1515 SYNOPSIS:
1616 Under existing law, the salary of the Secretary
1717 of Commerce and the salaries of the deputy secretaries
1818 of the Department of Commerce may not exceed a specific
1919 dollar amount above the highest paid non-merit position
2020 in the department.
2121 This bill would provide that the salary of the
2222 Secretary of Commerce would be set by the Governor in
2323 the same manner as other department heads are set.
2424 This bill would provide that the salary of the
2525 deputy secretaries would be set by the secretary and
2626 approved by the Governor.
2727 This bill would also make nonsubstantive,
2828 technical revisions to update the existing code
2929 language to current style.

6868 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
6969 Section 1. Section 41-29-1, Code of Alabama 1975, is
7070 amended to read as follows:
7171 "ยง41-29-1
7272 (a)(1) There is hereby created the Department of
7373 Commerce within the office of the Governor and directly under
7474 his or her supervision and control. The Department of Commerce
7575 shall be headed by the Secretary of Commerce, who shall be a
7676 person possessed with extensive responsible an individual with
7777 extensive experience in development of economic, human, and
7878 physical resources and promotion of industrial and commercial
7979 development. The secretary shall be appointed by the Governor
8080 and serve at his or her pleasure at a salary of any reasonable
8181 amount not to exceed by forty thousand dollars ($40,000) the
8282 highest authorized salary for employees of the Department of
8383 Commerce who are subject to the Merit System law set in the
8484 same manner as other appointed department heads under Section
8585 36-6-6. In fixing such the secretary's salary, the Governor
8686 shall give due consideration of the salaries of comparable
8787 positions in other states and in private industry. All other
8888 employees necessary to carry out the duties and functions of
8989 the Department of Commerce shall be employed subject to the
9090 state Merit System law. In addition to any other employees,
9191 there may be employed a total of eight assistant secretaries
9292 for the office, who shall not be subject to the state Merit
9393 System law and whose compensation shall be determined by the
9494 secretary.

125125 (2) The eight additional assistant secretaries shall be
126126 persons individuals experienced in industrial and commercial
127127 development for at least the two years prior to their
128128 employment. Compensation for the eight additional assistant
129129 secretaries shall not exceed the amount of compensation paid
130130 for the highest classification of state Merit System employees
131131 employed by the Department of Commerce.
132132 (3) The makeup of the assistant secretaries shall be
133133 inclusive and should reflect the racial, gender, geographic,
134134 urban,/rural, and economic diversity of the state.
135135 (b) On the date determined pursuant to Section 41-29-6,
136136 the Department of Commerce shall be comprised of the following
137137 divisions: The Business Development Division and the Workforce
138138 Development Division. Each division shall be headed by a
139139 deputy secretary who shall be appointed by the Secretary of
140140 Commerce outside of the classified service and who shall serve
141141 at the pleasure of the secretary at a salary of any reasonable
142142 amount not to exceed by ten thousand dollars ($10,000) the
143143 highest authorized salary for employees of the Department of
144144 Commerce who are subject to the Merit System law set by the
145145 secretary and approved by the Governor . The deputy secretary
146146 of each division shall report to the Secretary of
147147 Commercesecretary.
148148 (c)(1) The Governor, through the Department of
149149 Commerce, shall encourage comprehensive and coordinated
150150 planning and programming of the affairs of state government.
151151 (2) All economic development functions as defined in
152152 subdivision (12) of Section 36-25-1 or otherwise engaged in by

182182 subdivision (12) of Section 36-25-1 or otherwise engaged in by
183183 any employee, department, agency, or body corporate in the
184184 executive branch of the state shall be pre-approved by the
185185 Secretary of Commerce or the Governor.
186186 (d) The Governor may direct any state department or
187187 other agency of state government directly under his or her
188188 control and supervision to furnish the Department of Commerce
189189 with such personnel, equipment, and services as are necessary
190190 to enable it the Department of Commerce to carry out its
191191 responsibilities and duties and may prescribe the terms
192192 thereof, including reimbursement of costs thereof.
193193 (e)(1) The Legislature finds and declares that the
194194 Alabama Community College System consists of comprehensive
195195 community and technical colleges and the Alabama Technology
196196 Network, an effective workforce development initiative. The
197197 Alabama Community College System provides a unified system of
198198 institutions delivering excellence in academic education,
199199 adult education, and workforce development initiatives that
200200 are responsive to industry needs for highly specialized
201201 training programs that help prepare entry level employees to
202202 meet growing demands.
203203 (2) Notwithstanding any other provision of this
204204 chapter, the Alabama Community College System shall continue
205205 to provide a wide range of career-technical courses and
206206 short-term training for job-specific certifications."
207207 Section 2. This act shall become effective on June 1,
208208 2024.
