1313 SYNOPSIS:
1414 Under existing law, a local board of education
1515 is required to adopt policies providing for certain
1616 salary deductions for its employees.
1717 This bill would require local boards of
1818 education to adopt policies to provide for deductions
1919 from employee salaries for the membership dues of
2020 professional educators' associations.

2424 Relating to public education; to amend Section 16-22-6,
2525 Code of Alabama 1975; to provide for salary deductions for
2626 membership dues of professional educators' associations.
2727 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2828 Section 1. Section 16-22-6, Code of Alabama 1975, is
2929 amended to read as follows:

3131 (a)(1) Each local board of education and certain
3232 postsecondary institutions shall adopt policies or regulations
3333 which will provide for deductions from salaries of its
3434 employees or groups of employees whenever a request is

6464 presented to the board or postsecondary institution by the
6565 employees or groups. The deductions shall be made from
6666 salaries earned in at least nine different pay periods and
6767 shall be remitted to the appropriate company, association, or
6868 organization as specified by the employees within 10 days
6969 following each deduction. The deductions may be made for, but
7070 not be limited to, savings plans, tax sheltered annuities, the
7171 Public Employees' Individual Retirement Account Fund,
7272 membership dues, voluntary contributions, and group insurance
7373 premiums. Deductions for membership dues and voluntary
7474 contributions shall be made based upon membership lists and
7575 forms provided by the employees' organization. Such The lists

8383 be revoked by giving a 30-day notice in writing. New
8484 authorizations for deduction of dues, voluntary contributions,

8787 next following the receipt of authorization. Upon termination
8888 of employment, amounts owed under the authorization of the

122122 deducted during a pay period for a separate type of deduction.
123123 Health insurance, life insurance, and tax sheltered annuities
124124 shall be interpreted as separate types of deductions. When
125125 amounts have been correctly deducted and remitted by the board
126126 or postsecondary institution, the board or postsecondary
127127 institution shall bear no further responsibility or liability
128128 for subsequent transactions. No board or postsecondary
129129 institution shall be liable for any error when acting in good
130130 faith pursuant to this section.
131131 (2) For the purposes of this section, membership dues
132132 include membership dues paid to professional educators'
133133 associations.
134134 (b) This section shall not apply to any four-year
135135 postsecondary institution."
136136 Section 2. This act shall become effective on the first
137137 day of the third month following its passage and approval by
138138 the Governor, or its otherwise becoming law.
