1414 SYNOPSIS:
1515 Under existing law, a district attorney is
1616 authorized to employ various personnel.
1717 This bill would remove any limitations on a
1818 district attorney's authorization to hire personnel
1919 based on the residency of any current or potential
2020 personnel.

2424 Relating to district attorneys; to amend Section
2525 12-17-220, Code of Alabama 1975; to remove limitations on a
2626 district attorney's authorization to hire personnel based on
2727 the residency of any current or potential personnel.
2828 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2929 Section 1. Section 12-17-220, Code of Alabama 1975, is
3030 amended to read as follows:
3131 "ยง12-17-220
3232 (a)(1) The district attorney of each judicial circuit
3333 is hereby authorized to employ, in any manner as he or she
3434 shall determine necessary, assistant district attorneys,
3535 investigators, clerical, secretarial, and other personnel, who

6565 shall be paid from funds available for that purpose. Unless
6666 otherwise provided by local law for Talladega County, all of
6767 these employees shall serve at the pleasure of the district
6868 attorney and shall not be considered employees under the State
6969 Merit System Act.
7070 (2) The district attorney's authority to employ
7171 personnel pursuant to subdivision (1) shall not be limited by
7272 the residency of any current or potential personnel.
7373 (b) The district attorney is authorized to supplement
7474 the salaries of personnel employed within his or her office.
7575 (c) The district attorney is authorized to use funds
7676 available to him or her from all sources such as grants,
7777 appropriations, gifts, and other sources for the purposes
7878 stated in this section or for any other law enforcement
7979 purpose.
8080 (d) Counties are authorized to supplement state
8181 expenditures as they deem necessary and shall provide other
8282 financial support as required by laws in effect on September
8383 30, 1977."
8484 Section 2. This act shall become effective immediately
8585 following its passage and approval by the Governor, or its
8686 otherwise becoming law.
