19+AN ACT
1820 Relating to the Polygraph Examiners Board; to amend
1921 Sections 34-25-2, 34-25-3, and 34-25-20, Code of Alabama 1975,
2022 to define "polygraph device"; to specify that a polygraph
2123 device does not include equipment or devices used for the
2224 prupose of computer voice stress analysis; and to make
2325 nonsubstantive, technical revisions to update the existing
2426 code language to current style.
2527 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2628 Section 1. Sections 34-25-2, 34-25-3, and 34-25-20,
2729 Code of Alabama 1975, are amended to read as follows:
2830 "§34-25-2
2931 For the purposes of this chapter, the following terms
3032 shall have the following respective meanings ascribed by this
3133 section:
3234 (1) BOARD. The Polygraph Examiners Board.
3335 (2) CHAIRMANCHAIR. That The member of the Polygraph
3436 Examiners Board selected by the board to act as chairmanchair.
3537 (3) INTERNSHIP. The study of polygraph examinations and
3638 of the administration of polygraph examinations by a trainee
3739 under the personal supervision and control of a polygraph
38-examiner in accordance with a course of study prescribed by
39-the board at the commencement of such the internship.
40-(4) PERSON. Any natural person, firm, association,
41-copartnership, or corporation.
42-(5) POLYGRAPH EXAMINER. Any person who uses
43-instrumentation described herein in this chapter to test or

72+(4) PERSON. Any natural person, firm, association,

74+(5) POLYGRAPH EXAMINER. Any person who uses
7375 instrumentation described herein in this chapter to test or
7476 question individuals for the purpose of detecting deception or
7577 verifying truth of statements, or any person who holds himself
7678 or herself out to be a lie detector operator or polygraph
7779 examiner, or any person who purports to be able to detect
7880 deception or verify truth of statements through
7981 instrumentation or the use of a mechanical device utilizing a
8082 polygraph instrument .
8183 (6) POLYGRAPH DEVICE. An instrument that, at a minimum,
8284 records visually, permanently, and simultaneously a subject's
8385 cardiovascular pattern, respiratory pattern, and galvanic skin
8486 response. A polygraph device does not include equipment or
8587 devices used for the purpose of computer voice stress
8688 analysis."
8789 "§34-25-3
8890 (a) Every polygraph examiner shall use an instrument
8991 which, as a minimum, records visually, permanently, and
9092 simultaneously:
9193 (1) A subject's cardiovascular pattern;
9294 (2) A subject's respiratory pattern; and
9395 (3) A subject's galvanic skin response a polygraph
9496 device during a polygraph examination .
9597 (b) Patterns of other physiological changes in addition
96-to subdivisions (1), (2), and (3) of subsection (a) may also
97-be recorded during a polygraph examination .
98-(c) The use of any instrument or polygraph device to
99-detect or to verify the truth of statements which does not
100-meet these minimum instrumentation requirements required in
101-Section 34-25-2 is hereby prohibited."

133135 (a) It shall be unlawful for any person, including a
134136 city, county, or state employee, to administer polygraph
135137 examinations or attempt to hold himself or herself out as a
136138 polygraph examiner without a license approved by the board and
137139 issued by the board.
138140 (b) It shall be unlawful for any person, including
139141 city, county, or state employees, to administer polygraph
140142 examinations utilizing any polygraph device or instrumentation
141143 which that does not comply with Section 34-25-3 meet the
142144 requirements of Section 34-25-2 ."
143145 Section 2. This act shall become effective immediately.
