1515 SYNOPSIS:
1616 Under existing law, certain pension, annuity, or
1717 retirement allowance benefits under the Teachers'
1818 Retirement System and the Employees' Retirement System
1919 are subject to state or municipal tax, levy, sale,
2020 garnishment, attachment, or any other related process
2121 under certain circumstances.
2222 This bill would revise the circumstances in
2323 which an individual's pension, annuity, or retirement
2424 allowance benefits under the Teachers' Retirement
2525 System and the Employees' Retirement System are subject
2626 to certain recovery actions.

2929 AN ACT
3030 Relating to retirement benefits; to amend Sections
3131 16-25-23 and 36-27-28, Code of Alabama 1975, to revise the
3232 circumstances in which an individual's pension, annuity, or
3333 retirement allowance benefits under the Teachers' Retirement
3434 System and the Employees' Retirement System are subject to
3535 certain recovery actions.

6666 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
6767 Section 1. Sections 16-25-23 and 36-27-28, Code of
6868 Alabama 1975, are amended to read as follows:
6969 "§16-25-23
7070 (a) Except as provided in subsection (b), the right of
7171 a personan individual to a pension; an annuity, or a
7272 retirement allowance; to the return of contributions; the
7373 pension, annuity , or retirement allowance itself; any optional
7474 benefit or any other right accrued or accruing to any
7575 personindividual under the provisions of this chapter; and the
7676 monies in the various funds created by this chapter are hereby
7777 exempt from any state or municipal tax and exempt from levy
7878 and sale, garnishment, attachment , or any other process
7979 whatsoever, and shall be unassignable except as in this
8080 chapter specifically otherwise provided in this chapter .
8181 (b)(1) Restitution, fines, court costs, fees, or any
8282 other financial obligations in a criminal case ordered by a
8383 circuit or district court judge in this state are not subject
8484 to the exemption set out in subsection (a), provided allboth
8585 of the following are satisfied:
8686 a. The amount of the restitution ordered is in the
8787 amount of one thousand dollars ($1,000) or greater.
8888 b. The personindividual subject to the order is a
8989 retiree or beneficiary who is currently receiving benefits
9090 from the Teachers' Retirement System.
9191 c. The case has been assigned to the district
9292 attorney's restitution recovery division.
9393 (2) If the requirements of subdivision (1) are met, and
9494 upon a motion filed by the district attorney, the circuit or

124124 upon a motion filed by the district attorney, the circuit or
125125 district court judge may order that the Teachers' Retirement
126126 System pay to the circuit clerk of the court no more than 25
127127 percent of the retiree's or beneficiary's gross monthly
128128 benefit less any deductions for child support or health
129129 insurance for any dependents, to be applied to the balance of
130130 the restitution, fines, court costs, fees, or other financial
131131 obligations ordered in the criminal case.
132132 (3) An order under subdivision (2) shall set out all of
133133 the following:
134134 a. The individual's name, date of birth, and Social
135135 Security number.
136136 b. The amount of restitution ordered is in the amount
137137 of one thousand dollars ($1,000) or greater.
138138 c. The amounts of restitution, fines, court costs,
139139 fees, or any other financial obligations owed, detailed
140140 individually.
141141 d. The relevant case numbers.
142142 e. The county in which the case was brought.
143143 f. The circuit clerk's name and mailing address.
144144 g. That the restitution, fines, court costs, fees, or
145145 other financial obligations are payable as a result of a
146146 criminal disposition.
147147 h. The amount or the percentage of funds to be paid.
148148 (4) The district attorney shall notify the court
149149 whenever the restitution, fines, court costs, fees, or other
150150 financial obligations are paid in full. Thereafter, the court
151151 shall issue an order to stop the diversion of the individual's
152152 funds. Any payment received by the circuit clerk in an amount

183183 over what was owed shall be paid back to the Teachers'
184184 Retirement System within 60 days with the specific identifying
185185 information as to the retiree or the beneficiary to whom it is
186186 owed."

188188 (a) Except as provided in subsection (b), the right of
