15 | 17 | Relating to Marion County; to create additional | |
16 | 18 | qualifications for the office of sheriff. | |
17 | 19 | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: | |
18 | 20 | Section 1. In Marion County, after the effective date | |
19 | 21 | of this act, any individual seeking to qualify for election to | |
20 | 22 | the office of sheriff or any individual appointed to serve as | |
21 | 23 | sheriff shall meet all of the following minimum qualifications | |
22 | 24 | in addition to any other qualifications required by law: | |
23 | 25 | (1) The individual is a citizen of the United States. | |
24 | 26 | (2) The individual has been a resident of Marion County | |
25 | 27 | for at least one year immediately prior to the qualification | |
26 | 28 | date or appointment date. | |
27 | 29 | (3) The individual has the qualifications of an elector | |
28 | 30 | pursuant to state and federal law and has been registered to | |
29 | 31 | vote in Marion County for at least one year immediately prior | |
30 | 32 | to the qualification date or appointment date. | |
31 | 33 | (4) The individual has attained a high school diploma | |
32 | 34 | or its equivalent, such as a GED. | |
33 | 35 | (5) The individual is 25 years of age or older prior to | |
34 | 36 | the qualification date or appointment date. | |
35 | - | (6) The individual has at least three years of prior | |
36 | - | full-time service as a law enforcement officer having the | |
37 | - | power of arrest, certified by the Alabama Peace Officers' | |
38 | - | Standards and Training Commission. | |
39 | - | (7) The individual has never been convicted of a felony | |
40 | - | criminal offense nor been convicted of a criminal offense in | |

71 | 73 | committed in this state. | |
72 | 74 | (8) The individual has either of the following | |
73 | 75 | qualifications: | |
74 | 76 | a. Has not been retired or separated from full-time | |
75 | 77 | active law enforcement, certified through the Alabama Peace | |
76 | 78 | Officers' Standards and Training Commission, for more than two | |
77 | 79 | consecutive years immediately prior to the qualification date | |
78 | 80 | or appointment date. | |
79 | 81 | b. If the individual does not qualify under a., the | |
80 | 82 | individual has obtained a recertification of full-time active | |
81 | 83 | law enforcement status as a law enforcement officer from the | |
82 | 84 | Alabama Peace Officers' Standards and Training Commission | |
83 | 85 | prior to the qualification date or appointment date. | |
84 | 86 | Section 2. Each year, the Sheriff of Marion County | |
85 | 87 | shall attend a minimum of 12 hours of executive level | |
86 | 88 | continuing education training approved by the Alabama Sheriffs | |
87 | 89 | Association, the National Sheriffs' Association, or any other | |
88 | 90 | recognized executive level continuing education training | |
89 | 91 | designed for law enforcement. | |
90 | 92 | Section 3. This act shall become effective immediately | |
91 | 93 | following its passage and approval by the Governor, or its | |
92 | - | otherwise becoming law. | |
