1717 AN ACT
1818 Relating to Calhoun County; to authorize the county
1919 commission and the governing bodies of municipalities to
2020 regulate halfway houses and other similar facilities; and to
2121 provide for enforcement.
2222 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2323 Section 1. For the purposes of this act, the following
2424 terms have the following meanings:
2525 (1) COURT ORDER. An order from a court to reside at a
2626 facility.
2727 (2) FACILITY. Any halfway house; substance abuse
2828 rehabilitation treatment facility; sober living facility; or
2929 any other facility that is housing any resident who: (i) is
3030 enrolled in the facility by court order; or (ii) is supervised
3131 by the Calhoun County Community Punishment and Corrections
3232 Authority, Inc.
3333 (3) HALFWAY HOUSE. Any group residence designed to
3434 facilitate individuals in their readjustment to private life
3535 following their release from institutionalization.
3636 Section 2. (a) The Calhoun County Commission, by
3737 resolution, may regulate facilities in the county. The

6767 resolution, may regulate facilities in the county. The
6868 governing body of a municipality, by resolution, may regulate
6969 facilities in the municipality. The regulations may include,
7070 but are not limited to:
7171 (1) A permit requirement.
7272 (2) Size requirements or limitations.
7373 (3) Location requirements or limitations, including,
7474 but not limited to, required minimum distances from other
7575 specified locations.
7676 (4) Limits on the number of tenants per room.
7777 (b) Any resolution adopted pursuant to this section may
7878 provide for a civil penalty of up to one thousand dollars
7979 ($1,000) to be assessed per day, per resident for each
8080 violation.
8181 (c) Any resolution adopted pursuant to this section
8282 shall provide for notice and a hearing before the assessment
8383 of penalties.
8484 (d) Any resolution adopted pursuant to this section may
8585 be enforced by the respective governing body by an action
8686 against the owner of the facility in the Civil Division of the
8787 Circuit Court of Calhoun County.
8888 (e) Any resolution adopted pursuant to this section
8989 shall prohibit a registered sex offender from residing in any
9090 facility that houses any resident who is enrolled in the
9191 facility by court order or who is supervised by the Calhoun
9292 County Community Punishment and Corrections Authority, Inc.
93-Section 3. This act is repealed on June 1, 2025.
94-Section 4. This act shall become effective on June 1,
