14+SYNOPSIS:
15+Under existing law, the Alabama Job Creation and
16+Military Stability Commission is comprised of one
17+retired senior member of the United States Armed Forces
18+for each of the four major military facilities in
19+Alabama: Redstone Arsenal, Anniston Army Depot, Maxwell
20+Air Force Base including the Gunter Annex, and Fort
21+Rucker.
22+This bill would expand the membership of the
23+commission to include a retired senior member of the
24+Armed Forces for Fort Benning.

1728 Relating to the Alabama Job Creation and Military
1829 Stability Commission; to amend Sections 31-14-2 and 31-14-3,
1930 Code of Alabama 1975, to expand the membership of the
2031 commission.
2132 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2233 Section 1. Sections 31-14-2 and 31-14-3, Code of
2334 Alabama 1975, are amended to read as follows:
24-"§31-14-2
25-When used in this chapter and except where the context
26-prohibits, the following words and terms shall have the
27-following meanings:
28-(1) COMMISSION. The Alabama Job Creation and Military
29-Stability Commission.
30-(2) FOUNDATION. The Military Stability Foundation, an
31-Alabama nonprofit corporation incorporated on September 8,
32-2011.
33-(3) MILITARY INSTALLATION. A federal or state military
34-fort, base, camp, post, station, yard, depot, arsenal, armory,
35-or other installation, if located within the State of Alabama.
36-(4) PROGRAM. The Military Stability Program established
37-by this chapter.
38-(5) RECIPIENT. A person, entity, association, or
39-governmental entity which receives monies from the program."

81+(a) There is created the The Alabama Job Creation and
7182 Military Stability Commission is created. Members of the
7283 commission shall include a chair and two vice chairs. The
7384 chair shall be the Lieutenant Governor, or in the absence of a
7485 Lieutenant Governor, the chair shall be the Governor, or his
7586 or her designee. The vice chairs shall be the President Pro
7687 Tempore of the Senate, or his or her designee, and the Speaker
7788 of the House of Representatives, or his or her designee.
7889 (b) The commission shall also consist of the following
7990 members:
8091 (1) Two members of the House of Representatives
81-appointed by the Speaker of the House of Representatives.
82-(2) Two members of the Senate appointed by the
83-President Pro Tempore of the Senate.
84-(3) The Adjutant General of the Alabama National Guard.
85-(4) The Secretary of the Alabama State Law Enforcement
86-Agency.
87-(5) The Secretary of the Department of Commerce.
88-(6) The Director of the Alabama Department of Economic
89-and Community Affairs.
90-(7) The Commissioner of the Alabama Department of
91-Veterans Affairs.
92-(8) One senator from the minority caucus appointed by
93-the Lieutenant Governor.
94-(9) One representative from the minority caucus
95-appointed by the Speaker of the House of Representatives.
96-(10) One retired senior member of the Armed Forces for
97-each of the four five major military facilities in Alabama,
98-Redstone Arsenal, Anniston Army Depot, Maxwell Air Force Base

136+(10) One retired senior member of the Armed Forces for
137+each of the four five major military facilities in Alabama,
138+Redstone Arsenal, Anniston Army Depot, Maxwell Air Force Base
128139 including the Gunter Annex, Fort Benning, and Fort Rucker, who
129140 shall be appointed by the Governor, after consultation with
130141 the individual designated in subdivision (11) as the civic
131142 leader from the community which the senior member of the
132143 military shall represent.
133144 (11) One civic leader with significant experience in
134145 military relocations from each of the four five communities
135146 currently impacted most significantly by the presence of
136147 military facilities and assigned personnel who shall be
137148 appointed by the chair after consultation with the existing
138-organizations described in subsection (h).
139-(c) Members of the commission shall serve for a term of
140-four years with each appointment, may be reappointed for an
141-unlimited number of terms, and shall serve on the commission
142-until a replacement is appointed.
143-(d) The members of the Alabama Job Creation and
144-Military Stability Commission created by Act 2011-350, as
145-amended by Act 2013-156, shall be the initial members of the
146-commission created under this section and shall continue to
147-serve on the commission at the pleasure of the appointing
148-authority until the quadrennium commencing in 2019. Persons
149-appointed after the commencement of the quadrennium commencing
150-in 2019 shall serve a term of four years.
151-(e) The commission shall hold its organizational
152-meeting by August 31, 2017. Thereafter, the commission shall
153-meet at the call of the chair; provided, that the commission
154-shall meet at least once annually.

