15	15	Under existing law, a district attorney is
16	16	authorized to employ various personnel.
17	17	This bill would remove any limitations on a
18	18	district attorney's authorization to hire personnel
19	19	based on the residency of any current or potential
20	20	personnel.
21	21	A BILL
22	22	TO BE ENTITLED
23	23	AN ACT
24	24	Relating to district attorneys; to amend Section
25	25	12-17-220, Code of Alabama 1975; to remove limitations on a
26	26	district attorney's authorization to hire personnel based on
27	27	the residency of any current or potential personnel.
28	28	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
29	29	Section 1. Section 12-17-220, Code of Alabama 1975, is
30	30	amended to read as follows:
31	31	"§12-17-220
32	32	(a)(1) The district attorney of each judicial circuit
33	33	is hereby authorized to employ, in any manner as he or she
34	34	shall determine necessary, assistant district attorneys,
35	35	investigators, clerical, secretarial, and other personnel, who

65	65	shall be paid from funds available for that purpose. Unless
66	66	otherwise provided by local law for Talladega County, all of
67	67	these employees shall serve at the pleasure of the district
68	68	attorney and shall not be considered employees under the State
69	69	Merit System Act.
70	70	(2) The district attorney's authority to employ
71	71	personnel pursuant to subdivision (1) shall not be limited by
72	72	the residency of any current or potential personnel.
73	73	(b) The district attorney is authorized to supplement
74	74	the salaries of personnel employed within his or her office.
75	75	(c) The district attorney is authorized to use funds
76	76	available to him or her from all sources such as grants,
77	77	appropriations, gifts, and other sources for the purposes
78	78	stated in this section or for any other law enforcement
79	79	purpose.
80	80	(d) Counties are authorized to supplement state
81	81	expenditures as they deem necessary and shall provide other
82	82	financial support as required by laws in effect on September
83	83	30, 1977."
84	84	Section 2. This act shall become effective immediately
85	85	following its passage and approval by the Governor, or its
86	86	otherwise becoming law.
