1515 SYNOPSIS:
1616 This bill would allow the Board of Dental
1717 Examiners to enter into the Dentist and Dental
1818 Hygienist Compact by adopting Article 5 of Chapter 9 of
1919 Title 34, Code of Alabama 1975, as a means of providing
2020 uniformity in licensing requirements and interstate
2121 practice throughout party states.

2525 Relating to the Board of Dental Examiners; to add
2626 Article 5 to Chapter 9 of Title 34, Code of Alabama 1975, to
2727 adopt the Dentist and Dental Hygienist Compact.
2828 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2929 Section 1. Article 5 is added to Chapter 9 of Title 34,
3030 Code of Alabama 1975, to read as follows:
3131 ARTICLE 5. DENTIST AND DENTAL HYGIENIST COMPACT.
3232 §34-9-100. Title and Purpose.
3333 This article shall be known and cited as the Dentist
3434 and Dental Hygienist Compact. The purposes of this compact are
3535 to facilitate the interstate practice of dentistry and dental
3636 hygiene and improve public access to dentistry and dental

6666 hygiene and improve public access to dentistry and dental
6767 hygiene services by providing dentists and dental hygienists
6868 licensed in a participating state the ability to practice in
6969 participating states in which they are not licensed. The
7070 compact does this by establishing a pathway for dentists and
7171 dental hygienists licensed in a participating state to obtain
7272 a compact privilege that authorizes them to practice in
7373 another participating state in which they are not licensed.
7474 The compact enables participating states to protect the public
7575 health and safety with respect to the practice of dentists and
7676 dental hygienists, through the state's authority to regulate
7777 the practice of dentistry and dental hygiene in the state. The
7878 compact does all of the following:
7979 (1) Enables dentists and dental hygienists who qualify
8080 for a compact privilege to practice in other participating
8181 states without satisfying burdensome and duplicative
8282 requirements associated with securing a license to practice in
8383 those states.
8484 (2) Promotes mobility and addresses workforce shortages
8585 through each participating state's acceptance of a compact
8686 privilege to practice in that state.
8787 (3) Increases public access to qualified, licensed
8888 dentists and dental hygienists by creating a responsible,
8989 streamlined pathway for licensees to practice in participating
9090 states.
9191 (4) Enhances the ability of participating states to
9292 protect the public's health and safety.
9393 (5) Does not interfere with licensure requirements
9494 established by a participating state.

125125 (6) Facilitates the sharing of licensure and
126126 disciplinary information among participating states.
127127 (7) Requires dentists and dental hygienists who
128128 practice in a participating state pursuant to a compact
129129 privilege to practice within the scope of practice authorized
130130 in that state.
131131 (8) Extends the authority of a participating state to
132132 regulate the practice of dentistry and dental hygiene within
133133 its borders to dentists and dental hygienists who practice in
134134 the state through a compact privilege.
135135 (9) Promotes the cooperation of participating states in
136136 regulating the practice of dentistry and dental hygiene within
137137 those states.
138138 (10) Facilitates the relocation of military members and
139139 their spouses who are licensed to practice dentistry or dental
140140 hygiene.
141141 §34-9-101. Definitions.
142142 As used in this compact, the following terms have the
143143 following meanings:
144144 (1) ACTIVE MILITARY MEMBER. Any individual with
145145 full-time duty status in the Armed Forces of the United
146146 States, including members of the National Guard and Reserve.
147147 (2) ADVERSE ACTION. Disciplinary action or encumbrance
148148 imposed on a license or compact privilege by a state licensing
149149 authority.
150150 (3) ALTERNATIVE PROGRAM. A non-disciplinary monitoring
151151 or practice remediation process applicable to a dentist or
152152 dental hygienist approved by a state licensing authority of a

182182 dental hygienist approved by a state licensing authority of a
183183 participating state in which the dentist or dental hygienist
184184 is licensed. This includes, but is not limited to, programs to
185185 which licensees with substance abuse or addiction issues are
186186 referred in lieu of state action.
187187 (4) CLINICAL ASSESSMENT. Examination or process
188188 required for licensure as a dentist or dental hygienist, as
189189 applicable, that provides evidence of clinical competence in
190190 dentistry or dental hygiene.
191191 (5) COMMISSIONER. The individual appointed by a
192192 participating state to serve as the member of the commission
193193 for that participating state.
194194 (6) COMPACT. The dentist and dental hygienist compact.
195195 (7) COMPACT PRIVILEGE. The authorization granted by a
196196 remote state to allow a licensee from a participating state to
197197 practice as a dentist or dental hygienist in a remote state.
198198 (8) CONTINUING PROFESSIONAL DEVELOPMENT. A requirement,
199199 as a condition of license renewal, to provide evidence of
200200 successful participation in educational or professional
201201 activities relevant to practice or area of work.
202202 (9) CRIMINAL BACKGROUND CHECK. The submission of
203203 fingerprints or other biometric-based information for a
204204 license applicant for the purpose of obtaining that
205205 applicant's criminal history record information, as defined in
206206 28 C.F.R. § 20.3(d) from the Federal Bureau of Investigation
207207 and the state's criminal history record repository as defined
208208 in 28 C.F.R. § 20.3(f).
209209 (10) DATA SYSTEM. The commission's repository of
210210 information about licensees, including, but not limited to,

