1313 SYNOPSIS:
1414 This bill would create three additional circuit
1515 judgeships and two additional district judgeships to be
1616 funded out of the State General Fund in Fiscal Year
1717 2024 as follows: an additional circuit judgeship,
1818 designated as Circuit Judgeship Number 4, in the
1919 Eleventh Judicial Circuit comprised of Lauderdale
2020 County; an additional circuit judgeship, designated as
2121 Circuit Judgeship Number 4, in the Nineteenth Judicial
2222 Circuit comprised of Autauga, Chilton, and Elmore
2323 Counties; an additional circuit judgeship, designated
2424 as Circuit Judgeship Number 6, in the Twenty-eighth
2525 Judicial Circuit comprised of Baldwin County; an
2626 additional district judgeship, designated as District
2727 Judgedship Number 3, in Baldwin County; and an
2828 additional district judgeship, designated as District
2929 Judgeship Number 2, in DeKalb County.
3030 This bill would create three additional circuit
3131 judgeships and two additional district judgeships to be
3232 funded out of the State General Fund in Fiscal Year
3333 2025 as follows: an additional circuit judgeship,
3434 designated as Circuit Judgeship Number 7, in the Sixth

7171 judgeship, designated as District Judgeship Number 6,
7272 in Mobile County; and an additional district judgeship,
7373 designated as District Judgeship Number 3, in Shelby

7575 This bill would create two additional circuit
7676 judgeships and one additional district judgeship to be
7777 funded out of the State General Fund in Fiscal Year
7878 2026 as follows: an additional circuit judgeship,

8787 This bill would provide for the authority of the

122122 To provide for additional circuit judgeships and
123123 additional district judgeships to be funded out of the State
124124 General Fund in Fiscal Years 2024, 2025, and 2026; and to
125125 provide for the authority of the judges and for the
126126 compensation and benefits of the judges.
127127 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
128128 Section 1.(a)(1) There is created an additional circuit
129129 judgeship for the Eleventh Judicial Circuit which shall be
130130 designated as Judgeship Number 4.
131131 (2) There is created an additional circuit judgeship
132132 for the Nineteenth Judicial Circuit which shall be designated
133133 as Circuit Judgeship Number 4. The judge elected to Judgeship
134134 Number 4 may reside in any county within the Nineteenth
135135 Judicial Circuit. The judge occupying Judgeship Number 4 shall
136136 be assigned to the domestic relations division of the circuit.
137137 (3) There is created an additional circuit judgeship
138138 for the Twenty-eighth Judicial Circuit which shall be
139139 designated as Circuit Judgeship Number 6.
140140 (4) There is created an additional district judgeship
141141 for Baldwin County which shall be designated as District
142142 Judgeship Number 3.
143143 (5) There is created an additional district judgeship
144144 for DeKalb County which shall be designated as District
145145 Judgeship Number 2.
146146 (b) The additional judgeships created pursuant to
147147 subsection (a) shall be filled at the next general election
148148 after the effective date of this act.

178178 (c) The initial judges elected to the additional
179179 judgeships created pursuant to subsection (a) shall serve for
180180 a six-year term holding office from the first Monday following
181181 the second Tuesday in January after the general election at
182182 which the judges are elected.
183183 (d) The initial judges elected to the additional
184184 judgeships created pursuant to subsection (a) shall have and
185185 shall exercise all the jurisdiction, power, rights, and
186186 authority and shall possess all of the qualifications, perform
187187 all of the duties, and shall be subject to all of the
188188 responsibilities and duties of the office to which other
189189 judges are subject.
190190 (e) The annual compensation of the additional judges
191191 elected pursuant to subsection (a) shall be in accordance with
192192 Chapter 10A of Title 12, Code of Alabama 1975, including, but
193193 not limited to, the provision that no judge first elected or
194194 appointed to office after October 1, 2001, may be provided a
195195 salary supplement or expense allowance.
196196 (f) Funding for the additional judgeships created
197197 pursuant to subsection (a) shall be made from the State
198198 General Fund appropriation to the Unified Judicial System
199199 commencing in Fiscal Year 2024.
200200 Section 2. (a)(1) There is created an additional
201201 circuit judgeship for the Sixth Judicial Circuit which shall
202202 be designated as Judgeship Number 7.
203203 (2) There is created an additional circuit judgeship
204204 for the Twenty-third Judicial Circuit which shall be
205205 designated as Circuit Judgeship Number 9.

298298 Section 3. (a)(1) There is created an additional
299299 circuit judgeship for the Nineteenth Judicial Circuit which
300300 shall be designated as Circuit Judgeship Number 5. The judge
301301 elected to Judgeship Number 5 may reside in any county within
302302 the Nineteenth Judicial Circuit.

304304 for the Twenty-eighth Judicial Circuit which shall be
305305 designated as Circuit Judgeship Number 7.

309309 (b) The additional judgeships created pursuant to

353353 (e) The annual compensation of the additional judges
354354 elected pursuant to subsection (a) shall be in accordance with
355355 Chapter 10A of Title 12, Code of Alabama 1975, including, but
356356 not limited to, the provision that no judge first elected or
357357 appointed to office after October 1, 2001, may be provided a
358358 salary supplement or expense allowance.
359359 (f) Funding for the additional judgeships created
360360 pursuant to subsection (a) shall be made from the State

363363 Section 4. Section 1 shall become effective
364364 immediately, Section 2 shall become effective October 1, 2024,
365365 and Section 3 shall become effective October 1, 2025,
366366 following its passage and approval by the Governor, or its
367367 otherwise becoming law.
