	16	+	AN ACT
15	17		Relating to the City of Orange Beach in Baldwin County;
16	18		to alter, rearrange, and extend the boundary lines and
17	19		corporate limits of the City of Orange Beach.
18	20		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
19	21		Section 1. The boundary lines and corporate limits of
20	22		the City of Orange Beach in Baldwin County are altered,
21	23		rearranged, extended, and redefined so as to include within
22	24		the corporate limits of the City of Orange Beach, in addition
23	25		to the territory presently contained within the corporate
24	26		limits of the City of Orange Beach, all of the following
25	27		territory:
26	28		Tract 1. Parcels 10, 11, and 12, Coyote Flats being
27	29		more particularly described as follows: Commencing at the
28	30		Northwest corner of the Southwest quarter of Section 23,
29	31		Township 8 South, Range 4 East, Baldwin County, Alabama;
30	32		thence run S89°43’06”E, 2675.21 feet to a point; thence run
31	33		S00°00’11”E, 16.39 feet to a point on the south right-of-way
32	34		line of Russian Road and the POINT OF BEGINNING; thence run
33	35		N89°45’14”E, along said south right-of-way line, 599.83 feet
34	36		to a point; thence run S00°03’12”E, leaving said south
35	37		right-of-way line, 1317.05 feet to a point; thence run
36	38		N89°36’33”W, 601.23 feet to a point; thence run N00°00’26”E,
37		-	1312.30 feet to the POINT OF BEGINNING, lying in Section 23,
38		-	Township 8 South, Range 4 East, Baldwin County, Alabama.
39		-	TRACT 2. The North Half (N ½) of the Southwest Quarter
40		-	(SW ¼) of Section 24, Township 8 South, Range 4 East, Baldwin
41		-	County, Alabama. LESS AND EXCEPT THE FOLLOWING PARCEL:

	72	+	County, Alabama. LESS AND EXCEPT THE FOLLOWING PARCEL:
71	73		Commence at the Northwest corner of the Southwest Quarter of
72	74		Section 24, Township 8 South, Range 4 East, Baldwin County,
73	75		Alabama for the point of beginning; run thence North 89
74	76		degrees 39 minutes 15 seconds East along the North line of the
75	77		Southwest Quarter of said Section 24 for 184.47 feet; run
76	78		thence South 44 degrees 50 minutes 57 seconds West for 261.77
77	79		feet; run thence North 00 degrees 02 minutes 39 seconds East
78	80		for 184.47 feet to the Northwest corner of the Southwest
79	81		Quarter of Section 34, township 8 South, Range 4 East Baldwin
80	82		County, Alabama and the point of beginning.
81	83		TRACT 3. Commencing at the Southwest Corner of the
82	84		Northwest Quarter of the Southwest Quarter of Section 2,
83	85		Township 8 South, Range 5 East, Baldwin County, Alabama;
84	86		thence East 40.00 feet to the East right of way line of County
85	87		Road #95; thence North along said right of way line for 547.90
86	88		feet and point of beginning; thence continue North along same
87	89		course for 252.70 feet; thence East for 480.00 feet; thence
88	90		South for 252.70 feet; thence West 480.00 feet to the point of
89	91		beginning.
90	92		Section 2. The Legislature finds that the territory
91	93		described and annexed pursuant to this act is not subject to
92	94		referendum election pursuant to Section 2-11.40 of the
93	95		Constitution of Alabama of 2022. The territory annexed is
94		-	owned, occupied, and used by the City of Orange Beach for
95		-	public municipal purposes only and contains no residents or
96		-	municipal electors.
97		-	Section 3. All territory annexed in the corporate
98		-	limits of the City of Orange Beach under the provisions of

	125	+	owned, occupied, and used by the City of Orange Beach for
	126	+	public municipal purposes only and contains no residents or
	127	+	municipal electors.
	128	+	Section 3. All territory annexed in the corporate
	129	+	limits of the City of Orange Beach under the provisions of
128	130		this act shall be subject to the laws and ordinances of the
129	131		City of Orange Beach, and the City Council of the City of
130	132		Orange Beach shall have and exercise the same and exclusive
131	133		jurisdiction over the annexed territory that is presently
132	134		exercised over territory within the corporate limits of the
133	135		City of Orange Beach.
134	136		Section 4. In accordance with Section 11-42-6 of the
135	137		Code of Alabama 1975, a map showing the territory proposed to
136	138		be annexed to the City of Orange Beach is on file in the
137	139		Office of the Judge of Probate in Baldwin County, Alabama, and
138	140		the map is open to the inspection of the public.
139	141		Section 5. This act shall become effective the first
140	142		day of the third month following its passage and approval by
141	143		the Governor, or its otherwise becoming law.
