1515 SYNOPSIS:
1616 Under existing law, animals that are killed or
1717 otherwise die must be burned or buried within 24 hours
1818 of death.
1919 This bill would further provide the methods by
2020 which these animals may be disposed.

2424 Relating to animals; to amend Section 3-1-28, Code of
2525 Alabama 1975, to further provide the methods by which dead
2626 animals may be disposed.
2727 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2828 Section 1. Section 3-1-28, Code of Alabama 1975, is
2929 amended to read as follows:
3030 "ยง3-1-28
3131 All owners or custodians of animals which that die or
3232 are killed in their his or her possession or custody, other
3333 than such as are those slaughtered for food, within 24 hours
3434 shall cause the bodies of such animals to be burned or burn,
3535 buried bury at least two feet below the surface of the ground ,
3636 or otherwise dispose of the animals' bodies in accordance with

6666 or otherwise dispose of the animals' bodies in accordance with
6767 Alabama Department of Agriculture and Industries rules . Hogs
6868 dying from cholera or any other disease whatsoever shall be
6969 burned. No such animal shall be burned or, buried, or disposed
7070 of sufficiently near a residence or residences as to create a
7171 nuisance. Any person individual violating this section,
7272 whether by failure to burn or, bury, or dispose of an animal,
7373 dying or being killed in his possession or by causing the same
7474 animal to be burned in such proximity to a dwelling residence
7575 or in such other way as to become a nuisance , shall be guilty
7676 of a misdemeanor and, on conviction, shall be fined not more
7777 than fifty dollars ($50).00."
7878 Section 2. This act shall become effective on October
7979 1, 2024.
