1313 SYNOPSIS:
1414 Under existing law, loitering is a violation.
1515 This bill would prohibit an individual from
1616 loitering on a public roadway maintained by the state
1717 or in the right-of-way of a public roadway maintained
1818 by the state.
1919 Under existing law, a pedestrian soliciting
2020 employment, business, or contributions or distributing
2121 articles on a highway is a violation.
2222 This bill would remove this prohibition.
2323 Section 111.05 of the Constitution of Alabama of
2424 2022, prohibits a general law whose purpose or effect
2525 would be to require a new or increased expenditure of
2626 local funds from becoming effective with regard to a
2727 local governmental entity without enactment by a 2/3
2828 vote unless: it comes withing one of a number of
2929 specified examples; it is approved by the affected
3030 entity; or the Legislature appropriates funds, or
3131 provides a local source of revenue, to the entity for
3232 the purpose.
3333 The purpose or effect of this bill would be to
3434 require a new or increased expenditure of local funds
3535 within the meaning of the amendment. However, the bill
3636 does not require approval of a local governmental
3737 entity or enactment by a 2/3 vote to become effective

7171 AN ACT
7272 Relating to crimes and offenses; to amend Sections
7373 13A-11-9 and 32-5A-216, Code of Alabama 1975, to prohibit an
7474 individual from loitering on a public roadway maintained by
7575 the state or in the right-of-way of a public roadway
7676 maintained by the state; to remove the prohibition on a
7777 pedestrian soliciting employment, business, or contributions
7878 or distributing articles on a highway; to provide criminal
7979 penalties for violations; and in connection therewith would
8080 have as its purpose or effect the requirement of a new or
8181 increased expenditure of local funds within the meaning of
8282 Section 111.05 of the Constitution of Alabama 2022.
8383 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
8484 Section 1. Sections 13A-11-9 and 32-5A-216, Code of
8585 Alabama 1975, are amended to read as follows:
8686 "§13A-11-9
8787 (a) A person commits the crime of loitering if he or
8888 she does any of the following:
8989 (1) Loiters,or remains, or wanders about in on a
9090 public place for the purpose of begging roadway maintained by
9191 the state or the right-of-way of a public roadway maintained

122122 (2) Loiters or remains in a public place for the
123123 purpose of gambling.
124124 (3) Loiters or remains in a public place for the
125125 purpose of engaging or soliciting another person to engage in
126126 prostitution or sodomy.
127127 (4) Being masked, loiters, remains, or congregates in a
128128 public place.
129129 (5) Loiters or remains in or about a school, college,
130130 or university building or grounds after having been told to
131131 leave by any authorized official of the school, college, or
132132 university, not having any reason or relationship involving
133133 custody of or responsibility for a pupil or any other
134134 specific, legitimate reason for being there, and not having
135135 written permission from a school, college , or university
136136 administrator.
137137 (6) Loiters or remains in any transportation facility,
138138 unless specifically authorized to do so, for the purpose of
139139 soliciting or engaging in any business, trade, or commercial
140140 transactions involving the sale of merchandise or services.
141141 (7) Loiters or remains in any place with one or more
142142 persons for the purpose of unlawfully using or possessing a
143143 dangerous drug.
144144 (b) A person does not commit a crime under subdivision
145145 (a)(4) if he or she is going to or from or staying at a
146146 masquerade party, or is participating in a public parade or
147147 presentation of an educational, religious, or historical
148148 character or in an event as defined in Section 13A-11-140.

178178 (c) Sodomy in subdivision (a)(3) is defined as in
179179 Section 13A-6-60.
180180 (d) Dangerous drug in subdivision (a)(7) means any
181181 narcotic, drug, or controlled substance as defined in Chapter
182182 2 of Title 20 and any schedule incorporated therein.
183183 (e) Loitering is a violation. A second or subsequent
184184 violation of this section in the same jurisdiction is a Class
185185 C misdemeanor.
186186 (f)(1) Prior to making an arrest for a violation of
187187 subdivision (a)(1), a law enforcement officer may instruct any
188188 person in violation of subdivision (a)(1) to immediately and
189189 peaceably exit the public roadway maintained by the state or
190190 the right-of-way of the public roadway maintained by the
191191 state.
192192 (2)a. Prior to making an arrest for an initial
193193 violation of subdivision (a)(1), a law enforcement officer may
194194 offer to transport any person in violation of subdivision
195195 (a)(1) to a location in the jurisdiction that offers emergency
196196 housing, if applicable.
197197 b. If a person accepts an offer made pursuant to
198198 subdivision (1), a law enforcement officer may transport the
199199 person accordingly.
200200 (g) Any actions undertaken by a law enforcement officer
201201 pursuant to this section shall be subject to Section 36-1-12. "

203203 (a) No person shall stand in a roadway for the purpose
204204 of soliciting a ride.
205205 (b) No person shall stand on a highway for the purpose

235235 of soliciting employment, business, or contributions from the
236236 occupant of any vehicle, nor for the purpose of distributing
237237 any article, unless otherwise authorized by official permit of
238238 the governing body of the city or county having jurisdiction
239239 over the highway.
240240 (c)(b) No person shall stand on or in proximity to a
241241 street or highway for the purpose of soliciting the watching
242242 or guarding of any vehicle while parked or about to be parked
243243 on a street or highway.
244244 (d)(c) No person shall fish from a bridge, viaduct, or
245245 trestle, or the approaches thereto, within the State of
246246 Alabama, unless otherwise authorized by the governing body of
247247 the city or county having jurisdiction over the highway or
248248 from the State of Alabama in the case of state highways. The
249249 authorizing authority shall erect and maintain appropriate
250250 signs giving notice that fishing is allowed."
251251 Section 2. Although this bill would have as its purpose
252252 or effect the requirement of a new or increased expenditure of
253253 local funds, the bill is excluded from further requirements
254254 and application under Section 111.05 of the Constitution of
255255 Alabama of 2022, because the bill defines a new crime or
256256 amends the definition of an existing crime.
257257 Section 3. This act shall become effective on the first
258258 day of the third month following its passage and approval by
259259 the Governor, or its otherwise becoming law.
