15-To make an appropriation of $13,651,435 from the
15+SYNOPSIS:
16+This bill makes an appropriation of $13,151,435
17+from the Education Trust Fund to Tuskegee University in
18+Tuskegee, Alabama, for the support and maintenance of
19+the educational program of the institution, for the
20+fiscal year ending September 30, 2024; provides that
21+the appropriation is subject to certain provisions of
22+the Code of Alabama 1975; requires an operations plan
23+and an audited financial statement prior to the release
24+of any funds; and requires an end of year
25+report.

28+AN ACT
29+To make an appropriation of $13,151,435 from the
1630 Education Trust Fund to Tuskegee University in Tuskegee,
1731 Alabama, for the support and maintenance of the educational
1832 program of the institution, for the fiscal year ending
1933 September 30, 2024; to provide that the appropriation is
2034 subject to certain provisions of the Code of Alabama 1975; to
2135 require an operations plan and an audited financial statement
2236 prior to the release of any funds; and to require an end of
23-year report.
24-BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
25-Section 1. Tuskegee University has a unique
26-relationship to the State of Alabama. Due to the unique nature
27-of the circumstances related to the establishment and
28-development of Tuskegee Institute which differs from that of
29-private schools and colleges receiving funds from the state
30-and from the state's public colleges and universities, the
31-institution should be afforded a unique treatment relative to
32-funding from the Education Trust Fund. Tuskegee Institute was
33-established by an act of the Legislature in 1881 and
34-separately incorporated by an act of the Legislature in 1892;
35-the Governor appoints five commissioners who serve as voting
36-members on the Tuskegee University Board; and the State
37-Superintendent of Education serves as an ex officio voting
38-commissioner on the Tuskegee University Board. Tuskegee has

67+BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
68+Section 1. Tuskegee University has a unique
69+relationship to the State of Alabama. Due to the unique nature

7084 institution, it is deemed that Tuskegee University should be
7185 funded accordingly and not as the private schools and colleges
7286 nor as the state public colleges and universities are funded.
7387 Section 2. There is hereby appropriated the sum of
74-$13,651,435 from the Education Trust Fund to Tuskegee
88+$13,151,435 from the Education Trust Fund to Tuskegee
7589 University in Tuskegee, Alabama, for the support and
7690 maintenance of the educational program of the institution, for
7791 the fiscal year ending September 30, 2024. Of the above
7892 appropriation, at least $2,000,000 shall be expended for the
7993 agricultural research and extension service state match.
80-Section 3. The above appropriation is made for the
81-support of public education in Alabama and for the support and
82-maintenance of the above program. The appropriation shall be
83-subject to the provisions, terms, conditions, and limitations
84-of the Budget and Financial Control Act, Section 41-4-80 et
85-seq., Code of Alabama 1975, the provisions of the Budget
86-Management Act of 1976, Section 41-19-1 et seq., Code of
87-Alabama 1975, and any other provisions of this act.
88-Section 4. (a) Prior to the release of any funds
89-appropriated under this act the following reports shall be
90-submitted:
91-(1) An operations plan for the 2024 fiscal year,
92-including goals and measurable performance indicators, shall
93-be submitted to and approved by the Director of Finance, as
94-provided for state agencies in Section 41-19-10 of the Code of
95-Alabama 1975.

123+Section 3. The above appropriation is made for the
124+support of public education in Alabama and for the support and
125+maintenance of the above program. The appropriation shall be
126+subject to the provisions, terms, conditions, and limitations
127+of the Budget and Financial Control Act, Section 41-4-80 et
128+seq., Code of Alabama 1975, the provisions of the Budget
129+Management Act of 1976, Section 41-19-1 et seq., Code of
130+Alabama 1975, and any other provisions of this act.
131+Section 4. (a) Prior to the release of any funds
132+appropriated under this act the following reports shall be

134+(1) An operations plan for the 2024 fiscal year,

125139 (2) An audited financial statement for all operations
126140 during the 2022 fiscal year.
127141 (b) It is the intent that funds appropriated for the
128142 2024 fiscal year shall be released by the Director of Finance
129143 following receipt of the above reports.
130144 (c) In addition, quarterly reports shall be made to the
131145 Director of Finance relating actual expenditures and
132146 accomplishments to planned expenditures and accomplishments.
133147 An end of year performance report for the 2024 fiscal year
134148 shall be made to the Director of Finance stating the work
135149 accomplished and the services provided and the costs of
136150 accomplishing the work and providing the services, citing
137-meaningful measures of program effectiveness and costs, as is
138-required for state agencies in Section 41-19-11 of the Code of
139-Alabama 1975.
140-(d) The Director of Finance shall forward a copy of all
141-required reports to the Legislative Council in a timely
142-manner.
143-Section 5. This act shall become effective October 1,
144-2023.
