	19	+	AN ACT
18	20		Relating to Shelby County; to authorize the Shelby
19	21		County Manager to void a motor vehicle licenses and other
20	22		licenses when a check, credit card, or other form of payment
21	23		tendered by an individual, company, or other entity for
22	24		payment of any license is found non-collectible; and to
23	25		provide for the reimbursement from the General Fund of Shelby
24	26		County to the Shelby County License Department for losses by
25	27		the office for errors and omissions.
26	28		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
27	29		Section 1. This act shall only apply in Shelby County.
28	30		Section 2. When a check, credit card, or other form of
29	31		payment tendered by an individual, company, or other entity
30	32		for payment of any motor vehicle license, vessel registration,
31	33		privilege license, door-to-door sales license, rental lease,
32	34		driver license, game and fish license, manufactured home
33	35		registration, or any other license is found to be
34	36		non-collectible, the Shelby County License Department shall
35	37		make a reasonable attempt to retrieve the motor vehicle
36	38		license plate or decal or to retrieve any other license issued
37	39		based on the non-collectible payment and the Shelby County
38		-	Manager may void the registration or license and any sales and
39		-	use taxes, ad valorem taxes, issuance fees, interest,
40		-	penalties, and costs related to the non-collectible payment.
41		-	After the motor vehicle or other licenses have been voided,
42		-	the license department shall receive credit for costs
43		-	associated with the non-collectible check, credit card, or
44		-	instrument issued. The appropriate state office shall mark the

	69	+	based on the non-collectible payment and the Shelby County
	70	+	Manager may void the registration or license and any sales and
	71	+	use taxes, ad valorem taxes, issuance fees, interest,
	72	+	penalties, and costs related to the non-collectible payment.
	73	+	After the motor vehicle or other licenses have been voided,
	74	+	the license department shall receive credit for costs
	75	+	associated with the non-collectible check, credit card, or
74	76		instrument issued. The appropriate state office shall mark the
75	77		records pertaining to the voided license accordingly, and upon
76	78		inquiry by any law enforcement agency, shall notify the agency
77	79		that the party in question is operating under a voided
78	80		license. All violations shall be prosecuted in accordance to
79	81		law.
80	82		Section 3.(a) The Shelby County Commission shall
81	83		reimburse the Shelby County License Department from the
82	84		General Fund of Shelby County up to three thousand dollars
83	85		($3,000), per year, or up to such other amount as may be
84	86		adjusted from time to time by the county commission, for the
85	87		amount of any losses arising or caused by any errors,
86	88		mistakes, or omissions of the Shelby County License
87	89		Department, or agents of the department, if the County
88	90		Manager, or his or her agents, finds the losses were caused
89	91		without personal knowledge, including losses arising from
90	92		acceptance of worthless or forged checks, drafts, money
91	93		orders, credit cards, or other written or online orders for
92	94		money or its equivalent.
93	95		(b) The Shelby County License Department and the Shelby
94	96		County Manager shall ensure that the license department
95	97		employees exercise due care in performing their duties and
96		-	make a diligent effort to correct any error, mistake, or
97		-	omission and collect the amount subject to potential loss
98		-	immediately upon becoming aware of the potential loss. This
99		-	section shall not apply to any deliberate misuse or
100		-	misappropriation of funds by the license department or
101		-	employees of the office.
102		-	Section 4. The provisions of this act are supplemental

132	134		Section 4. The provisions of this act are supplemental
133	135		and it shall be construed in pari materia with other laws
134	136		regarding the Shelby County License Department.
135	137		Section 5. All laws or parts of laws which are indirect
136	138		conflict or inconsistent herewith are hereby repealed.
137	139		Section 6. This act shall become effective on June 1,
138	140		2024.