179+(c) Members of the commission shall serve for a term of

189200 committee of the commission, or any other committee
190201 established by the commission may participate in a meeting of
191202 the commission or committee by means of telephone conference,
192203 video conference, or using similar communications methods by
193204 means of which all individuals participating in the meeting
194205 may hear one another. Participation by such means shall
195-constitute presence in person at a meeting for all purposes,
196-including for purposes of establishing a quorum. Notice of
197-meetings mustshall be provided in accordance with the Alabama
198-Open Meetings Act and similar means of communication be
199-allowed to provide for members of the public to listen and
200-observe meetings.
201-(g) The Secretary of the Senate, the Clerk of the House
202-of Representatives, the Legislative Services Agency, Legal
203-Division, the Legislative Services Agency, Fiscal Division,
204-and the Examiners of Public Accounts shall provide assistance
205-as requested by the commission. Each legislative member of the
206-commission and supporting staff shall be entitled to his or
207-her regular legislative compensation and his or her per diem
208-and travel expenses for each day he or she attends a meeting
209-of the commission which shall be paid out of any funds
210-appropriated for the use of the Legislature, upon warrants
211-drawn on the Comptroller upon requisition signed by the
212-commission's chair ; provided, however, that . members Members

245256 (h) The commission shall make proactive attempts to
246257 ensure the stability of Alabama-assigned Department of Defense
247258 resources by the study and evaluation of military
248259 organizations, personnel, civilian support personnel,
249260 equipment, and infrastructure currently located in the state,
250261 and the re-stationing or reorganization of military resources
251262 located in, relocating to, or outside of the state using the
252-following items of evaluation:
253-(1) All Department of Defense personnel, assets, and
254-equipment, including that belonging to the Alabama National
255-Guard and Reserve units or forces.
256-(2) The economic impact of these resources on
257-surrounding communities.
258-(3) Current policies, programs, and services that
259-impact Department of Defense resources located in the state.
260-(4) The impact these Department of Defense assets and
261-resources have on state and local job creation.
262-(5) The impact of Department of Defense assets and
263-resources on local businesses and industry.
264-(6) Funding available or required to promote the
265-sustained presence of Department of Defense assets and
266-resources appropriated to the state.
267-(i) The commission shall not alter the purpose,
268-replace, or change the role of any existing organization, task
269-force, or committee within a military community with the

293+(1) All Department of Defense personnel, assets, and
294+equipment, including that belonging to the Alabama National
295+Guard and Reserve units or forces.
296+(2) The economic impact of these resources on
297+surrounding communities.
298+(3) Current policies, programs, and services that
299+impact Department of Defense resources located in the state.
300+(4) The impact these Department of Defense assets and
301+resources have on state and local job creation.
302+(5) The impact of Department of Defense assets and
303+resources on local businesses and industry.
304+(6) Funding available or required to promote the
305+sustained presence of Department of Defense assets and
306+resources appropriated to the state.
307+(i) The commission shall not alter the purpose,
308+replace, or change the role of any existing organization, task
309+force, or committee within a military community with the
299310 purpose of promoting military growth including Base Closure
300311 and Realignment Commission associated actions.
301312 (j) The appointing authorities of the commission shall
302313 coordinate their appointments to assure the membership of the
303314 Alabama Job Creation and Military Stability Commission is
304315 inclusive and reflects the racial, gender, geographic, urban,
305316 rural, and economic diversity of the state.
306317 (k) The commission shall make an annual report to
307318 members of the Legislature no later than the seventh
308319 legislative day of each regular session beginning in 2018
309-detailing all commission activities and recommendations.
310-(l) The commission may accept gifts, contributions,
311-bequests, grants, and other donations, whether public or
312-private, of money, real property, or personal property and
313-shall expend the same in furtherance of the work of the
314-commission.
315-(m) The work of the commission shall be supported by
316-the Military Stability Foundation, an Alabama nonprofit
317-corporation incorporated on September 8, 2011, which shall not
318-be considered a government body. Documents produced by or for
319-the foundation shall not be considered public writings, even
320-if viewed by or delivered to the commission, as the disclosure
321-of the documents would be detrimental to the best interest of
322-the public."
323-Section 2. This act shall become effective on the first
324-day of the third month following its passage and approval by
325-the Governor, or its otherwise becoming law.
