15+SYNOPSIS:
16+This bill would propose an amendment to the
17+Constitution of Alabama of 2022, relating to Baldwin
18+County to define the Bon Secour Landmark District
19+within the county and to prohibit the annexation by
20+local law of any property within the district into any
21+municipality except under certain conditions.

24+AN ACT
1625 To propose an amendment to the Constitution of Alabama
1726 of 2022, relating to Baldwin County, to define the Bon Secour
1827 Landmark District within the county and to prohibit the
1928 annexation by local law of any property within the district
2029 into any municipality except under certain conditions.
2130 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2231 Section 1. The following amendment to the Constitution
2332 of Alabama of 2022, is proposed:
2433 PROPOSED AMENDMENT
2534 (a) For the purposes of this amendment, the "Bon Secour
2635 Landmark District" in Baldwin County is defined as follows:
2736 Beginning at the intersection of the centerline of County Road
28-12 S and the centerline County Road 49; thence run Easterly
29-along the centerline of County Road 12 S to the intersection
30-of the centerline of County Road 12 S and the centerline of
31-County Road 65; thence run Southerly along the centerline of
32-County Road 65 a distance of 3,192 feet, more or less, to a
33-point; thence run Easterly 30 feet, more or less, to the
34-projected west boundary line of parcel
35-05-61-04-39-0-000-001.000; thence run Easterly along the north
36-line of said parcel to the centerline of Bon Secour River;
37-thence run Southwesterly following the meanderings along the
38-centerline and of Bon Secour River approximately 2,500 feet,
39-more of less, to the intersection of Keller Road; thence run
40-Easterly along the centerline of Keller Rd to the intersection
41-of the centerline of Keller Road and the centerline of Helton
42-Drive; thence run Southerly along the centerline of Helton

193+(b) No property within the Bon Secour Landmark District
194+may be annexed into any municipality by local law.
195+(c) Subsection (b) shall not apply to any municipality
196+incorporated after the ratification of this amendment which
188197 includes any part of the Bon Secour Landmark District.
189198 (d) The Bon Secour Landmark District shall not be
190199 considered a legal entity and shall not have any of the
191200 following powers or authority:
192201 (1) Standing to sue or be sued.
193202 (2) Taxing authority.
194203 (3) Zoning authority.
195204 (4) Police power and public safety authority.
196205 (5) Authority to adopt ordinances, rules, or
197206 regulations within its boundaries.
198207 (6) Any other authority or power commonly associated
199208 with a legal entity.
200209 Upon ratification of this constitutional amendment, the
201210 Code Commissioner shall number and place this amendment as
202-appropriate in the constitution omitting this instructional
203-paragraph and may make the following nonsubstantive revisions:
204-change capitalization, hierarchy, spelling, and punctuation
205-for purposes of style and uniformity; correct manifest
206-grammatical, clerical, and typographical errors; revise
207-internal or external citations and cross-references; and
208-translate effective dates.
209-END PROPOSED AMENDMENT
210-Section 2. An election upon the proposed amendment
211-shall be held in accordance with Sections 284, 284.01, and 285
212-of the Constitution of Alabama of 2022, and the election laws
213-of this state. The appropriate election official shall assign
214-a ballot number for the proposed constitutional amendment on
215-the election ballot and shall set forth the following
216-description of the substance or subject matter of the proposed
