1717 AN ACT
1818 Relating to Baldwin County; to amend Section
1919 45-2-231.90, Code of Alabama 1975; to increase service of
2020 process fees.
2121 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2222 Section 1. Section 45-2-231.90, Code of Alabama 1975,
2323 is amended to read as follows:
2424 "ยง45-2-231.90
2525 (a) This section shall only apply to Baldwin County.
2626 (b) The Baldwin County Sheriff Service of Process
2727 Serving Fund is created and hereinafter referred to in this
2828 section as the fund.
2929 (c) The Sheriff of Baldwin County, except for warrants
3030 for arrest, may contract with or enter into contract or
3131 agreement with a private, public, or governmental entity for
3232 the purpose of service of process.
3333 (d)(1) In addition to all existing charges, fees,
3434 judgments, and costs of court, the clerk, sheriff, or other
3535 appropriate court official in the criminal division of the
3636 district and circuit courts of Baldwin County, shall collect a
3737 service of process fee of thirty dollars ($30) fifty dollars

6767 service of process fee of thirty dollars ($30) fifty dollars
6868 ($50) per document which shall be paid into the fund.
6969 (2) In addition to all existing charges, fees,
7070 judgments, and costs of court, the clerk, sheriff, or other
7171 appropriate court official in the civil division of the
7272 district and circuit courts of Baldwin County, shall collect a
7373 service of process fee of thirty dollars ($30) fifty dollars
7474 ($50) per document which shall be paid into the fund.
7575 (3) The clerk, sheriff, or other appropriate court
7676 official shall collect a service of process fee of fifty
7777 dollars ($50) per document for matters originating outside of
7878 Baldwin County which shall be paid into the fund.
7979 (3)(4) The court official designated in Baldwin County
8080 by law for the respective courts shall collect the service of
8181 process fee designated in subdivisions (1) and, (2), and (3)
82-and shall retain three five dollars ($3) ($5) of each fee for
83-deposit in the circuit clerk's fund for the operation of the
84-office of circuit clerk or for compensation or reimbursement
85-of mileage incurred by jurors. The remainder of the fees
86-collected shall be remitted to the sheriff for deposit in the
87-Sheriff's Service of Process Serving Fund.

8888 (e)(1) The sheriff may use the monies generated by this
8989 section for any lawful purpose relating to the operation of
9090 the office of sheriff, including, but not limited to, any of
9191 the following:
9292 a. The operation of the office of sheriff, the jail, or
9393 other correction center; judicial protective services; the
9494 purchase of office supplies and equipment, communications
9595 equipment, personal equipment, uniforms, and automobiles;

125125 equipment, personal equipment, uniforms, and automobiles;
126126 salaries, salary supplements, expense allowances, and
127127 professional dues; training; and related activities.
128128 b. The construction, renovation, furnishing, and
129129 maintenance of offices, buildings, and grounds operated by the
130130 office of sheriff.
131131 c. Any other expenses by the sheriff related to the
132132 enhancement of law enforcement and corrections in the county.
133133 (2) The funds shall not revert to the general fund of
134134 the county at the end of the fiscal year."
135135 Section 2. This act shall become effective on October
136136 1, 2024.
