16+AN ACT
1517 Relating to Marion County ; to amend Sections 45-47-230
1618 and 45-47-242.21, Code of Alabama 1975, to abolish certain
1719 expense allowances paid to certain county officials; to revise
1820 the salaries of the sheriff, revenue commissioner, and members
1921 of the county commission; and to repeal Section 45-47-70, Code
2022 of Alabama 1975, relating to expense allowances paid to
2123 members of the Marion County Commission.
2224 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2325 Section 1. Sections 45-47-230 and 45-47-242.21, Code of
2426 Alabama 1975, are amended to read as follows:
2527 "§45-47-230
2628 (a) The County Commission of Marion County is
2729 authorized and directed to pay the chief deputy sheriff, each
2830 deputy sheriff, and the sheriff's clerk an additional expense
2931 allowance of one hundred dollars ($100) per month payable from
3032 the general fund of the county. The expense allowance shall be
3133 in addition to all compensation or allowances heretofore
3234 payable to each such officer.
3335 (b) The Sheriff of Marion County shall be entitled to
3436 receive an expense allowance in the amount of five hundred
35-dollars ($500) per month and each Each deputy sheriff of
36-Marion County shall be entitled to receive an expense
37-allowance of fifty dollars ($50) per month to be paid out of
38-the county general fund. This expense allowance shall be in
39-addition to any and all other compensation, salary, and
40-expense allowances provided for by law. The expense allowance

7173 "§45-47-242.21
7274 (a) The judge of probate is relieved of all duties and
7375 responsibilities relating to the assessment and collection of
7476 taxes, commissions, and issuance fees on motor vehicles. The
7577 revenue commissioner shall receive the commissions and fees
7678 currently allocated to the judge of probate for performing
7779 these functions, and those fees and commissions shall be
7880 remitted to the county general fund. Reporting and remitting
7981 the collections of those fees shall be made by the revenue
8082 commissioner or as otherwise required by law.
8183 (b) The Revenue Commissioner of Marion County shall
8284 perform all duties relating to the issuance of motor vehicle
8385 license plates in the county and shall perform all duties
8486 relating to the assessment and collection of ad valorem taxes,
8587 commissions, fees, or other charges imposed by law on motor
8688 vehicles, which have heretofore been performed jointly by the
8789 revenue commissioner and the judge of probate.
8890 (c) The Revenue Commissioner of Marion County shall be
8991 compensated an additional five thousand dollars ($5,000) per
9092 year, paid in equal monthly installments from the general fund
9193 of the county, for performing all of the duties relating to
92-the assessments, collections, and issuance of motor vehicle
93-license plates in Marion County. "
94-Section 2. (a) Beginning on the effective date of this
95-act, the Sheriff of Marion County shall receive an additional
96-expense allowance in an amount that brings his or her total
97-compensation to eighty thousand dollars ($80,000) per year to

133135 of eighty thousand dollars ($80,000), which shall be in lieu
134136 of any other compensation, salary, or expense allowance
135137 provided by law for the sheriff for the performance of his or
136138 her official duties.
137139 Section 3.(a) Beginning on the effective date of this
138140 act, the Revenue Commissioner of Marion County shall receive
139141 an additional expense allowance in an amount that brings his
140142 or her total compensation to seventy-two thousand dollars
141143 ($72,000) per year to be paid out of the county general fund.
142144 The expense allowance shall be in addition to any and all
143145 other compensation, salary, or expense allowances provided by
144146 law.
145147 (b) Beginning with the next term of office, the expense
146148 allowance provided in subsection (a) shall be void, and the
147149 Revenue Commissioner of Marion County shall receive a total
148150 yearly salary of seventy-two thousand dollars ($72,000), which
149-shall be in lieu of any other compensation, salary, or expense
150-allowance provided by law for the revenue commissioner for the
151-performance of his or her official duties. The compensation
152-provided by Section 11-2A-3, Code of Alabama 1975, shall be
153-considered to be included in the total yearly salary.

180+shall be in lieu of any other compensation, salary, or expense
181+allowance provided by law for the revenue commissioner for the
182+performance of his or her official duties. The compensation
183+provided by Section 11-2A-3, Code of Alabama 1975, shall be
184+considered to be included in the total yearly salary.
185+Section 4.(a) Beginning on the effective date of this
184186 act, each member of the Marion County Commission shall receive
185187 an additional expense allowance in an amount that brings the
186188 total compensation of each member to sixty thousand dollars
187189 ($60,000) per year to be paid out of the county general fund.
188190 The expense allowance shall be in addition to any and all
189191 other compensation, salary, or expense allowances provided by
190192 law.
191193 (b) Beginning with the next term of office, the expense
192194 allowance provided in subsection (a) shall be void, and each
193195 member of the Marion County Commission shall receive a total
194196 yearly salary of sixty thousand dollars ($60,000), which shall
195197 be in lieu of any other compensation, salary, or expense
196198 allowance provided by law for the members for the performance
197199 of their official duties.
198200 Section 5. Section 45-47-70, Code of Alabama 1975,
199201 relating to expense allowances paid to members of the Marion
200202 County Commission, is repealed.
201203 Section 6. This act shall become effective immediately
202204 following its passage and approval by the Governor, or its
203205 otherwise becoming law.
