15	15	AN ACT
16	16	Relating to Etowah County; to provide that the
17	17	director and employees of The Etowah County Punishment and
18	18	Corrections Authority have arrest powers and may make arrests
19	19	in certain circumstances.
20	20	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
21	21	Section 1. (a) The Director of The Etowah County
22	22	Punishment and Corrections Authority and employees of the
23	23	authority shall be considered law enforcement officers of this
24	24	state with power to make arrests and serve arrest and search
25	25	warrants while performing their official duties to the same
26	26	extent as deputy sheriffs are authorized in their counties as
27	27	long as they hold current certification from the Alabama Peace
28	28	Officers' Standards and Training Commission. The powers of
29	29	arrest under this section shall be limited to investigations
30	30	and arrests of criminal acts committed at the authority's
31	31	program facilities and acts committed by persons under the
32	32	authority's supervision that are a violation of supervision or
33	33	are a criminal offense.
34	34	(b) The authority director or corrections employee with law
35	35	enforcement authority may arrest any person under his or her

65	65	supervision without a warrant if he or she has probable cause
66	66	to believe the person has committed a criminal offense or
67	67	violated the conditions of supervision. In case of a
68	68	warrantless arrest, the director or employee shall prepare a
69	69	written warrant stating that the offender, in his or her
70	70	judgment, has committed a criminal offense or violated a
71	71	condition of supervision, and the warrant shall suffice to
72	72	immediately bring the offender before the court to determine
73	73	probable cause for the act described in the warrant. The court
74	74	may order detention of the offender pending further hearing,
75	75	after which the court may revoke probation or participation in
76	76	the authority's community corrections program, or both,
77	77	pursuant to subdivision (d)(3) of Section 15-18-175, Code of
78	78	Alabama 1975.
79	79	(c) The director and employees of the authority given
80	80	powers of arrest by this section shall be required to comply
81	81	with the minimum standards for state law enforcement officers
82	82	as certified by the Alabama Peace Officers' Standards and
83	83	Training Commission.
84	84	Section 2. This act shall become effective on the first
85	85	day of the third month following its passage and approval by
86	86	the Governor, or its otherwise becoming law.
