talladega Economic
136139 Development Authority fails to make a recommendation
137140 acceptable to the Talladega County legislative delegation,
138141 then final disposition of said funds shall be at the sole
139142 discretion of the Talladega County legislative delegation.
140143 Distribution of these discretionary funds shall be approved by
141144 the Talladega County legislative delegation, as defined above
142145 for maintenance and repairs of the health department building .
143146 Notwithstanding the distribution in this subdivision, the
144147 amount of one million five hundred thousand dollars
145148 ($1,500,000) from the existing funds on deposit in the Health
146149 Department Fund on the effective date of the act adding this
147150 language shall be allocated to the East Alabama Rural
148151 Innovation and Training Hub.
149-(5) Ten percent to the Talladega County Economic
150-Development Authority.
151-(6) Ten percent for development of water lines to serve
152-Talladega County residents and industry for improved fire

181+(5) Ten percent to the Talladega County Economic
182+Development Authority.
183+(6) Ten percent for development of water lines to serve

188191 Development Authority fails to make a recommendation
189192 acceptable to the Talladega County legislative delegation,
190193 then final disposition of said the funds shall be at the sole
191194 discretion of the Talladega County legislative delegation. The
192195 term "approval by the Talladega County legislative delegation"
193196 as used in this subdivision and for purposes of this act,
194197 shall mean the approval of the members of the House of
195198 Representatives who reside within Talladega County.
196199 Distribution of these discretionary funds shall be approved by
197200 the Talladega County legislative delegation, as defined above.
198201 (7) Five percent to the public libraries in Talladega
199202 County located in Childersburg, Lincoln, Munford, Sylacauga,
200203 and Talladega to be distributed on a pro rata basis by
201204 population of each municipality.
202205 (8) Five percent to the Talladega County Commission
203206 fund that is used to match federal and state funds for roads
204207 and bridges in Talladega County.
205208 (9) Five percent for the maintenance and renovation of
206-county-owned buildings as needed and as determined by the
207-county commission , including as first priority the courthouse
208-annex located in Sylacauga .
209-(10) Four percent to be used to improve the supply and
210-quality of the water in North Talladega County, particularly

238+county-owned buildings as needed and as determined by the
239+county commission , including as first priority the courthouse
240+annex located in Sylacauga .
241+(10) Four percent to be used to improve the supply and
242+quality of the water in North Talladega County, particularly
240243 to enhance water supplies and capacities for communities
241244 within North Talladega County in and around the Talladega
242245 Municipal Airport, including, but not limited to, the addition
243246 and maintenance of water towers. The Talladega Economic
244247 Development Authority shall make recommendations to the
245248 Talladega County Commission as to the expenditure of these
246249 funds. Approval by the Talladega County legislative
247250 delegation, as defined above, is required prior to the
248251 expenditure of any funds. If the Talladega Economic
249252 Development Authority fails to make a recommendation
250253 acceptable to the Talladega County legislative delegation,
251254 then final disposition of said the funds shall be at the sole
252255 discretion approval of the Talladega County legislative
253256 delegation. Distribution of these discretionary funds shall be
254257 approved by the Talladega County legislative delegation, as
255258 defined above.
256259 (11) Four Ten percent to be used to hire additional law
257260 enforcement officers in the Talladega County Sheriff's
258261 Department to better serve the rural residents of Talladega
259262 personnel for the public safety radio system or for other law
260263 enforcement purposes, at the determination needed by the
261264 county commission .
262265 (12) Two percent divided equally and distributed to the
263-ARC programs of North and South Talladega County located in
264-Sylacauga and Talladega.
265-(13) Two percent to the Talladega Childrens
266-Rehabilitation Office for rehabilitation services in Talladega

297+(13) Two percent to the Talladega Childrens
298+Rehabilitation Office for rehabilitation services in Talladega
299+County.
297300 (14) a. Any remaining revenue proceeds shall be
298301 deposited into a trust fund called the Talladega County
299302 Special Tax Trust Fund. As the need for the funds in items (1)
300303 to (13), inclusive, becomes obsolete as determined by the
301304 Talladega County Economic Development Authority, and as agreed
302305 to by the Talladega County legislative delegation, or in the
303306 alternative as determined by the Talladega County legislative
304307 delegation, the percentage allotted to any particular item
305308 also shall be deposited in the Special Tax Trust Fund to be
306309 invested in the same manner as other funds in the County
307310 Treasury are invested. The legislative delegation of Talladega
308311 County may determine which future projects are appropriate for
309312 the expenditure of interest earned on funds held in the trust
310313 account. No expenditures shall be made from the Special Tax
311314 Trust Fund until after the expiration of five years from the
312315 establishment of the trust account. After such time only the
313316 interest on the Special Tax Trust Fund may be expended on
314317 projects and/or the financing of projects, including bonded
315318 indebtedness, submitted to the Talladega County legislative
316319 delegation for approval .
317320 b. Revenues currently in the Debt Retirement Fund
318321 provided for in Act 91-533 which are not needed to retire
319322 current indebtedness shall be distributed as follows: 1. The
320-first one hundred thousand dollars ($100,000) to purchase
321-vehicles for the Talladega County Sheriff's Department.
322-2. The balance remaining shall be divided and equally
323-distributed in a lump sum for the purposes addressed above in
324-subdivisions (2) and (4).

352+first one hundred thousand dollars ($100,000) to purchase
353+vehicles for the Talladega County Sheriff's Department.
354+2. The balance remaining shall be divided and equally
355+distributed in a lump sum for the purposes addressed above in
356+subdivisions (2) and (4).
354357 c. The Talladega County Economic Development Authority
355358 shall act in an advisory capacity to the Talladega County
356359 legislative delegation in regard to expenditures from the
357360 Talladega County Special Tax Trust Fund. The authority shall
358361 report to the legislative delegation annually beginning
359362 September 1, 2000, and shall issue additional reports at other
360363 times when requested by the delegation. The amount of three
361364 million five hundred thousand dollars ($3,500,000) from
362365 existing funds on deposit on the effective date of the act
363366 adding this amendatory language in the Talladega County
364367 Special Trust Fund shall be allocated to the East Alabama
365368 Rural Training and Innovation Hub. Thereafter, any remaining
366369 funds and future revenues shall be used for rural Talladega
367370 County projects, at the discretion of the Talladega County
368371 Commission, subject to approval of the Talladega County
369372 legislative delegation. "
370373 Section 2. Act 2015-515 of the 2015 Regular Session,
371374 relating to the distribution of a portion of the special sales
372375 and use tax, is repealed.
373376 Section 3. This act shall become effective immediately
374377 following its passage and approval by the Governor, or its
375378 otherwise becoming law.
