15	15	SYNOPSIS:
16	16	Under existing law, animals that are killed or
17	17	otherwise die must be burned or buried within 24 hours
18	18	of death.
19	19	This bill would further provide the methods by
20	20	which these animals may be disposed.
21	21	A BILL
22	22	TO BE ENTITLED
23	23	AN ACT
24	24	Relating to animals; to amend Section 3-1-28, Code of
25	25	Alabama 1975, to further provide the methods by which dead
26	26	animals may be disposed.
27	27	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
28	28	Section 1. Section 3-1-28, Code of Alabama 1975, is
29	29	amended to read as follows:
30	30	"§3-1-28
31	31	All owners or custodians of animals which that die or
32	32	are killed in their his or her possession or custody, other
33	33	than such as are those slaughtered for food, within 24 hours
34	34	shall cause the bodies of such animals to be burned or burn,
35	35	buried bury at least two feet below the surface of the ground ,
36	36	or otherwise dispose of the animals' bodies in accordance with

66	66	or otherwise dispose of the animals' bodies in accordance with
67	67	Alabama Department of Agriculture and Industries rules . Hogs
68	68	dying from cholera or any other disease whatsoever shall be
69	69	burned. No such animal shall be burned or, buried, or disposed
70	70	of sufficiently near a residence or residences as to create a
71	71	nuisance. Any person individual violating this section,
72	72	whether by failure to burn or, bury, or dispose of an animal,
73	73	dying or being killed in his possession or by causing the same
74	74	animal to be burned in such proximity to a dwelling residence
75	75	or in such other way as to become a nuisance , shall be guilty
76	76	of a misdemeanor and, on conviction, shall be fined not more
77	77	than fifty dollars ($50).00."
78	78	Section 2. This act shall become effective on October
79	79	1, 2024.
