20 | 23 | | Section 1. Section 45-22-100.07 of the Code of Alabama |

21 | 24 | | 1975, is amended to read as follows: |

23 | 26 | | (a) In Cullman County, the governing body of the Town |
---|
24 | 27 | | of Garden City may own, operate, manage, and preserve the |
---|
25 | 28 | | former Garden City school property in the Town of Garden City, |
---|
26 | 29 | | including any ball fields and other historical structures, |
---|
27 | 30 | | owned by the Cullman County Board of Education. To the extent |
---|
28 | 31 | | allowed under Section 36-1-12, members of the governing body |
---|
29 | 32 | | are immune from civil liability for actions taken in the |
---|
30 | 33 | | conduct of their duties relating to the Garden City school |
---|
31 | 34 | | property. |
---|
32 | 35 | | (b)(1) The governing body of the Town of Garden City |
---|
33 | 36 | | may accept title to the former Garden City school property |
---|
34 | 37 | | owned by the Cullman County Board of Education and may hold |
---|
35 | | - | the property for the benefit and use of the public, |
---|
36 | | - | particularly the Town of Garden City. The governing body of |