241241 examination, licensure, investigative, compact privilege,
242242 state action, and alternative program.
243243 (11) DENTAL HYGIENIST. An individual who is licensed by
244244 a state licensing authority to practice dental hygiene.
245245 (12) DENTIST. An individual who is licensed by a state
246246 licensing authority to practice dentistry.
247247 (13) DENTIST AND DENTAL HYGIENIST COMPACT COMMISSION. A
248248 joint government agency established by this compact comprised
249249 of each state that has enacted the compact and a national
250250 administrative body comprised of a commissioner from each
251251 state that has enacted the compact.
252252 (14) ENCUMBERED LICENSE. A license that a state
253253 licensing authority has limited in any way other than through
254254 an alternative program.
255255 (15) EXECUTIVE BOARD. The chair, vice chair, secretary,
256256 and treasurer, and any other commissioners as may be
257257 determined by commission rule or bylaw.
258258 (16) JURISPRUDENCE REQUIREMENT. The assessment of an
259259 individual's knowledge of the laws and rules governing the
260260 practice of dentistry or dental hygiene, as applicable, in a
261261 state.
262262 (17) LICENSE. Current authorization by a state, other
263263 than authorization pursuant to a compact privilege, or other
264264 privilege, for an individual to practice as a dentist or
265265 dental hygienist in that state.
266266 (18) LICENSEE. An individual who holds an unrestricted
267267 license from a participating state to practice as a dentist or
268268 dental hygienist in that state.

299299 (19) MODEL COMPACT. The model for the Dentist and
300300 Dental Hygienist Compact on file with the Council of State
301301 Governments or other entity as designated by the commission.
302302 (20) PARTICIPATING STATE. A state that has enacted the
303303 compact and been admitted to the commission in accordance with
304304 the provisions in this compact and commission rules.
305305 (21) QUALIFYING LICENSE. A license that is not an
306306 encumbered license issued by a participating state to practice
307307 dentistry or dental hygiene.
308308 (22) REMOTE STATE. A participating state where a
309309 licensee who is not licensed as a dentist or dental hygienist
310310 is exercising or seeking to exercise the compact privilege.
311311 (23) RULE. A regulation adopted by an entity that has
312312 the force of law.
313313 (24) SCOPE OF PRACTICE. The procedures, actions, and
314314 processes a dentist or dental hygienist licensed in a state is
315315 permitted to undertake in that state and the circumstances
316316 under which the licensee is permitted to undertake those
317317 procedures, actions, and processes. The procedures, actions,
318318 and processes and the circumstances under which they may be
319319 undertaken may be established through means, including, but
320320 not limited to, statute, rules, case law, and other processes
321321 available to the state licensing authority or other government
322322 agency.
323323 (25) SIGNIFICANT INVESTIGATIVE INFORMATION.
324324 Information, records, and documents received or generated by a
325325 state licensing authority pursuant to an investigation for
326326 which a determination has been made that there is probable

356356 which a determination has been made that there is probable
357357 cause to believe that the licensee has violated a statute or
358358 rule that is considered more than a minor infraction for which
359359 the state licensing authority could pursue state action
360360 against the licensee.
361361 (26) STATE. Any state, commonwealth, district, or
362362 territory of the United States of America that regulates the
363363 practices of dentistry and dental hygiene.
364364 (27) STATE LICENSING AUTHORITY. An agency or other
365365 entity of a state that is responsible for the licensing and
366366 regulation of dentists or dental hygienists.
367367 §34-9-102. State Participation in the Compact.
368368 (a) In order to join the compact and thereafter
369369 continue as a participating state, a state must do all of the
370370 following:
371371 (1) Enact a compact that is not materially different
372372 from the model compact as determined in accordance with
373373 commission rules.
374374 (2) Participate fully in the commission's data system.
375375 (3) Have a mechanism in place for receiving and
376376 investigating complaints about its licensees and license
377377 applicants.
378378 (4) Notify the commission, in compliance with the terms
379379 of the compact and commission rules, of any state action or
380380 the availability of significant investigative information
381381 regarding a licensee and license applicant.
382382 (5) Fully implement a criminal background check
383383 requirement, within a time frame established by commission
384384 rule, by receiving the results of a qualifying criminal

414414 rule, by receiving the results of a qualifying criminal
415415 background check.
416416 (6) Comply with the commission rules applicable to a
417417 participating state.
418418 (7) Accept the National Board Examinations of the Joint
419419 Commission on National Dental Examinations or another
420420 examination accepted by commission rule as a licensure
421421 examination.
422422 (8) Accept for licensure that applicants for a dentist
423423 license graduate from a predoctoral dental education program
424424 accredited by the Commission on Dental Accreditation, or
425425 another accrediting agency recognized by the United states
426426 Department of Education for the accreditation of dentistry and
427427 dental hygiene education programs, leading to the Doctor of
428428 Dental Surgery (D.D.S.) or Doctor of Dental Medicine (D.M.D.)
429429 degree.
430430 (9) Accept for licensure that applicants for a dental
431431 hygienist license graduate from a dental hygiene education
432432 program accredited by the Commission on Dental Accreditation
433433 or another accrediting agency recognized by the United states
434434 Department of Education for the accreditation of dentistry and
435435 dental hygiene education programs.
436436 (10) Require for licensure that applicants successfully
437437 complete a clinical assessment.
438438 (11) Have continuing professional development
439439 requirements as a condition for license renewal.
440440 (12) Pay a participation fee to the commission as
441441 established by commission rule.
442442 (b) A state is not disqualified from participating in

