18+TO BE ENTITLED
19+AN ACT
1820 Relating to Shelby County; to authorize the Shelby
1921 County Manager to void a motor vehicle licenses and other
2022 licenses when a check, credit card, or other form of payment
2123 tendered by an individual, company, or other entity for
2224 payment of any license is found non-collectible; and to
2325 provide for the reimbursement from the General Fund of Shelby
2426 County to the Shelby County License Department for losses by
2527 the office for errors and omissions.
2628 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2729 Section 1. This act shall only apply in Shelby County.
2830 Section 2. When a check, credit card, or other form of
2931 payment tendered by an individual, company, or other entity
3032 for payment of any motor vehicle license, vessel registration,
3133 privilege license, door-to-door sales license, rental lease,
3234 driver license, game and fish license, manufactured home
3335 registration, or any other license is found to be
3436 non-collectible, the Shelby County License Department shall
3537 make a reasonable attempt to retrieve the motor vehicle
3638 license plate or decal or to retrieve any other license issued
3739 based on the non-collectible payment and the Shelby County
38-Manager may void the registration or license and any sales and
39-use taxes, ad valorem taxes, issuance fees, interest,
40-penalties, and costs related to the non-collectible payment.
41-After the motor vehicle or other licenses have been voided,
42-the license department shall receive credit for costs
43-associated with the non-collectible check, credit card, or
44-instrument issued. The appropriate state office shall mark the

69+based on the non-collectible payment and the Shelby County
70+Manager may void the registration or license and any sales and
71+use taxes, ad valorem taxes, issuance fees, interest,
72+penalties, and costs related to the non-collectible payment.
73+After the motor vehicle or other licenses have been voided,
74+the license department shall receive credit for costs
75+associated with the non-collectible check, credit card, or
7476 instrument issued. The appropriate state office shall mark the
7577 records pertaining to the voided license accordingly, and upon
7678 inquiry by any law enforcement agency, shall notify the agency
7779 that the party in question is operating under a voided
7880 license. All violations shall be prosecuted in accordance to
7981 law.
8082 Section 3.(a) The Shelby County Commission shall
8183 reimburse the Shelby County License Department from the
8284 General Fund of Shelby County up to three thousand dollars
8385 ($3,000), per year, or up to such other amount as may be
8486 adjusted from time to time by the county commission, for the
8587 amount of any losses arising or caused by any errors,
8688 mistakes, or omissions of the Shelby County License
8789 Department, or agents of the department, if the County
8890 Manager, or his or her agents, finds the losses were caused
8991 without personal knowledge, including losses arising from
9092 acceptance of worthless or forged checks, drafts, money
9193 orders, credit cards, or other written or online orders for
9294 money or its equivalent.
9395 (b) The Shelby County License Department and the Shelby
9496 County Manager shall ensure that the license department
9597 employees exercise due care in performing their duties and
96-make a diligent effort to correct any error, mistake, or
97-omission and collect the amount subject to potential loss
98-immediately upon becoming aware of the potential loss. This
99-section shall not apply to any deliberate misuse or
100-misappropriation of funds by the license department or
101-employees of the office.
102-Section 4. The provisions of this act are supplemental

132134 Section 4. The provisions of this act are supplemental
133135 and it shall be construed in pari materia with other laws
134136 regarding the Shelby County License Department.
135137 Section 5. All laws or parts of laws which are indirect
136138 conflict or inconsistent herewith are hereby repealed.
137139 Section 6. This act shall become effective on June 1,
138140 2024.
