1515 SYNOPSIS:
1616 Under existing law, political action committees
1717 (PACs) are prohibited from making contributions to
1818 other PACs, except that PACs may make contributions to
1919 principal campaign committees, so long as the donor PAC
2020 is not a principal campaign committee.
2121 This bill would permit PACs to make
2222 contributions to political parties so long as the donor
2323 PAC is not a principal campaign committee.

2626 AN ACT
2727 Relating to political action committees; to amend
2828 Section 17-5-15, Code of Alabama 1975, to permit PACs to make
2929 contributions to political parties in certain circumstances.
3030 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3131 Section 1. Section 17-5-15, Code of Alabama 1975, is
3232 amended to read as follows:
3333 "§17-5-15
3434 (a) It shall be unlawful for any person, acting for
3535 himself or herself or on behalf of any entity, to make a
3636 contribution in the name of another person or entity, or

6666 knowingly permit his or her name, or the entity's name, to be
6767 used to effect such a contribution made by one person or
6868 entity in the name of another person or entity, or for any
6969 candidate, principal campaign committee, or political action
7070 committee to knowingly accept a contribution made by one
7171 person or entity in the name of another person or entity;
7272 provided, however, that nothing in this chapter prohibits any
7373 person from soliciting and receiving contributions from other
7474 persons for the purpose of making expenditures to a candidate,
7575 political campaign committee, political action committee, or
7676 elected state or local official required to file reports
7777 pursuant to Section 17-5-8.
7878 (b)(1) It shall be unlawful for any political action
7979 committee or tax exempt political organization under 26 U.S.C.
8080 § 527, including a principal campaign committee, or any person
8181 authorized to make an expenditure on behalf of such political
8282 action committee or 527 organization, to make a contribution,
8383 expenditure, or any other transfer of funds to any other
8484 political action committee or 527 organization. It shall be
8585 unlawful for any principal campaign committee or any person
8686 authorized to make an expenditure on behalf of such principal
8787 campaign committee to make a contribution, expenditure, or
8888 other transfer of funds to any other principal campaign
8989 committee, except where the contribution, expenditure, or any
9090 other transfer of funds is made from a principal campaign
9191 committee to another principal campaign committee on behalf of
9292 the same person.
9393 (2) Notwithstanding the foregoingsubdivision (1), a

124124 committee may make contributions, expenditures, or other
125125 transfers of funds to a principal campaign committeecommittees
126126 and political parties ; and a separate segregated fund
127127 established by a corporation under federal law, if the fund
128128 does not receive any contributions from within this state
129129 other than contributions from its employees and directors, is
130130 not restricted by this subsection in the amount it may
131131 transfer to a political action committee established under the
132132 provisions of Section 17-5-14.1 by the same or an affiliated
133133 corporation."
134134 Section 2. This act shall become effective immediately
135135 following its passage and approval by the Governor, or its
136136 otherwise becoming law.