472472 (b) A state is not disqualified from participating in
473473 the compact by providing alternative pathways for an
474474 individual to obtain an unrestricted license.
475475 (c) When conducting a criminal background check the
476476 state licensing authority shall do all of the following:
477477 (1) Consider the information disclosed in the criminal
478478 background check in making a licensure decision.
479479 (2) Maintain documentation of completion of the
480480 criminal background check and background check information to
481481 the extent allowed by state and federal law.
482482 (3) Report to the commission whether it has completed
483483 the criminal background check and whether the individual was
484484 granted or denied a license.
485485 (d) A licensee of a participating state, who has a
486486 qualifying license in that state and does not hold an
487487 encumbered license in any other participating state, shall be
488488 issued a compact privilege in a remote state in accordance
489489 with the terms of the compact and commission rules. If a
490490 remote state has a jurisprudence requirement, a compact
491491 privilege will not be issued to the licensee unless the
492492 licensee has satisfied the jurisprudence requirement.
493493 §34-9-103. Compact Privilege.
494494 (a) To obtain and exercise the compact privilege under
495495 the terms and provisions of the compact, the licensee must do
496496 all of the following:
497497 (1) Possess a qualifying license as a dentist or dental
498498 hygienist in a participating state.
499499 (2) Be eligible for a compact privilege in any remote
500500 state in accordance with subsections (d), (g), and (h).

530530 state in accordance with subsections (d), (g), and (h).
531531 (3) Submit to an application process whenever the
532532 licensee is seeking a compact privilege.
533533 (4) Pay any applicable commission and remote state fees
534534 for a compact privilege in the remote state.
535535 (5) Meet any jurisprudence requirement established by a
536536 remote state in which the licensee is seeking a compact
537537 privilege.
538538 (6) Pass a National Board Examination of the Joint
539539 Commission on National Dental Examinations or another
540540 examination accepted by commission rule.
541541 (7) For a dentist, be a graduate from a predoctoral
542542 dental education program accredited by the Commission on
543543 Dental Accreditation, or another accrediting agency recognized
544544 by the United States Department of Education for the
545545 accreditation of dentistry and dental hygiene education
546546 programs, leading to the Doctor of Dental Surgery (D.D.S.) or
547547 Doctor of Dental Medicine (D.M.D.) degree.
548548 (8) For a dental hygienist, be a graduate from a dental
549549 hygiene education program accredited by the Commission on
550550 Dental Accreditation or another accrediting agency recognized
551551 by the United States Department of Education for the
552552 accreditation of dentistry and dental hygiene education
553553 programs.
554554 (9) Successfully complete a clinical assessment for
555555 licensure.
556556 (10) Report to the commission state action taken by any
557557 non-participating state when applying for a compact privilege
558558 and, otherwise, within 30 days from the date the state action

588588 and, otherwise, within 30 days from the date the state action
589589 is taken.
590590 (11) Report to the commission when applying for a
591591 compact privilege the address of the licensee's primary
592592 residence and thereafter immediately report to the commission
593593 any change in the address of the licensee's primary residence.
594594 (12) Consent to accept service of process by mail at
595595 the licensee's primary residence on record with the commission
596596 with respect to any action brought against the licensee by the
597597 commission or a participating state, and consent to accept
598598 service of a subpoena by mail at the licensee's primary
599599 residence on record with the commission with respect to any
600600 action brought or investigation conducted by the commission or
601601 a participating state.
602602 (b) The licensee must comply with the requirements of
603603 subsection (a) to maintain the compact privilege in the remote
604604 state. If those requirements are met, the compact privilege
605605 will continue as long as the licensee maintains a qualifying
606606 license in the state through which the licensee applied for
607607 the compact privilege and pays any applicable compact
608608 privilege renewal fees.
609609 (c) A licensee providing dentistry or dental hygiene in
610610 a remote state under the compact privilege shall function
611611 within the scope of practice authorized by the remote state
612612 for a dentist or dental hygienist licensed in that state.
613613 (d) A licensee providing dentistry or dental hygiene
614614 pursuant to a compact privilege in a remote state is subject
615615 to that state's regulatory authority. A remote state, in
616616 accordance with due process and that state's laws, may by

646646 accordance with due process and that state's laws, may by
647647 state action revoke or remove a licensee's compact privilege
648648 in the remote state for a specific period of time and impose
649649 fines or take any other necessary actions to protect the
650650 health and safety of its citizens. If a remote state imposes a
651651 state action against a compact privilege that limits the
652652 compact privilege, that state action applies to all compact
653653 privileges in all remote states. A licensee whose compact
654654 privilege in a remote state is removed for a specified period
655655 of time is not eligible for a compact privilege in any other
656656 remote state until the specific time for removal of the
657657 compact privilege has passed and all encumbrance requirements
658658 are satisfied.
659659 (e) If a license in a participating state is an
660660 encumbered license, the licensee shall lose the compact
661661 privilege in a remote state and shall not be eligible for a
662662 compact privilege in any remote state until the license is no
663663 longer encumbered.
664664 (f) Once an encumbered license in a participating state
665665 is restored to good standing, the licensee must meet the
666666 requirements of subsection (a) to obtain a compact privilege
667667 in a remote state.
668668 (g) If a licensee's compact privilege in a remote state
669669 is removed by the remote state, the individual shall lose or
670670 be ineligible for the compact privilege in any remote state
671671 until both of the following occur:
672672 (1) The specific period of time for which the compact
673673 privilege was removed has ended.
674674 (2) All conditions for removal of the compact privilege

