16+AN ACT
1517 Relating to Lamar County; to authorize the county
1618 commission to set certain fees to be charged by the sheriff
1719 for personal service of documents in the civil division of the
1820 district and circuit court; to authorize the county commission
1921 to set the per day charge for feeding municipal inmates in the
2022 county jail; to authorize the county commission to set a fee
2123 for fingerprinting individuals by the sheriff's office for
2224 non-law enforcement purposes; and to provide for the
2325 distribution of the proceeds from the fees.
2426 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2527 Section 1. This act shall apply only in Lamar County.
2628 Section 2. (a) The Lamar County Commission may levy an
2729 additional fee for the personal service of process by the
2830 sheriff or his or her deputies or agents of documents filed in
2931 the civil division of the district and circuit court in the
3032 county as follows:
3133 (1) For the personal service of process of civil papers
3234 in the courts of Lamar County or from any other county in the
3335 state, the fee shall be fifty dollars ($50).
3436 (2) For the personal service of process by the sheriff
35-of civil papers sent to the sheriff for service from a court
36-outside of the state, the fee shall be seventy-five dollars
37-($75).
38-(b) The fees shall be collected by the appropriate
39-court clerk and shall be forwarded to the Lamar County General
40-Fund. Fifty percent of the proceeds shall be distributed to

66+of civil papers sent to the sheriff for service from a court
67+outside of the state, the fee shall be seventy-five dollars
68+($75).
69+(b) The fees shall be collected by the appropriate
70+court clerk and shall be forwarded to the Lamar County General
71+Fund. Fifty percent of the proceeds shall be distributed to
7072 the office of the sheriff to be used to defray the costs of
7173 personal service and for the operation of the office of
7274 sheriff.
7375 Section 3. The Lamar County Commission may set the
7476 amount the sheriff charges for the feeding of municipal
7577 inmates in the county jail. After the effective date of this
7678 act, the county commission shall set the amount the
7779 municipality pays at five dollars ($5) per day for municipal
7880 inmates held in the county jail. The county commission may
7981 each fiscal year review the amount of the payment and may
8082 adjust the amount to reasonably cover increases in the
8183 expenses by the sheriff. All proceeds from the fees shall be
8284 deposited in the municipal feeding account of the sheriff's
8385 office.
8486 Section 4. The Lamar County Commission may authorize
8587 the sheriff to charge a fee for fingerprinting individuals for
8688 non-law enforcement purposes, such as for passport
8789 identification or employment purposes. The proceeds from the
8890 fees shall be deposited in the Sheriff's Law Enforcement Fund
8991 and used for any law enforcement purpose.
9092 Section 5. This act shall become effective on the first
9193 day of the third month following its passage and approval by
92-the Governor, or its otherwise becoming law.
