20+Relating to Cullman County; to authorize the sheriff to
21+establish procedures for using a credit card or debit card to
22+make purchases provided the proper procedures are followed.
2123 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2224 Section 1. (a) For purposes of this section, the
2325 following terms have the following meanings:
2426 (1) CREDIT CARD. A line of credit issued by a domestic
2527 lender or credit card bank.
2628 (2) DEBIT CARD. A card issued by a bank in relation to
2729 a checking or savings account authorized by law to be expended
2830 at the discretion of the Cullman County Sheriff's Office.
2931 (b) To provide for convenience in making purchases of
3032 tangible personal property or services approved by the
3133 sheriff, the Sheriff of Cullman County may establish
3234 procedures to make certain purchases through the use of a
3335 credit card or debit card issued to the Cullman County
3436 Sheriff's Office.
3537 (c) The sheriff shall adopt written policy and
3638 procedures governing the use of a credit card or debit card,
3739 which, at a minimum shall include each of the following:
38-(1) A monetary limit on the amount of any individual
39-purchase which may be made with a credit card or debit card.
40-(2) A monetary limit on the total monthly amount that
41-may be purchased with a credit card or debit card taking into
42-consideration the monetary limit of the discretionary fund
43-used.
44-(3) Procedures to ensure that the sheriff, or his or

69+which, at a minimum shall include each of the following:
70+(1) A monetary limit on the amount of any individual
71+purchase which may be made with a credit card or debit card.
72+(2) A monetary limit on the total monthly amount that
73+may be purchased with a credit card or debit card taking into
74+consideration the monetary limit of the discretionary fund
75+used.
7476 (3) Procedures to ensure that the sheriff, or his or
7577 her designee, has sole access to any credit card or debit
7678 card, credit card or debit card numbers, access codes, or
7779 security codes.
7880 (4) Procedures to keep accurate records of all
7981 purchases made with a credit card or debit card which shall be
8082 periodically reviewed during required audits.
8183 (5) Procedures to ensure that all credit card or debit
8284 card bills are carefully reviewed by the sheriff each month to
8385 make sure that no unauthorized charges appear on the bill.
8486 (6) Procedures to ensure that all credit card or debit
8587 card bills are paid in full on a timely basis each month to
8688 avoid service charges, late fees, or interest payments.
8789 (d) The sheriff shall select a credit card or debit
8890 card provider or providers taking into consideration each of
8991 the following:
9092 (1) Whether the credit card or debit card issuer
9193 requires an annual fee for using the card.
9294 (2) Whether the credit card or debit card issuer offers
9395 rewards or rebates based upon purchases made using the
9496 account.
9597 (3) The interest rates, service charges, finance
96-charges, or late fees that will be assessed in the event a
97-bill from the credit card or debit card issuer is paid late or
98-the balance is not paid in full.
99-(4) Whether penalties or fees will be assessed against
100-the sheriff in the event he or she decides to terminate the
101-credit card or debit card.
102-(5) Any other consideration deemed relevant by the

127+(3) The interest rates, service charges, finance
128+charges, or late fees that will be assessed in the event a
129+bill from the credit card or debit card issuer is paid late or
130+the balance is not paid in full.
131+(4) Whether penalties or fees will be assessed against
132+the sheriff in the event he or she decides to terminate the
133+credit card or debit card.
132134 (5) Any other consideration deemed relevant by the
133135 sheriff.
134136 (e) In the event a credit card or debit card provides
135137 rewards or rebates based upon the use of the card, any rewards
136138 or rebates earned from the card or cards shall be deposited in
137139 the discretionary account of the Cullman County Sheriff's
138140 Office.
139141 (f) The sole purpose of this section is to provide the
140142 Sheriff of Cullman County a more efficient method of making
141143 payment for authorized purchases of tangible property or
142144 services. Nothing in this section shall authorize the Sheriff
143145 of Cullman County to expend funds in excess of those otherwise
144146 validly appropriated under law. Nor shall anything in this
145147 section authorize the Sheriff of Cullman County to establish a
146148 debt of the Cullman County Commission.
147149 Section 2. This act shall become effective June 1,