704704 (2) All conditions for removal of the compact privilege
705705 have been satisfied.
706706 (h) Once the requirements of subsection (g) have been
707707 met, the licensee must meet the requirements in subsection (a)
708708 to obtain a compact privilege in a remote state.
709709 §34-9-104. Active Military Member or Their Spouse.
710710 An active military member or his or her spouse shall
711711 not be required to pay to the commission for a compact
712712 privilege the fee otherwise charged by the commission. If a
713713 remote state chooses to charge a fee for a compact privilege,
714714 the state may choose to charge a reduced fee or no fee to an
715715 active military member or his or her spouse for a compact
716716 privilege.
717717 §34-9-105. State Actions.
718718 (a) A participating state in which a licensee is
719719 licensed shall have exclusive authority to impose state action
720720 against the qualifying license issued by that participating
721721 state.
722722 (b) A participating state may take state action based
723723 on the significant investigative information of a remote
724724 state, so long as the participating state follows its own
725725 procedures for imposing state action.
726726 (c) Nothing in this compact shall override a
727727 participating state's decision that participation in an
728728 alternative program may be used in lieu of state action and
729729 that such participation shall remain non-public if required by
730730 the participating state's laws. Participating states must
731731 require licensees who enter any alternative program in lieu of

762762 discipline to agree not to practice pursuant to a compact
763763 privilege in any other participating state during the term of
764764 the alternative program without prior authorization from the
765765 other participating state.
766766 (d) Any participating state in which a licensee is
767767 applying to practice or is practicing pursuant to a compact
768768 privilege may investigate actual or alleged violations of the
769769 statutes and rules authorizing the practice of dentistry or
770770 dental hygiene in any other participating state in which the
771771 dentist or dental hygienist holds a license or compact
772772 privilege.
773773 (e) A remote state shall have the authority to do all
774774 of the following:
775775 (1) Take state actions as set forth in Section
776776 34-9-103(d) against a licensee's compact privilege in the
777777 state.
778778 (2) In furtherance of its rights and responsibilities
779779 under the compact and the commission's rules, the remote state
780780 may issue subpoenas for both hearings and investigations that
781781 require the attendance and testimony of witnesses, and the
782782 production of evidence. Subpoenas issued by a state licensing
783783 authority in a participating state for the attendance and
784784 testimony of witnesses, or the production of evidence from
785785 another participating state, shall be enforced in the latter
786786 state by any court of competent jurisdiction, according to the
787787 practice and procedure of that court applicable to subpoenas
788788 issued in proceedings pending before it. The issuing authority
789789 shall pay any witness fees, travel expenses, mileage, and
790790 other fees required by the service statutes of the state where

825825 state action taken against that licensee.
826826 (f) Joint investigations.
827827 (1) In addition to the authority granted to a
828828 participating state by its dentist or dental hygienist
829829 licensure act or other applicable state law, a participating
830830 state may jointly investigate licensees with other
831831 participating states.
832832 (2) Participating states shall share any significant
833833 investigative information, litigation, or compliance materials
834834 in furtherance of any joint or individual investigation
835835 initiated under the compact.
836836 (g) Authority to continue investigation.
837837 (1) After a licensee's compact privilege in a remote
838838 state is terminated, the remote state may continue an
839839 investigation of the licensee that began when the licensee had
840840 a compact privilege in that remote state.
841841 (2) If the investigation yields what would be
842842 significant investigative information had the licensee
843843 continued to have a compact privilege in that remote state,
844844 the remote state shall report the presence of such information
845845 to the data system as required by Section 34-9-107(b)(6) as if
846846 it was significant investigative information.

878878 Commission.
879879 (a) The compact participating states hereby create and
880880 establish a joint government agency whose membership consists
881881 of all participating states that have enacted the compact. The
882882 commission is an instrumentality of the participating states
883883 acting jointly and not an instrumentality of any one state.
884884 The commission shall come into existence on or after the
885885 effective date of the compact as set forth in Section
886886 34-9-110(a).
887887 (b) Participation, voting, and meetings.
888888 (1) Each participating state shall have and be limited
889889 to one commissioner selected by that participating state's
890890 state licensing authority or, if the state has more than one
891891 state licensing authority, selected collectively by the state
892892 licensing authorities.
893893 (2) The commissioner shall be a member or designee of
894894 the authority or authorities.
895895 (3) The commission may by rule or bylaw establish a
896896 term of office for commissioners and may by rule or bylaw
897897 establish term limits.
898898 (4) The commission may recommend to a state licensing
899899 authority or authorities, as applicable, removal or suspension
900900 of an individual as the state's commissioner.
901901 (5) A participating state's state licensing authority
902902 or authorities, as applicable, shall fill any vacancy of its
903903 commissioner on the commission within 60 days of the vacancy.
904904 (6) Each commissioner shall be entitled to one vote on
905905 all matters that are voted upon by the commission.
906906 (7) The commission shall meet at least once during each

936936 (7) The commission shall meet at least once during each

940940 (c) The commission shall have the power to do all of

942942 (1) Establish the fiscal year of the commission.
943943 (2) Establish a code of conduct and conflict of
944944 interest policies.
945945 (3) Adopt rules and bylaws.
946946 (4) Maintain its financial records in accordance with
947947 the bylaws.
948948 (5) Meet and take actions as are consistent with the
949949 provisions of this compact, the commission's rules, and the
950950 bylaws.
951951 (6) Initiate and conclude legal proceedings or actions
952952 in the name of the commission, provided that the standing of
953953 any state licensing authority to sue or be sued under
954954 applicable law shall not be affected.
955955 (7) Maintain and certify records and information
956956 provided to a participating state as the authenticated
957957 business records of the commission, and designate a person to
958958 do so on the commission's behalf.
959959 (8) Purchase and maintain insurance and bonds.
960960 (9) Borrow, accept, or contract for services of
961961 personnel, including, but not limited to, employees of a
962962 participating state.
963963 (10) Conduct an annual financial review.

