17+AN ACT
1518 Relating to Macon County; to amend Section 45-44-90 of
1619 the Code of Alabama 1975, establishing the Macon County
1720 Economic Development Authority, to further provide for the
1821 operation of the authority; and to authorize the formation of
1922 a successor authority under certain conditions.
2023 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2124 Section 1. Section 45-44-90 of the Code of Alabama
2225 1975, is amended to read as follows:
2326 "ยง45-44-90
2427 (a) In Macon County, there is created the Macon County
2528 Economic Development Authority to aid and assist current
2629 industries and coordinate efforts of all municipal and county
2730 agencies of Macon County, and to aid organizations in the
2831 development of new industries which will provide job
2932 opportunities for the citizens of the county.
3033 (b) The authority created pursuant to Section (a) may
3134 incorporate or reincorporate as an authority pursuant to
3235 Chapter 92A of Title 11. The members of the board of directors
3336 of the newly incorporated or reincorporated authority shall be
3437 the same as the board members provided for in Section
35-45-44-90.01, as amended.
36-(c) Any funds distributed or otherwise available to the
37-Macon County Economic Development Authority pursuant to this
38-article or pursuant to Section 45-44-242.12, or otherwise, may
39-be expended or pledged by the authority, or any successor
40-authority, by whatever name known, for the purposes of

67+45-44-90.01, as amended, unless otherwise provided in the
68+articles of incorporation of the new authority.
69+(c) Any funds distributed or otherwise available to the
70+Macon County Economic Development Authority pursuant to this
71+article or pursuant to Section 45-44-242.12, or otherwise, may
72+be expended or pledged by the authority, or any successor
73+authority, by whatever name known, for the purposes of
7074 economic development in Macon County, including for the
7175 purpose of securing and the repayment of loans for economic
7276 development purposes. Any power, privilege, duty, or exemption
7377 granted to any newly incorporated authority or any successor
7478 authority shall not be construed as being inconsistent with,
7579 replace, negate, or otherwise limit any purpose, power, or
7680 source of funds granted to the Macon County Economic
7781 Development Authority. "
7882 Section 2. This act shall become effective immediately
7983 following its passage and approval by the Governor, or its
8084 otherwise becoming law.
