15+SYNOPSIS:
16+Under existing law, there is an intrastate hours
17+of service limitation applied to drivers of commercial
18+motor vehicles operating in intrastate transportation,
19+within a 75 air-mile radius of their normal work
20+reporting location, following 10 consecutive hours off
21+duty, except when prohibited by federal rule or law.
22+This bill would increase the air-mile radius for
23+intrastate motor carriers from 75 to 150 to reflect the
24+current federal allowance.

27+AN ACT
1628 Relating to commercial motor vehicle drivers; to amend
1729 Section 32-9A-6 of the Code of Alabama 1975, to increase the
1830 intrastate air-mile radius for which the intrastate hours of
1931 service limitation applies.
2032 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2133 Section 1. Section 32-9A-6 of the Code of Alabama 1975,
2234 is amended to read as follows:
2335 "§32-9A-6
2436 (a) The intrastate hours of service limitations
25-limitation applied to the drivers of commercial motor vehicles
26-operating in intrastate transportation within a 75150 air-mile
27-radius of their normal work reporting location, following 10
28-consecutive hours off duty except when prohibited by federal
29-rule or law, shall be the following:
30-(1) A 12-hour driving limit, provided driving shall be
31-prohibited for any driver of a commercial motor vehicle
32-afterwho has been on duty for having been on duty for more
33-than 15 hours is prohibited.
34-(2) Driving shall be prohibited for any driver who has
35-been on duty 70 hours in seven consecutive days.
36-(b) An intrastate driver is defined by his or her
37-previous seven days in operation.
38-(c) All motor carriers operating under the variance
39-provided by this section shall have a satisfactory safety
40-rating with the Federal Motor Carrier Safety Administration
41-(FMCSA) or be unrated. Subsection (a) shall not apply to a
42-motor carrier with a conditional or unsatisfactory FMCSA

66+(a) The intrastate hours of service limitations

7789 395.8. The driver shall retain a copy of each record of duty
7890 status for the previous seven consecutive days, which shall be
7991 in his or her possession and available for inspection while on
8092 duty."
8193 Section 2. This act shall become effective on October
8294 1, 2024.