10001000 (12) As set forth in the commission rules, charge a fee
10011001 to a licensee for the grant of a compact privilege in a remote
10021002 state and thereafter, as may be established by commission
10031003 rule, charge the licensee a compact privilege renewal fee for
10041004 each renewal period in which that licensee exercises or
10051005 intends to exercise the compact privilege in that remote
10061006 state. Nothing in this subdivision shall be construed to
10071007 prevent a remote state from charging a licensee a fee for a
10081008 compact privilege or renewals of a compact privilege, or a fee
10091009 for the jurisprudence requirement if the remote state imposes
10101010 such a requirement for the grant of a compact privilege.
10111011 (13) Accept any and all appropriate gifts, donations,
10121012 grants of money, other sources of revenue, equipment,
10131013 supplies, materials, and services, and receive, utilize, and
10141014 dispose of the same; provided that at all times the commission
10151015 shall avoid any appearance of impropriety conflict of
10161016 interest.
10171017 (14) Lease, purchase, retain, own, hold, improve, or
10181018 use any property, real, personal, or mixed, or any undivided
10191019 interest therein.
10201020 (15) Sell, convey, mortgage, pledge, lease, exchange,
10211021 abandon, or otherwise dispose of any property real, personal,

10731073 (d) Meetings of the commission.
10741074 (1) All meetings of the commission that are not closed
10751075 pursuant to this subsection shall be open to the public.
10761076 Notice of public meetings shall be posted on the commission's
10771077 website at least 30 days prior to the public meeting.
10781078 (2) Notwithstanding subsection (d)(1), the commission

11891189 (6) The commission shall keep minutes that fully and
11901190 clearly describe all matters discussed in a meeting and shall
11911191 provide a full and accurate summary of actions taken, and the
11921192 reasons supporting the actions taken, including a description
11931193 of the views expressed. All documents considered in connection
11941194 with an action shall be identified in the minutes. All minutes

12281228 (e) Financing of the commission.
12291229 (1) The commission shall pay, or provide for the
12301230 payment of, the reasonable expenses of its establishment,
12311231 organization, and ongoing activities.
12321232 (2) The commission may accept all appropriate sources
12331233 of revenue, donations, grants of money, equipment, supplies,
12341234 materials, and services.
12351235 (3) The commission may levy on and collect an annual
12361236 assessment from each participating state and impose fees on
12371237 licensees of participating states when a compact privilege is
12381238 granted, to cover the cost of the operations and activities of
12391239 the commission and its staff, which must be in a total amount
12401240 sufficient to cover its annual budget as approved each fiscal
12411241 year for which sufficient revenue is not provided by other
12421242 sources. The aggregate annual assessment amount for
12431243 participating states shall be allocated based upon a formula
12441244 that the commission shall adopt by rule.
12451245 (4) The commission shall not incur obligations of any
12461246 kind prior to securing the funds adequate to meet those
12471247 obligations; nor shall the commission pledge the credit of any
12481248 participating state, except by and with the authority of the
12491249 participating state.
12501250 (5) The commission shall keep accurate accounts of all
12511251 receipts and disbursements. The receipts and disbursements of
12521252 the commission shall be subject to the financial review and
12531253 accounting procedures established under its bylaws. All

12901290 (1) The executive board shall have the power to act on

12931293 executive board shall include all of the following:
12941294 a. Overseeing the day-to-day activities of the
12951295 administration of the compact, including compliance with the
12961296 provisions of the compact and the commission's rules and
12971297 bylaws.
12981298 b. Recommending to the commission changes to the rules
12991299 or bylaws, changes to this compact legislation, fees charged
13001300 to compact participating states, fees charged to licensees,
13011301 and other fees.
13021302 c. Ensuring compact administration services are
13031303 appropriately provided, including by contract.
13041304 d. Preparing and recommending the budget.
13051305 e. Maintaining financial records on behalf of the

13071307 f. Monitoring compact compliance of participating
13081308 states and providing compliance reports to the commission.
13091309 g. Establishing additional committees as necessary.
13101310 h. Exercising the powers and duties of the commission

13641364 b. The executive board shall give five business days'
13651365 notice of its public meetings, posted on its website and as it

14071407 (g) Qualified immunity, defense, and indemnification.
14081408 (1) The members, officers, executive director,
14091409 employees, and representatives of the commission shall be
14101410 immune from suit and liability, both personally and in their
14111411 official capacity, for any claim for damage to or loss of
14121412 property or personal injury or other civil liability caused by
14131413 or arising out of any actual or alleged act, error, or
14141414 omission that occurred, or that the individual against whom
14151415 the claim is made had a reasonable basis for believing
14161416 occurred within the scope of commission employment, duties, or
14171417 responsibilities; provided that nothing in this subdivision
14181418 shall be construed to protect any individual from suit or
14191419 liability for any damage, loss, injury, or liability caused by
14201420 the intentional, willful, or wanton misconduct of that
14211421 individual. The procurement of insurance of any type by the
14221422 commission shall not in any way compromise or limit the
14231423 immunity granted under this subdivision.
14241424 (2) The commission shall defend any member, officer,
14251425 executive director, employee, and representative of the
14261426 commission in any civil action seeking to impose liability
14271427 arising out of any actual or alleged act, error, or omission

14731473 individual's employment, duties, or responsibilities for the

14781478 indemnify and hold harmless the individual, provided that the

15251525 §34-9-107. Data System.
15261526 (a) The commission shall provide for the development,
15271527 maintenance, operation, and utilization of a coordinated
15281528 database and reporting system containing licensure, state
15291529 action, and the presence of significant investigative
15301530 information on all licensees and applicants for a license in
15311531 participating states.
15321532 (b) Notwithstanding any other provision of state law to
15331533 the contrary, a participating state shall submit a uniform
15341534 data set to the data system on all individuals to whom this
15351535 compact is applicable as required by the rules of the
15361536 commission, including all of the following:
15371537 (1) Identifying information.
15381538 (2) Licensure data.

