	17	+	AN ACT
15	18		Relating to Macon County; to amend Section 45-44-90 of
16	19		the Code of Alabama 1975, establishing the Macon County
17	20		Economic Development Authority, to further provide for the
18	21		operation of the authority; and to authorize the formation of
19	22		a successor authority under certain conditions.
20	23		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
21	24		Section 1. Section 45-44-90 of the Code of Alabama
22	25		1975, is amended to read as follows:
23	26		"§45-44-90
24	27		(a) In Macon County, there is created the Macon County
25	28		Economic Development Authority to aid and assist current
26	29		industries and coordinate efforts of all municipal and county
27	30		agencies of Macon County, and to aid organizations in the
28	31		development of new industries which will provide job
29	32		opportunities for the citizens of the county.
30	33		(b) The authority created pursuant to Section (a) may
31	34		incorporate or reincorporate as an authority pursuant to
32	35		Chapter 92A of Title 11. The members of the board of directors
33	36		of the newly incorporated or reincorporated authority shall be
34	37		the same as the board members provided for in Section
35		-	45-44-90.01, as amended.
36		-	(c) Any funds distributed or otherwise available to the
37		-	Macon County Economic Development Authority pursuant to this
38		-	article or pursuant to Section 45-44-242.12, or otherwise, may
39		-	be expended or pledged by the authority, or any successor
40		-	authority, by whatever name known, for the purposes of

	67	+	45-44-90.01, as amended, unless otherwise provided in the
	68	+	articles of incorporation of the new authority.
	69	+	(c) Any funds distributed or otherwise available to the
	70	+	Macon County Economic Development Authority pursuant to this
	71	+	article or pursuant to Section 45-44-242.12, or otherwise, may
	72	+	be expended or pledged by the authority, or any successor
	73	+	authority, by whatever name known, for the purposes of
70	74		economic development in Macon County, including for the
71	75		purpose of securing and the repayment of loans for economic
72	76		development purposes. Any power, privilege, duty, or exemption
73	77		granted to any newly incorporated authority or any successor
74	78		authority shall not be construed as being inconsistent with,
75	79		replace, negate, or otherwise limit any purpose, power, or
76	80		source of funds granted to the Macon County Economic
77	81		Development Authority. "
78	82		Section 2. This act shall become effective immediately
79	83		following its passage and approval by the Governor, or its
80	84		otherwise becoming law.
