| 20 | 22 | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: | |
| 21 | 23 | Section 1. (a)(1) For purposes of this section, the | |
| 22 | 24 | term "motor vehicle" means a motor vehicle as defined in | |
| 23 | 25 | Section 40-12-240 of the Code of Alabama 1975, excluding any | |
| 24 | 26 | trailer qualifying as a utility trailer. | |
| 25 | 27 | (2) The Marengo County Commission may levy an | |
| 26 | 28 | additional annual issuance fee, not to exceed five dollars | |
| 27 | 29 | ($5), for each motor vehicle tag issued in the county or | |
| 28 | 30 | otherwise subject to ad valorem taxation by the county unless | |
| 29 | 31 | specifically exempted therefrom. | |
| 30 | 32 | (3) The additional fee authorized by this section shall | |
| 31 | 33 | become due at the same time the state license and registration | |
| 32 | 34 | fee becomes due pursuant to Section 32-6-61, provided that the | |
| 33 | 35 | additional annual fee is not collected more than once in a | |
| 34 | 36 | 12-month period per vehicle. | |
| 35 | 37 | (4) Any fee levied pursuant to this section may be | |
| 36 | - | removed at the discretion of the county commission provided | |
| 37 | - | the removal does not affect any contractual obligation. | |
| 38 | - | (b) Any person who is 65 years of age or older, upon | |
| 39 | - | verified proof of age, shall be granted an exemption from | |
| 40 | - | payment of the issuance fee levied pursuant to subsection (a) | |