15981598 State action information pertaining to a licensee or license
15991599 applicant in any participating state will be available to any

16351635 (g) Any information submitted to the data system that
16361636 is subsequently expunged pursuant to federal law or the laws
16371637 of the participating state contributing the information shall
16381638 be removed from the data system.
16391639 §34-9-108. Rulemaking.
16401640 (a) The commission shall adopt reasonable rules in
16411641 order to effectively and efficiently implement and administer
16421642 the purposes and provisions of the compact. A commission rule
16431643 shall be invalid and have no force or effect only if a court
16441644 of competent jurisdiction holds that the rule is invalid
16451645 because the commission exercised its rulemaking authority in a
16461646 manner that is beyond the scope and purposes of the compact,
16471647 or the powers granted hereunder, or based upon another
16481648 applicable standard of review.
16491649 (b) The rules of the commission shall have the force of
16501650 law in each participating state; provided, however, that where
16511651 the rules of the commission conflict with the laws of the
16521652 participating state that establish the participating state's
16531653 scope of practice as held by a court of competent
16541654 jurisdiction, the rules of the commission shall be ineffective
16551655 in that state to the extent of the conflict.
16561656 (c) The commission shall exercise its rulemaking powers
16571657 pursuant to the criteria set forth in this section and the
16581658 rules adopted thereunder. Rules shall become binding as of the
16591659 date specified by the commission for each rule.

16901690 (d) If a majority of the Legislatures of the
16911691 participating states rejects a commission rule or portion of a
16921692 commission rule, by enactment of a statute or resolution in
16931693 the same manner used to adopt the compact, within four years
16941694 of the date of adoption of the rule, then the rule shall have
16951695 no further force and effect in any participating state or to
16961696 any state applying to participate in the compact.
16971697 (e) Rules shall be adopted at a regular or special
16981698 meeting of the commission.
16991699 (f) Prior to adoption of a proposed rule, the
17001700 commission shall hold a public hearing and allow persons to
17011701 provide oral and written comments, data, facts, opinions, and
17021702 arguments.
17031703 (g) Prior to adoption of a proposed rule by the
17041704 commission, and at least 30 days in advance of the meeting at
17051705 which the commission will hold a public hearing on the
17061706 proposed rule, the commission shall provide a notice of
17071707 proposed rulemaking by all of the following:
17081708 (1) On the website of the commission or other publicly
17091709 accessible platform.
17101710 (2) To persons who have requested notice of the
17111711 commission's notices of proposed rulemaking.
17121712 (3) In other ways as the commission may by rule
17131713 specify.
17141714 (h) The notice of proposed rulemaking shall include all
17151715 of the following:
17161716 (1) The time, date, and location of the public hearing
17171717 at which the commission will hear public comments on the
17181718 proposed rule and, if different, the time, date, and location

17511751 (2) If the hearing is held via telecommunication, video
17521752 conference, or other electronic means, the commission shall
17531753 include the mechanism for access to the hearing in the notice
17541754 of proposed rulemaking.
17551755 (3) The text of the proposed rule and the reason for
17561756 its proposal.
17571757 (4) A request for comments on the proposed rule from
17581758 any interested person.
17591759 (5) The manner in which interested persons may submit
17601760 written comments.
17611761 (i) All hearings will be recorded. A copy of the
17621762 recording and all written comments and documents received by
17631763 the commission in response to the proposed rule shall be
17641764 available to the public.
17651765 (j) Nothing in this section shall be construed as
17661766 requiring a separate hearing on each commission rule. Rules
17671767 may be grouped for the convenience of the commission at
17681768 hearings required by this section.
17691769 (k) The commission, by majority vote of all
17701770 commissioners, shall take final action on the proposed rule
17711771 based on the rulemaking record.
17721772 (1) The commission may adopt changes to the proposed
17731773 rule provided the changes do not enlarge the original purpose
17741774 of the proposed rule.
17751775 (2) The commission shall provide an explanation of the
17761776 reasons for substantive changes made to the proposed rule as

18071807 well as reasons for substantive changes not made that were
18081808 recommended by commenters.
18091809 (3) The commission shall determine a reasonable
18101810 effective date for the rule. Except for an emergency as
18111811 provided in subsection (l), the effective date of the rule
18121812 shall be no sooner than 30 days after the commission issuing
18131813 the notice that it adopted or amended the rule.
18141814 (l) Upon determination that an emergency exists, the
18151815 commission may consider and adopt an emergency rule with 24-
18161816 hours' notice, with opportunity to comment, provided that the
18171817 usual rulemaking procedures provided in the compact and in
18181818 this section shall be retroactively applied to the rule as
18191819 soon as reasonably possible, in no event later than 90 days
18201820 after the effective date of the rule. For the purposes of this
18211821 provision, an emergency rule is one that must be adopted
18221822 immediately in order to do any of the following:
18231823 (1) Meet an imminent threat to public health, safety,
18241824 or welfare.
18251825 (2) Prevent a loss of commission or participating state
18261826 funds.
18271827 (3) Meet a deadline for the adoption of a rule that is
18281828 established by federal law or rule.
18291829 (4) Protect public health and safety.
18301830 (m) The commission or an authorized committee of the
18311831 commission may direct revisions to a previously adopted rule
18321832 for purposes of correcting typographical errors, errors in
18331833 format, errors in consistency, or grammatical errors. Public
18341834 notice of any revisions shall be posted on the website of the

