17-Relating to Dale County; to propose an amendment to
18-the Constitution of Alabama of 2022, authorizing a
19-municipality in the county to permit the limited operation of
20-golf carts on a municipal street or public road; to provide
21-limitations; to require the driver to have a driver license;
22-to require the operator of a golf cart on a municipal street
23-or public roadway to be covered by liability insurance; and to
24-authorize the municipality to assess a civil penalty for
25-violations.
16+SYNOPSIS:
17+This bill would propose an amendment to the
18+Constitution of Alabama of 2022, relating to Dale
19+County, to authorize municipalities in the county to
20+permit the limited operation of golf carts on municipal
21+streets or public roads subject to restrictions and
22+civil penalties for violations.

25+AN ACT
26+Relating to Dale County; to propose an amendment to the
27+Constitution of Alabama of 2022, authorizing a municipality in
28+the county to permit the limited operation of golf carts on a
29+municipal street or public road; to provide limitations; to
30+require the driver to have a driver license; to require the
31+operator of a golf cart on a municipal street or public
32+roadway to be covered by liability insurance; and to authorize
33+the municipality to assess a civil penalty for violations.
2634 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2735 Section 1. The following amendment to the Constitution
2836 of Alabama of 2022, is proposed and shall become valid as a
2937 part of the constitution when all requirements of this act and
30-applicable constitutional provisions are fulfilled:
31- PROPOSED AMENDMENT
32-(a) A municipality in Dale County may designate
33-municipal streets or public roads within the municipality for
34-use by golf carts. Before making that designation, the
35-municipality shall first determine that golf carts may safely
36-travel on or across the street or road. The municipality
37-making the safety determination shall consider factors
38-including, but not limited to, the speed, volume, and
39-character of motor vehicle traffic using the road or street.
40-Upon a determination that golf carts may be safely operated on
41-the designated street or road, the municipality shall post
42-appropriate signs to indicate that the operation of golf carts
43-is authorized.

70+(a) A municipality in Dale County may designate
71+municipal streets or public roads within the municipality for
72+use by golf carts. Before making that designation, the
73+municipality shall first determine that golf carts may safely
74+travel on or across the street or road. The municipality
75+making the safety determination shall consider factors
76+including, but not limited to, the speed, volume, and
77+character of motor vehicle traffic using the road or street.
78+Upon a determination that golf carts may be safely operated on
79+the designated street or road, the municipality shall post
80+appropriate signs to indicate that the operation of golf carts

7482 (b) A municipality that authorizes the use of golf
7583 carts pursuant to subsection (a) shall inspect any golf cart
7684 that an owner wishes to use pursuant to subsection (a) to
7785 determine if the safety equipment required by subsection (e)
7886 is present on the golf cart and shall verify that the operator
7987 of the golf cart on a municipal street or public road is
8088 covered by a policy of liability insurance held by the owner
8189 of the golf cart. The liability limits for operation of the
8290 golf cart shall be the same as for operation of a motor
8391 vehicle. If the proper safety equipment is present and the
8492 golf cart is covered by liability insurance, the municipality
8593 shall issue a permit to the owner upon payment of a permit
8694 fee. The municipality may designate the appropriate department
8795 of the municipality to inspect and permit golf carts and may
88-adopt rules for permitting golf carts, including providing for
89-a permit fee.
90-(c) A municipality may not allow a golf cart to operate
91-on a municipal street or public road where the posted speed
92-limit exceeds 25 miles per hour.
93-(d) A municipality may limit the operation of a golf
94-cart pursuant to this section to only between the hours of
95-sunrise and sunset.
96-(e) The golf cart shall be equipped with headlights,
97-brake lights, turn signals, and a windshield.
98-(f) No person may operate a golf cart on a public
99-street or road without a driver license.
100-(g) A municipality may enact an ordinance regarding
101-golf cart operation and equipment that is more restrictive

138+(g) A municipality may enact an ordinance regarding
131139 golf cart operation and equipment that is more restrictive
132140 than the restrictions enumerated in this section. Upon
133141 enactment, the municipality shall post appropriate signs or
134142 otherwise inform residents that the ordinance exists and will
135143 be enforced within the jurisdictional limits of the
136144 municipality.
137145 (h) All golf carts shall be entitled to full use of a
138146 lane, and no motor vehicle shall be driven in such a manner as
139147 to deprive any golf cart of the full use of a lane.
140148 (i) The operator of a golf cart may not overtake and
141149 pass in the same lane occupied by the vehicle being overtaken.
142150 (j) A golf cart may not be operated between lanes of
143151 traffic or between adjacent lines or rows of vehicles.
144152 (k) Golf carts may not be operated two or more abreast
145153 in a single lane.
146-(l) The unauthorized operation of a golf cart on a
147-municipal street or public road is a violation for which the
148-municipality may collect a civil penalty of up to fifty
149-dollars ($50).
150-(m) Notwithstanding any other provision of this
151-amendment, a municipality may enact an ordinance regarding
152-golf cart operation and equipment that is less restrictive
153-than the restrictions enumerated in this amendment authorizing
154-the use of golf carts for periods not to exceed 80 hours by
155-the municipality or a civic organization in conjunction with
156-civic events or events to raise funds, promote economic
157-development, or similar purposes as authorized in the

188197 Upon ratification of this constitutional amendment, the
189198 Code Commissioner shall number and place this amendment as
190199 appropriate in the constitution omitting this instructional
191200 paragraph and may make the following nonsubstantive revisions:
192201 change capitalization, hierachy, spelling, and punctuation for
193202 purposes of style and uniformity; correct manifest
194203 grammatical, clerical, and typographical errors; revise
195204 internal and external citations and cross-references; and
196205 translate effective date.
197206 Section 2. An election upon the proposed amendment
198207 shall be held in accordance with Sections 284, 284.01, and 285
199208 of the Constitution of Alabama of 2022, and the election laws
200209 of this state.
201210 Section 3. The appropriate election official shall
202211 assign a ballot number for the proposed constitutional
203-amendment on the election ballot and shall set forth the
204-following description of the substance or subject matter of
205-the proposed constitutional amendment:
