1414 TO BE ENTITLED
1515 AN ACT
1616 Relating to Etowah County; to provide that the
1717 director and employees of The Etowah County Punishment and
1818 Corrections Authority have arrest powers and may make arrests
1919 in certain circumstances.
2020 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2121 Section 1. (a) The Director of The Etowah County
2222 Punishment and Corrections Authority and employees of the
2323 authority shall be considered law enforcement officers of this
2424 state with power to make arrests and serve arrest and search
2525 warrants while performing their official duties to the same
2626 extent as deputy sheriffs are authorized in their counties as
2727 long as they hold current certification from the Alabama Peace
2828 Officers' Standards and Training Commission. The powers of
2929 arrest under this section shall be limited to investigations
3030 and arrests of criminal acts committed at the authority's
3131 program facilities and acts committed by persons under the
3232 authority's supervision that are a violation of supervision or
3333 are a criminal offense.
3434 (b) The authority director or corrections employee with law
3535 enforcement authority may arrest any person under his or her

6565 supervision without a warrant if he or she has probable cause
6666 to believe the person has committed a criminal offense or
6767 violated the conditions of supervision. In case of a
6868 warrantless arrest, the director or employee shall prepare a
6969 written warrant stating that the offender, in his or her
7070 judgment, has committed a criminal offense or violated a
7171 condition of supervision, and the warrant shall suffice to
7272 immediately bring the offender before the court to determine
7373 probable cause for the act described in the warrant. The court
7474 may order detention of the offender pending further hearing,
7575 after which the court may revoke probation or participation in
7676 the authority's community corrections program, or both,
7777 pursuant to subdivision (d)(3) of Section 15-18-175, Code of
7878 Alabama 1975.
7979 (c) The director and employees of the authority given
8080 powers of arrest by this section shall be required to comply
8181 with the minimum standards for state law enforcement officers
8282 as certified by the Alabama Peace Officers' Standards and
8383 Training Commission.
8484 Section 2. This act shall become effective on the first
8585 day of the third month following its passage and approval by
8686 the Governor, or its otherwise becoming law.