18641864 notice of any revisions shall be posted on the website of the
18651865 commission. The revision shall be subject to challenge by any
18661866 individual for a period of 30 days after posting. The revision
18671867 may be challenged only on grounds that the revision results in
18681868 a material change to a rule. A challenge shall be made in
18691869 writing and delivered to the commission prior to the end of
18701870 the notice period. If no challenge is made, the revision will
18711871 take effect without further action. If the revision is
18721872 challenged, the revision may not take effect without the
18731873 approval of the commission.
18741874 (n) No participating state's rulemaking requirements
18751875 shall apply under this compact.
18761876 §34-9-109. Oversight, Dispute Resolution, and
18771877 Enforcement.
18781878 (a) Oversight.
18791879 (1) The executive and judicial branches of state
18801880 government in each participating state shall enforce this
18811881 compact and take all actions necessary and appropriate to
18821882 implement the compact.
18831883 (2) Venue is proper and judicial proceedings by or
18841884 against the commission shall be brought solely and exclusively
18851885 in a court of competent jurisdiction where the principal
18861886 office of the commission is located. The commission may waive
18871887 venue and jurisdictional defenses to the extent it adopts or
18881888 consents to participate in alternative dispute resolution
18891889 proceedings. Nothing in this subdivision shall affect or limit
18901890 the selection or propriety of venue in any action against a
18911891 licensee for professional malpractice, misconduct, or any
18921892 similar matter.

19231923 (3) The commission shall be entitled to receive service
19241924 of process in any proceeding regarding the enforcement or
19251925 interpretation of the compact or commission rule and shall
19261926 have standing to intervene in a proceeding for all purposes.
19271927 Failure to provide the commission service of process shall
19281928 render a judgment or order void as to the commission, this
19291929 compact, or adopted rules.
19301930 (b) Default, technical assistance, and termination.
19311931 (1) If the commission determines that a participating
19321932 state has defaulted in the performance of its obligations or
19331933 responsibilities under this compact or the adopted rules, the
19341934 commission shall provide written notice to the defaulting
19351935 state. The notice of default shall describe the default, the
19361936 proposed means of curing the default, and any other action
19371937 that the commission may take, and shall offer training and
19381938 specific technical assistance regarding the default.
19391939 (2) The commission shall provide a copy of the notice
19401940 of default to the other participating states.
19411941 (c) If a state in default fails to cure the default,
19421942 the defaulting state may be terminated from the compact upon
19431943 an affirmative vote of a majority of the commissioners, and
19441944 all rights, privileges, and benefits conferred on that state
19451945 by this compact may be terminated on the effective date of
19461946 termination. A cure of the default does not relieve the
19471947 offending state of obligations or liabilities incurred during
19481948 the period of default.
19491949 (d) Termination of participation in the compact shall
19501950 be imposed only after all other means of securing compliance

19811981 have been exhausted. Notice of intent to suspend or terminate
19821982 shall be given by the commission to the Governor, the majority
19831983 and minority leaders of the defaulting state's Legislature,
19841984 the defaulting state's state licensing authority or
19851985 authorities, as applicable, and each of the participating
19861986 states' state licensing authority or authorities, as
19871987 applicable.
19881988 (e) A state that has been terminated is responsible for
19891989 all assessments, obligations, and liabilities incurred through
19901990 the effective date of termination, including obligations that
19911991 extend beyond the effective date of termination.
19921992 (f) Upon the termination of a state's participation in
19931993 this compact, that state shall immediately provide notice to
19941994 all licensees of the state, including licensees of other
19951995 participating states issued a compact privilege to practice
19961996 within that state, of such termination. The terminated state
19971997 shall continue to recognize all compact privileges then in
19981998 effect in that state for a minimum of 180 days after the date
19991999 of said notice of termination.
20002000 (g) The commission shall not bear any costs related to
20012001 a state that is found to be in default or that has been
20022002 terminated from the compact, unless agreed upon in writing
20032003 between the commission and the defaulting state.
20042004 (h) The defaulting state may appeal the action of the
20052005 commission by petitioning the U.S. District Court for the
20062006 District of Columbia or the federal district where the
20072007 commission has its principal offices. The prevailing party
20082008 shall be awarded all costs of such litigation, including

20402040 (i) Dispute resolution.
20412041 (1) Upon request by a participating state, the
20422042 commission shall attempt to resolve disputes related to the
20432043 compact that arise among participating states and between
20442044 participating states and non-participating states.
20452045 (2) The commission shall adopt a rule providing for
20462046 both mediation and binding dispute resolution for disputes as
20472047 appropriate.
20482048 (j) Enforcement.
20492049 (1) The commission, in the reasonable exercise of its
20502050 discretion, shall enforce the provisions of this compact and
20512051 the commission's rules.
20522052 (2) By majority vote, the commission may initiate legal
20532053 action against a participating state in default in the U.S.
20542054 District Court for the District of Columbia or the federal
20552055 district where the commission has its principal offices to
20562056 enforce compliance with the provisions of the compact and its
20572057 adopted rules. The relief sought may include both injunctive
20582058 relief and damages. In the event judicial enforcement is
20592059 necessary, the prevailing party shall be awarded all costs of
20602060 such litigation, including reasonable attorney fees. The
20612061 remedies in this subdivision shall not be the exclusive
20622062 remedies of the commission. The commission may pursue any
20632063 other remedies available under federal or the defaulting
20642064 participating state's law.
20652065 (3) A participating state may initiate legal action

21062106 §34-9-110. Effective Date, Withdrawal, and Amendment.
21072107 (a) The compact shall come into effect on the date on
21082108 which the compact statute is enacted into law in the seventh
21092109 participating state.
21102110 (1) On or after the effective date of the compact, the
21112111 commission shall convene and review the enactment of each of
21122112 the states that enacted the compact prior to the commission
21132113 convening, the charter participating states, to determine if
21142114 the statute enacted by each charter participating state is
21152115 materially different than the model compact.
21162116 a. A charter participating state whose enactment is
21172117 found to be materially different from the model compact shall
21182118 be entitled to the default process set forth in Section
21192119 34-9-109.
21202120 b. If any participating state is later found to be in
21212121 default, or is terminated or withdraws from the compact, the
21222122 commission shall remain in existence and the compact shall
21232123 remain in effect even if the number of participating states
21242124 should be less than seven.

