15+Under existing law, a district attorney is
16+authorized to employ various personnel.
17+This bill would remove any limitations on a
18+district attorney's authorization to hire personnel
19+based on the residency of any current or potential
20+personnel.

1524 Relating to district attorneys; to amend Section
1625 12-17-220, Code of Alabama 1975; to remove limitations on a
1726 district attorney's authorization to hire personnel based on
1827 the residency of any current or potential personnel.
1928 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2029 Section 1. Section 12-17-220, Code of Alabama 1975, is
2130 amended to read as follows:
2231 "ยง12-17-220
2332 (a)(1) The district attorney of each judicial circuit
2433 is hereby authorized to employ, in any manner as he or she
2534 shall determine necessary, assistant district attorneys,
2635 investigators, clerical, secretarial, and other personnel, who
27-shall be paid from funds available for that purpose. Unless
28-otherwise provided by local law for Talladega County, all of
29-these employees shall serve at the pleasure of the district
30-attorney and shall not be considered employees under the State
31-Merit System Act.
32-(2) The district attorney's authority to employ
33-personnel pursuant to subdivision (1) shall not be limited by
34-the residency of any current or potential personnel.
35-(b) The district attorney is authorized to supplement
36-the salaries of personnel employed within his or her office.
37-(c) The district attorney is authorized to use funds
38-available to him or her from all sources such as grants,
39-appropriations, gifts, and other sources for the purposes

7584 Section 2. This act shall become effective immediately
7685 following its passage and approval by the Governor, or its
