15 | 17 | Relating to Lamar County; to authorize the county | |
16 | 18 | commission to set certain fees to be charged by the sheriff | |
17 | 19 | for personal service of documents in the civil division of the | |
18 | 20 | district and circuit court; to authorize the county commission | |
19 | 21 | to set the per day charge for feeding municipal inmates in the | |
20 | 22 | county jail; to authorize the county commission to set a fee | |
21 | 23 | for fingerprinting individuals by the sheriff's office for | |
22 | 24 | non-law enforcement purposes; and to provide for the | |
23 | 25 | distribution of the proceeds from the fees. | |
24 | 26 | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: | |
25 | 27 | Section 1. This act shall apply only in Lamar County. | |
26 | 28 | Section 2. (a) The Lamar County Commission may levy an | |
27 | 29 | additional fee for the personal service of process by the | |
28 | 30 | sheriff or his or her deputies or agents of documents filed in | |
29 | 31 | the civil division of the district and circuit court in the | |
30 | 32 | county as follows: | |
31 | 33 | (1) For the personal service of process of civil papers | |
32 | 34 | in the courts of Lamar County or from any other county in the | |
33 | 35 | state, the fee shall be fifty dollars ($50). | |
34 | 36 | (2) For the personal service of process by the sheriff | |
35 | - | of civil papers sent to the sheriff for service from a court | |
36 | - | outside of the state, the fee shall be seventy-five dollars | |
37 | - | ($75). | |
38 | - | (b) The fees shall be collected by the appropriate | |
39 | - | court clerk and shall be forwarded to the Lamar County General | |
40 | - | Fund. Fifty percent of the proceeds shall be distributed to | |

73 | 75 | Section 3. The Lamar County Commission may set the | |
74 | 76 | amount the sheriff charges for the feeding of municipal | |
75 | 77 | inmates in the county jail. After the effective date of this | |
76 | 78 | act, the county commission shall set the amount the | |
77 | 79 | municipality pays at five dollars ($5) per day for municipal | |
78 | 80 | inmates held in the county jail. The county commission may | |
79 | 81 | each fiscal year review the amount of the payment and may | |
80 | 82 | adjust the amount to reasonably cover increases in the | |
81 | 83 | expenses by the sheriff. All proceeds from the fees shall be | |
82 | 84 | deposited in the municipal feeding account of the sheriff's | |
83 | 85 | office. | |
84 | 86 | Section 4. The Lamar County Commission may authorize | |
85 | 87 | the sheriff to charge a fee for fingerprinting individuals for | |
86 | 88 | non-law enforcement purposes, such as for passport | |
87 | 89 | identification or employment purposes. The proceeds from the | |
88 | 90 | fees shall be deposited in the Sheriff's Law Enforcement Fund | |
89 | 91 | and used for any law enforcement purpose. | |
90 | 92 | Section 5. This act shall become effective on the first | |
91 | 93 | day of the third month following its passage and approval by | |
92 | - | the Governor, or its otherwise becoming law. | |