21552155 (2) Participating states enacting the compact
21562156 subsequent to the charter participating states shall be
21572157 subject to the process set forth in Section 34-9-106(c)(23) to
21582158 determine if their enactments are materially different from
21592159 the model compact and whether they qualify for participation
21602160 in the compact.
21612161 (3) All actions taken for the benefit of the commission
21622162 or in furtherance of the purposes of the administration of the
21632163 compact prior to the effective date of the compact or the
21642164 commission coming into existence shall be considered to be
21652165 actions of the commission unless specifically repudiated by
21662166 the commission.
21672167 (4) Any state that joins the compact subsequent to the
21682168 commission's initial adoption of the rules and bylaws shall be
21692169 subject to the commission's rules and bylaws as they exist on
21702170 the date on which the compact becomes law in that state. Any
21712171 rule that has been previously adopted by the commission shall
21722172 have the full force and effect of law on the day the compact
21732173 becomes law in that state.
21742174 (b) Any participating state may withdraw from this
21752175 compact by enacting a statute repealing that state's enactment
21762176 of the compact.
21772177 (1) A participating state's withdrawal shall not take
21782178 effect until 180 days after enactment of the repealing
21792179 statute.
21802180 (2) Withdrawal shall not affect the continuing
21812181 requirement of the withdrawing state's licensing authority or
21822182 authorities to comply with the investigative and state action

22132213 reporting requirements of this compact prior to the effective
22142214 date of withdrawal.
22152215 (3) Upon the enactment of a statute withdrawing from
22162216 this compact, the state shall immediately provide notice of
22172217 the withdrawal to all licensees within that state.
22182218 Notwithstanding any subsequent statutory enactment to the
22192219 contrary, the withdrawing state shall continue to recognize
22202220 all compact privileges to practice within that state granted
22212221 pursuant to this compact for a minimum of 180 days after the
22222222 date of such notice of withdrawal.
22232223 (c) Nothing contained in this compact shall be
22242224 construed to invalidate or prevent any licensure agreement or
22252225 other cooperative arrangement between a participating state
22262226 and a non-participating state that does not conflict with the
22272227 provisions of this compact.
22282228 (d) This compact may be amended by the participating
22292229 states. No amendment to this compact shall become effective
22302230 and binding upon any participating state until it is enacted
22312231 into the laws of all participating states.
22322232 §34-9-111. Construction and Severability.
22332233 (a) This compact and the commission's rulemaking
22342234 authority shall be liberally construed so as to effectuate the
22352235 purposes and the implementation and administration of the
22362236 compact. Provisions of the compact expressly authorizing or
22372237 requiring the adoption of rules shall not be construed to
22382238 limit the commission's rulemaking authority solely for those
22392239 purposes.
22402240 (b) The provisions of this compact shall be severable,

22702270 (b) The provisions of this compact shall be severable,
22712271 and if any phrase, clause, sentence, or provision of this
22722272 compact is held by a court of competent jurisdiction to be
22732273 contrary to the constitution of any participating state, a
22742274 state seeking participation in the compact, or of the United
22752275 States, or the applicability thereof to any government,
22762276 agency, person, or circumstance is held to be unconstitutional
22772277 by a court of competent jurisdiction, the validity of the
22782278 remainder of this compact and the applicability thereof to any
22792279 other government, agency, person, or circumstance shall not be
22802280 affected thereby.
22812281 (c) Notwithstanding subsection b, the commission may
22822282 deny a state's participation in the compact or, in accordance
22832283 with the requirements of Section 34-9-109(b) , terminate a
22842284 participating state's participation in the compact, if it
22852285 determines that a constitutional requirement of a
22862286 participating state is a material departure from the compact.
22872287 Otherwise, if this compact shall be held to be contrary to the
22882288 constitution of any participating state, the compact shall
22892289 remain in full force and effect as to the remaining
22902290 participating states and in full force and effect as to the
22912291 participating state affected as to all severable matters.
22922292 §34-9-112. Consistent Effect and Conflict With Other
22932293 State Laws.
22942294 (a) Nothing in this compact shall prevent or inhibit
22952295 the enforcement of any other law of a participating state that
22962296 is not inconsistent with the compact.
22972297 (b) Any laws, statutes, rules, or other legal
22982298 requirements in a participating state in conflict with the

23292329 compact are superseded to the extent of the conflict.
23302330 (c) All permissible agreements between the commission
23312331 and the participating states are binding in accordance with
23322332 their terms.
23332333 §34-9-113. Judicial Proceedings by Individuals.
23342334 Except as to judicial proceedings for the enforcement
23352335 of this compact among member states, individuals may pursue
23362336 judicial proceedings related to this compact in any Alabama
23372337 state or federal court that would otherwise have competent
23382338 jurisdiction.
23392339 Section 2. This act shall become effective on October
