18+Relating to Cullman County; to authorize and direct the
19+sheriff to take certain actions regarding abandoned and stolen
20+firearms.
1921 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2022 Section 1. (a) For the purposes of this section, the
2123 term "firearm" shall have the same meaning as defined in
2224 Section 13A-8-1, Code of Alabama 1975.
2325 (b) The Sheriff of Cullman County shall keep and
2426 maintain a separate permanent record of all abandoned and
2527 stolen firearms not subject to disposition by general law. The
2628 records shall include a description of the firearm, the date
2729 of recovery of the firearm, the serial or other identifying
2830 number, if any, of the firearm, and the place of recovery of
2931 the firearm.
3032 (c) Unless otherwise provided by law, the sheriff may
3133 sell or destroy a firearm if all of the following have
3234 occurred:
3335 (1) The firearm has been recorded pursuant to
3436 subsection (b).
3537 (2) The sheriff has possessed the firearm for at least
36-six months.
37-(3) The owner of the firearm has not claimed the
38-firearm.
39-(d)(1) The sheriff may sell or trade firearms pursuant
40-to subsection (c) only to gun dealers who have held an active
41-business license in this state for at least one year
42-immediately prior to the date of the sale or trade.

67+(2) The sheriff has possessed the firearm for at least
68+six months.
69+(3) The owner of the firearm has not claimed the
70+firearm.
71+(d)(1) The sheriff may sell or trade firearms pursuant
72+to subsection (c) only to gun dealers who have held an active
73+business license in this state for at least one year
7274 immediately prior to the date of the sale or trade.
7375 (2) The sheriff shall establish a procedure to notify
7476 gun dealers of all firearms available for trade or sale.
7577 (3) Proceeds of a sale, after deducting and paying all
7678 expenses incurred in the recovery, maintenance, and sale of
7779 the firearm, shall be dispersed as follows:
7880 a. Seventy percent to the office of the sheriff.
7981 b. Thirty percent to the office of the district
8082 attorney.
8183 (e) The sheriff may establish a procedure to destroy
8284 firearms and may expend necessary sheriff department funds for
8385 that purpose.
8486 Section 2. This act shall become effective on October
8587 1, 2024.
