18	18		Relating to Baldwin County; to amend Section
19	19		45-2-231.90, Code of Alabama 1975; to increase service of
20	20		process fees.
21	21		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
22	22		Section 1. Section 45-2-231.90, Code of Alabama 1975,
23	23		is amended to read as follows:
24	24		"§45-2-231.90
25	25		(a) This section shall only apply to Baldwin County.
26	26		(b) The Baldwin County Sheriff Service of Process
27	27		Serving Fund is created and hereinafter referred to in this
28	28		section as the fund.
29	29		(c) The Sheriff of Baldwin County, except for warrants
30	30		for arrest, may contract with or enter into contract or
31	31		agreement with a private, public, or governmental entity for
32	32		the purpose of service of process.
33	33		(d)(1) In addition to all existing charges, fees,
34	34		judgments, and costs of court, the clerk, sheriff, or other
35	35		appropriate court official in the criminal division of the
36	36		district and circuit courts of Baldwin County, shall collect a
37	37		service of process fee of thirty dollars ($30) fifty dollars

67	67		service of process fee of thirty dollars ($30) fifty dollars
68	68		($50) per document which shall be paid into the fund.
69	69		(2) In addition to all existing charges, fees,
70	70		judgments, and costs of court, the clerk, sheriff, or other
71	71		appropriate court official in the civil division of the
72	72		district and circuit courts of Baldwin County, shall collect a
73	73		service of process fee of thirty dollars ($30) fifty dollars
74	74		($50) per document which shall be paid into the fund.
75	75		(3) The clerk, sheriff, or other appropriate court
76	76		official shall collect a service of process fee of fifty
77	77		dollars ($50) per document for matters originating outside of
78	78		Baldwin County which shall be paid into the fund.
79	79		(3)(4) The court official designated in Baldwin County
80	80		by law for the respective courts shall collect the service of
81	81		process fee designated in subdivisions (1) and, (2), and (3)
82		-	and shall retain three ~~five~~ dollars ($3~~) ($5~~) of each fee for
83		-	~~deposit in~~ the circuit clerk's fund for the operation of the
84		-	~~office of~~ circuit clerk or for compensation or reimbursement
85		-	~~of mileage~~ incurred by jurors. The remainder of the fees
86		-	~~collected shall~~ be remitted to the sheriff for deposit in the
87		-	~~Sheriff's~~ Service of Process Serving Fund.

88	88		(e)(1) The sheriff may use the monies generated by this
89	89		section for any lawful purpose relating to the operation of
90	90		the office of sheriff, including, but not limited to, any of
91	91		the following:
92	92		a. The operation of the office of sheriff, the jail, or
93	93		other correction center; judicial protective services; the
94	94		purchase of office supplies and equipment, communications
95	95		equipment, personal equipment, uniforms, and automobiles;

125	125		equipment, personal equipment, uniforms, and automobiles;
126	126		salaries, salary supplements, expense allowances, and
127	127		professional dues; training; and related activities.
128	128		b. The construction, renovation, furnishing, and
129	129		maintenance of offices, buildings, and grounds operated by the
130	130		office of sheriff.
131	131		c. Any other expenses by the sheriff related to the
132	132		enhancement of law enforcement and corrections in the county.
133	133		(2) The funds shall not revert to the general fund of
134	134		the county at the end of the fiscal year."
135	135		Section 2. This act shall become effective on October
136	136		1, 2024.
