18 | 18 | | Relating to Calhoun County; to authorize the county |
---|
19 | 19 | | commission and the governing bodies of municipalities to |
---|
20 | 20 | | regulate halfway houses and other similar facilities; and to |
---|
21 | 21 | | provide for enforcement. |
---|
22 | 22 | | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: |
---|
23 | 23 | | Section 1. For the purposes of this act, the following |
---|
24 | 24 | | terms have the following meanings: |
---|
25 | 25 | | (1) COURT ORDER. An order from a court to reside at a |
---|
26 | 26 | | facility. |
---|
27 | 27 | | (2) FACILITY. Any halfway house; substance abuse |
---|
28 | 28 | | rehabilitation treatment facility; sober living facility; or |
---|
29 | 29 | | any other facility that is housing any resident who: (i) is |
---|
30 | 30 | | enrolled in the facility by court order; or (ii) is supervised |
---|
31 | 31 | | by the Calhoun County Community Punishment and Corrections |
---|
32 | 32 | | Authority, Inc. |
---|
33 | 33 | | (3) HALFWAY HOUSE. Any group residence designed to |
---|
34 | 34 | | facilitate individuals in their readjustment to private life |
---|
35 | 35 | | following their release from institutionalization. |
---|
36 | 36 | | Section 2. (a) The Calhoun County Commission, by |
---|
37 | 37 | | resolution, may regulate facilities in the county. The |
---|

68 | 68 | | governing body of a municipality, by resolution, may regulate |
---|
69 | 69 | | facilities in the municipality. The regulations may include, |
---|
70 | 70 | | but are not limited to: |
---|
71 | 71 | | (1) A permit requirement. |
---|
72 | 72 | | (2) Size requirements or limitations. |
---|
73 | 73 | | (3) Location requirements or limitations, including, |
---|
74 | 74 | | but not limited to, required minimum distances from other |
---|
75 | 75 | | specified locations. |
---|
76 | 76 | | (4) Limits on the number of tenants per room. |
---|
77 | 77 | | (b) Any resolution adopted pursuant to this section may |
---|
78 | 78 | | provide for a civil penalty of up to one thousand dollars |
---|
79 | 79 | | ($1,000) to be assessed per day, per resident for each |
---|
80 | 80 | | violation. |
---|
81 | 81 | | (c) Any resolution adopted pursuant to this section |
---|
82 | 82 | | shall provide for notice and a hearing before the assessment |
---|
83 | 83 | | of penalties. |
---|
84 | 84 | | (d) Any resolution adopted pursuant to this section may |
---|
85 | 85 | | be enforced by the respective governing body by an action |
---|
86 | 86 | | against the owner of the facility in the Civil Division of the |
---|
87 | 87 | | Circuit Court of Calhoun County. |
---|
88 | 88 | | (e) Any resolution adopted pursuant to this section |
---|
89 | 89 | | shall prohibit a registered sex offender from residing in any |
---|
90 | 90 | | facility that houses any resident who is enrolled in the |
---|
91 | 91 | | facility by court order or who is supervised by the Calhoun |
---|
92 | 92 | | County Community Punishment and Corrections Authority, Inc. |
