17+AN ACT
1618 Relating to Marengo County; to provide for an
1719 additional issuance fee for motor vehicle tags; to provide for
1820 distribution of the revenue, and to provide for retroactive
1921 effect.
2022 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2123 Section 1. (a)(1) For purposes of this section, the
2224 term "motor vehicle" means a motor vehicle as defined in
2325 Section 40-12-240 of the Code of Alabama 1975, excluding any
2426 trailer qualifying as a utility trailer.
2527 (2) The Marengo County Commission may levy an
2628 additional annual issuance fee, not to exceed five dollars
2729 ($5), for each motor vehicle tag issued in the county or
2830 otherwise subject to ad valorem taxation by the county unless
2931 specifically exempted therefrom.
3032 (3) The additional fee authorized by this section shall
3133 become due at the same time the state license and registration
3234 fee becomes due pursuant to Section 32-6-61, provided that the
3335 additional annual fee is not collected more than once in a
3436 12-month period per vehicle.
3537 (4) Any fee levied pursuant to this section may be
36-removed at the discretion of the county commission provided
37-the removal does not affect any contractual obligation.
38-(b) Any person who is 65 years of age or older, upon
39-verified proof of age, shall be granted an exemption from
40-payment of the issuance fee levied pursuant to subsection (a)
41-for one motor vehicle.
42-(c) The funds collected pursuant to this section shall

67+(4) Any fee levied pursuant to this section may be

7375 be deposited into a special fund to be held by the county
7476 commission to be distributed to the Marengo County Economic
7577 Development Authority and for improvements to the Marengo
7678 County road system as authorized by the county commission.
7779 Section 2. This act shall be retroactive to October 1,
7880 2022, and any fees collected and the distribution and
7981 expenditure of any funds in accordance with this act after
8082 October 1, 2022, are ratified and confirmed.
8183 Section 3. This act shall become effective immediately.
