1515 SYNOPSIS:
1616 Under existing law, a retiree receiving an
1717 Employees' Retirement System or Teachers' Retirement
1818 System allowance may perform duties with an employer
1919 participating in the system without suspension of the
2020 retirement allowance, provided the person is not
2121 employed in a permanent full-time capacity and the
2222 compensation does not exceed $30,000 plus Consumer
2323 Price Index adjustments after 2017.
2424 This bill would provide further for the
2525 compensation earned by retired law enforcement officers
2626 working as school resource officers for local boards of
2727 education.

3030 AN ACT
3131 Relating to the Teachers' Retirement System and the
3232 Employees' Retirement System; to amend Section 16-1-44.1, Code
3333 of Alabama 1975; to provide further for the compensation of
3434 retired law enforcement officers providing services as school
3535 resource officers for local boards of education.

6666 Section 1. Section 16-1-44.1 of the Code of Alabama
6767 1975, is amended to read as follows:
6868 "ยง16-1-44.1
6969 (a) As used in this section, the following terms have
7070 the following meanings:
7171 (1) RETIRED LAW ENFORCEMENT OFFICER. A person who was a
7272 law enforcement officer and retired in good standing from a
7373 federal, state, or local law enforcement agency with at least
7474 20 years of law enforcement experience.
7575 (2) SCHOOL RESOURCE OFFICER. A person who is certified
7676 by the Alabama Peace Officers' Standards and Training
7777 Commission as a law enforcement officer, whose certification
7878 is in good standing, and who has the power of arrest.
7979 (b) A local board of education may employ persons as
8080 school security personnel or contract with a local chief of
8181 police or sheriff to employ school resource officers. A local
8282 board of education may allow any person employed by the board
8383 as school security personnel or as a school resource officer
8484 to carry a firearm while on duty if the employee satisfies all
8585 of the following qualifications:
8686 (1) He or she is certified by the Alabama Peace
8787 Officers' Standards and Training Commission as a law
8888 enforcement officer whose certification is in good standing or
8989 he or she is a retired law enforcement officer.
9090 (2) He or she has successfully completed active shooter
9191 training approved by the Alabama State Law Enforcement Agency.
9292 (3) He or she annually completes and passes the firearm
9393 requalification required of law enforcement officers by the

124124 (4) While on duty, he or she carries a non-lethal
125125 weapon and is trained in the appropriate use of that
126126 non-lethal weapon.
127127 (c) The compensation paid to a retired law enforcement
128128 officer employed by a local board of education as a school
129129 resource officer for hours worked after regular school hours
130130 for extracurricular activities shall be paid on a contractual
131131 basis and shall not be included in the calculation of the
132132 limits set forth by Sections 16-25-26(a) and 36-27-8.2(a).
133133 (c)(d) Nothing in this section confers upon any
134134 individual the power of arrest.
135135 (d)(e) The State Department of Education shall adopt
136136 any necessary rules to provide for the implementation of this
137137 section including, but not limited to, rules providing
138138 additional qualifications for employment as school security
139139 personnel or school resource officers."
140140 Section 2. This act shall become effective on the first
141141 day of the third month following its passage and approval by
142142 the Governor, or its otherwise becoming law.
