16+AN ACT
1517 Relating to Marion County; to create additional
1618 qualifications for the office of sheriff.
1719 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
1820 Section 1. In Marion County, after the effective date
1921 of this act, any individual seeking to qualify for election to
2022 the office of sheriff or any individual appointed to serve as
2123 sheriff shall meet all of the following minimum qualifications
2224 in addition to any other qualifications required by law:
2325 (1) The individual is a citizen of the United States.
2426 (2) The individual has been a resident of Marion County
2527 for at least one year immediately prior to the qualification
2628 date or appointment date.
2729 (3) The individual has the qualifications of an elector
2830 pursuant to state and federal law and has been registered to
2931 vote in Marion County for at least one year immediately prior
3032 to the qualification date or appointment date.
3133 (4) The individual has attained a high school diploma
3234 or its equivalent, such as a GED.
3335 (5) The individual is 25 years of age or older prior to
3436 the qualification date or appointment date.
35-(6) The individual has at least three years of prior
36-full-time service as a law enforcement officer having the
37-power of arrest, certified by the Alabama Peace Officers'
38-Standards and Training Commission.
39-(7) The individual has never been convicted of a felony
40-criminal offense nor been convicted of a criminal offense in

66+(6) The individual has at least three years of prior
67+full-time service as a law enforcement officer having the
68+power of arrest, certified by the Alabama Peace Officers'
69+Standards and Training Commission.
70+(7) The individual has never been convicted of a felony
71+criminal offense nor been convicted of a criminal offense in
7072 another jurisdiction that would qualify as a felony if
7173 committed in this state.
7274 (8) The individual has either of the following
7375 qualifications:
7476 a. Has not been retired or separated from full-time
7577 active law enforcement, certified through the Alabama Peace
7678 Officers' Standards and Training Commission, for more than two
7779 consecutive years immediately prior to the qualification date
7880 or appointment date.
7981 b. If the individual does not qualify under a., the
8082 individual has obtained a recertification of full-time active
8183 law enforcement status as a law enforcement officer from the
8284 Alabama Peace Officers' Standards and Training Commission
8385 prior to the qualification date or appointment date.
8486 Section 2. Each year, the Sheriff of Marion County
8587 shall attend a minimum of 12 hours of executive level
8688 continuing education training approved by the Alabama Sheriffs
8789 Association, the National Sheriffs' Association, or any other
8890 recognized executive level continuing education training
8991 designed for law enforcement.
9092 Section 3. This act shall become effective immediately
9193 following its passage and approval by the Governor, or its
92-otherwise becoming law.
